This is in response to your letter dated Septmber 23, 1985, which transmitted revised portions (Revision 4 - September,1985) of your Fundamental Nuclear Material Control (FNMC) Plan under the provisions of both 10 CFR 70.32(c) and 70.34. The 10 CFR 70.34 change (FRIC Plan page No. 3-2, Sub-Section 3.4.1.1) was made in response to our generic letter dated December 20, 1984, concerning the receipt of UF which is currently covered by License Condition 6.5 to Amendment MPP-3 your License No. SMi-33.

Our review has determined that both the 10 CFR 70.32(c) and 70.34 revisions are acceptable in that they do not decrease the effectiveness of your safeguards program and will not adversely affect the comon defense and security nor the public health and safety, and is otherwise in the public interest. We are also taking this opportunity to recognize the Region III May 30, 1985, approval of certain FNMC Plan revisions (Revision 3) dated January 1985, under the provisions of 10 CFR 70.32 (c) .

In order to implanent the aforernentioned approvals, current License ?.cnditions 2.1, 3.1 and 6.5 to Amendment MPP-3 to your License No. SNM-33 are hereby revised , effective imediately, to incorporate the FM1C Plan changes (Revision 3) dated January 1985 and (Revision 4) dated September 1985. The revised License Conditions are as follows:

2,1 The licensee shall follow the Fundamental Nuclear Material Control (FNMC) Plan dated January 1977; as amended December 1977, April 1978, February 1979 and pages marked Revision 2 - February 1981, Revision 3 -

January 1985 (as approved by Region III May 30, 1985,) Revision 4 -

Septsber 1985; and as revised in accordance with the provisions of 1

10 CFR 70.32(c).

3.1 Except as allowed in License Condition 6.5 for UF , the licensee or hisdesignatedagentshallmeasure,exceptasspebifiedin10CFR 70.58(e), the uranium and U-235 content of all special nuclear material receipts, shipnents, waste discards, and material inventoried.

9 C-E Power Systems 6.5 Notwithstanding the requirments of 10 CFR 70.58(e) and License Condition 3.1, measurenents for uranium hexafluoride receipts which do not exceed 6% in the isotope U-235 may be perfoured in accordance with the procedures (Section 3.4.1.1 - Revision 4 dated Septerber 1985 of the FNMC Plan) enclosed with the licensee's letter dated Septanber 23, 1985.

We have detennined that the attachrent to your September 23, 1985, letter contains infonnation of the type specified in 10 CFR 2.'790(d) . Accordingly, pursuant to Section 2.790(d) (1), such information is dested to be cmmercial or financial within the meaning of 10 CFR 9.5(a) (4), and shall be withheld fran public disclosure, unless subject to the provisions of 10 CFR 9.12.
