Based upon our review of the proposed amendments to relocate the seismic monitoring instrumentation " Limiting Conditions for Operation", and
" Surveillance Requirements" from the Technical Specifications to the Updated Final Safety Analysis Report, we consider the proposed chances acceptable.
Our safety evaluation is provided as Attachment 1.

and the associated Tables 3.3-7 and 4.3-4, and Bases 3/4.3.3.3 contained in the TS, to the Updated Final Safety Analysis Report (UFSAR).
I BACKGROUND:
The " Final Policy Statement on Technical Specifications Improvements for Nuclear Power Reactors" (FPSTSI) published by the NRC in the Federal Register on July 22, 1993 (58 FR 39132) discusses revised criteria for defining the scope of the TS as required by 10 CFR 50.36.
In particular, the FPSTSI enumerates four criteria that delineate the classes of technical material that should be included in the TS.

The Civil Engineering and Geosciences Branch (ECGB) staff has reviewed the request for relocation of the TS LCO 3.3.3.3, the SR 4.3.3.3, and associated 4'
Tables 3.3-7 and 4.3-4, and' Bases 3/4.3.3.3 for Seismic Monitoring Instrumentation from the Technical Specifications contained in the TS sections 3.3.3.3 and 4.3.3.3 to the Updated Final Safety Analysis Report (UFSAR). The requirements described in the affected sections of the TS will be maintained i
and any subsequent changes to the UFSAR or equivalent controlled document, related to these instruments, will be made in accordance with 10 CFR 50.59.
The request was evaluated uti?izing the four criteria set forth in the above j
i NRC FPSTSI. The proposed amendment does not involve changes in which the plant will be operated, maintained, or tested. The requirements described in the affected sections of the TS will be maintained and any subsequent changes i
to the UFSAR or equivalent controlled documents, related to these instruments,
.will be made in accordance with 10 CFR 50.59.
In addition, the licensee has informed the NRC that the present complement of seismic instruments, accompanying recording-instrumentation, and controls will be updated.
Appendix A to 10 CFR Part 100 requires that SNI be provided to promptly determine the severity of any earthquake induced ground motion affecting the i
plant and evaluate its effects on the plant, including initiating shutdown procedures if certain specified ground motion criteria have been exceeded.
However, tho SMI are not considered part of the accident analysis as outlined j.

e by the NRC FPSTSI criteria 1 through 4, nor do they affect the margin of safety of the plant.
On this basis, the staff concludes that TS LC0 3.3.3.3, TS SR 4.3.3.3. Tables 3.3-7 and 4.3-4 the Bases for TS 3/4.3.3.3 may be relocated to the UFSAR.
Any future changes to the SMI requirements will be controlled by 10 CFR 50.59.
The ECGB staff has not reviewed the proposed upgrade of the seismic instrumentation because no specific information was provided to the staff.
However, such a review will take place when the UFSAR amendment is submitted for review.

The licensee requested the relocation of the seismic monitoring instrumentation Limiting Condition for Operation 3.3.3.3, Surveillance i
Requirements 4.3.3.3, associated Tables 3.3-7 and 4.3-4, and Bases 3/4.3.3.3, contained in the Technical Specifications, to the Updated Final Safety Analysis Report, section 3.7.4.
The licensee stated that as part of the change request it would upgrade the seismic monitoring instrumentation system.
The NRC staff reviewed the material submitted with the initial request and information that was provided following a telephone conference.
In the final conclusion the NRC staff recommended that the FPL be granted their request for 1
relocation of the seismic instrumentation technical specifications to the UFSAR.
