EXEMPTION FROM 10 CFR 50.71(e), FSAP UPDATES Re:

Haddam Neck Plant and Hillstone Unit 1 On, February 4,1985, Connecticut Yankee Atomic Power Company (CYAPCO) and Northeast Nuclear Energy Company (NNECO) requested an exemption frcm the schedular reoutrement of 10 CFR 50.71(e)(3)(ii) for submittal of an updated; Safety Analysis Report (FSAR) y Analysis (FDSA) for Haddam Neck and Final Facility Description and Safet for Millstone Unit No. 1.

On April 11, 1985, the NRC granted an exemption from the requirements of 10 CFR 50.71(e) for both Haddam Neck and Millstone Unit No. 1 for a period of six months.

Further, the April 11, 1985 letter states that "any additional exemptions from ccmpliance with 10 CFR 50.71 will be granted by the Director of Licensing, ONRR, only upon the review and approval of a program plan containing schedules or milestones for the submittal of ar updated FSAR."

On September 13,1985, CYAPC0 and NNECO requested another schedular exemption from 10 CFR 50.71(e). CYPACO and NNECO have proposed submittal of initial updates of the FDSA and FSAR by June 20, 1987 and stated that the necessary resource burden (approximately 20,000 person hours) would be explicitly considered in the Integrated Safety Assessment Program (ISAP) efforts.

The staff has reviewed the exemption requests and has concluded that the requests are not responsive to the terms identified in the exemptions granted on April 11, 1985. These exemptions stated that detailed program plans were to be provided in any future exemption request. We have reviewed your September 1985 submittal and conclude that a plan containing the required milestones and schedules, demonstrating a good faith effort to reasonably achieve compliance, has not been provided.

Based upon the above, we deny your September 13, 1985 application for 4

exemptions from 10 CFR 50.71(e) for the Haddam Neck Plant and Hillstone Unit 1, respectively.

to reasonably achieve ccmpliance under which subsequent requests for further exemption from 10 CFR 50.71(e) would be considered. These conditinns include the submittal of partial updates of FDSA and FSAR sections on a schedule to be i

approved by the staff. These conditions also include the submittel of a r

complete set of systems descriptions and piping and instrumentation dravires 4

for each of the units by no later than July 1,1086.

In addition, the staff would expect that under this program a description of the currer.t licensino basis and a major part of the FDSA and FSAR updates would be provided by December 1986 and March 1987 for Millstone Unit 1 and Haddan Heck, respectively.

Selected other partiel updates, including the ongoing evaluations and the accident and transient analyses being developed for Paddam Neck, are to be provided on a schedule consistent with your ISAP initiatives.

Should the licensees reauest exemptions fron 50.71(c) for Millstone Unit 1 and the Haddan Neck Plant, the exemption requests must contain a coinprehensive plan for the submittal of an updated FDSA and FSAP and be submitted by October 11, 1985.

If a conprehensive exemption recuest is not received by that date, j
