COMSECY-96-056:
DSI 6 - HIGH-LEVEL WASTE I support the Commission's preliminary view to maintain the current program on high-level waste (HLW) and spent fuel (Option 3).
This includes strong support for our fiscal year 1998 budget request of $17 million so that all 10 key technical issues (KTIs) can be addressed in time for the 1998 viability assessment performed by the Department of Energy on the Yucca Mountalt Sito.
Consistent with Option 3. I believe that the Commission should give priority to interactions with the Environmental Protection Agency as it carries out its responsibility to set appropriate and implementable repository performance standards.
Should legislation be passed that requires a significant change in the NRC program, the NRC will need to be in a position to rapidly implement such a change. The current program, so long as it can address all the KTIs provides that flexibility.
On the related issues in the paper. I believe that the staff needs to promptly address any changes required in our regulatory process to deal efficiently with dual-purpose (storage and transportation) spent fuel containers. At this point, I have no basis to object to the staff inclination to grant the l
petition for rulemaking from a decommissioning licensee to. modify Part 72 to orovide for storage of greater than class C waste.
