PROPOSED NOTICE OF RULEMAKING -- 100 PERCENT RECOVERY FOR FY 1997 Attached for your action are the following items relating to the publication of the subject proposed rule which was signed by the Acting Chief Financial Officer on February 19, 1997,
- 1. Original and 25 copies of the Proposed Notice of Rulemaking - 10 1 CFR Parts 170 and 171. '
- 2. Six Congressional letters relating to the proposed rule. l
- 3. Draft public announ' cement. l

The proposed rule is consistent with previous Commission fee policy decisions and does not constitute a significant question of solicy nor does it amend regulations contained in 10 CFR Part 7. 8, or 9 Su)part C concerning matters of policy. Note that the 3roposed rule has been discussed with the Office of Enforcement. They agree t1at no changes to the Criminal Penalties or Enforcement Policy provisions need to be made at this time. ,
Given the time urgency, the proposed rule should be published imediately. We are also attaching for your files a copy of the " Approved for Publication" and
" Weekly Staff Notes to the Commission.'
