EXEMPTION FROM SUBMITTAL DATE FOR UPDATED FACILITY DESCRIPTION AND SAFETY ANALYSIS (FDSA)

Re: Haddam Neck Plant On April 11, 1985, the NRC issued an exemption from certain requirenents of Section 50.71(e) of 10 CFR 50 in response to a request from Connecticut Yankee Atomic Power Company (CYAPC0) dated February 4,1985. That exerption permitted a six-month extension, from date of issuance, for the submission of an updated FDSA for Haddam Neck. Also, the staff stated that any additional exemptions from compliance with 10 CFR 50.71 would be granted by the Director of Licensing, ONRR, only upon the review and apprnval of a program plan containing schedules and milestones for the submittal of the updated FDSA.

On July 31, 1985, the NRC issued the results of its screening review for the topics to be included in the Integrated Safety Assessment Program (ISAP) scope of review for Haddam Neck. In that scope of review, the staff included the FDSA update, designated as ISAP Topic 1.15. By letter dated September 13, 1985, CYAPC0 requested an additional exemption from the schedular requirements of 10 CFR 50.71(e) for Haddam Neck. In that letter, in additien to the fact that this facility is participating in ISAP, it was pointed out that a number of other projects at Haddam Neck, as well as at Millstone Units 1, 7 ard 3, will impact the quality of the FDSA update. That is, there are cther ongoing projects that will not only affect the resource requirements fer performing the FPSA update but the results of the projects should be an integral part'of the update.

Therefore, CYAPC0 requested that the submission date be extended to June 30, 1987. However, the staff, by letter dated October 2, 1985 informed CYAPC0 that information submitted in its September 13, 1985 exemption request was not responsive to the terms identified in the exemption granted on April II,1085.

That is, the staff determined that a plan containing the required milestones and schedule, demonstrating a good faith effort to reasonably achieve compliance, had not been provided.

By letter dated October 11,1985, CYAPC0 resubmitted its request for a schedular exemption to the requirements of 10 CFR 50.71(e). In that letter, CYAPCO provided milestones and schedules for the submittal of the component parts of an updated FDSA and for completion of the entire FDSA update. In summary, CYAPC0 proposes to provide: (1) stand alone document descriptions such as emergency planning, by April 30, 1986; (2) updated accident analyses by June 30,1986;(3) updated system descriptions and piping and instrumentation diagrams by July 1,1986; and (4) the major part of the FDSA update by March 31, 1987 with the balance submitted by June 30, 1987. Accordingly, CYAPC0 requested formal relief from the schedular requirements of 10 CFR 50.71(e) until June 30, 1987 for the Haddam Neck Plant. This date will allow time for the additional editing and changes necessary to ensure overall document consistency when the individual components-are incorporated into the updated FDSA.

The staff has evaluated the October 11, 1985 exemption request. The results of the staff's evaluation, as described in the enclosed Exemption, find that your request for an addition exemption meets the requirements identified in the original exemption issued on April 11, 1985. An exemption until June 30, 1987 is being granted for the submittal of an updated FDSA provided that milestones described above are met.

An Environmental Assessment and Finding of No Significant Impact for this action was published in the Federal Register on _Nov. 21,1985(50 FR 48144) .

This exemption is being forwarded to the Office of the Federal Register for publication.
