SUBJECT:

FEES FOR SAFEGUARDS REVIEW 0F LICENSE ret!EWAL APPLICATIONS This responds to your March 23, 1982 memorandum, which requested a decision as to whether licensees should be charged for the routine safeguards reviews per-l formed by your office of license renewal applications.

Your memorandum stated that the Division of Safeguards discontinued its participation in the renewal process years ago, and that the purpose of your review is to assure that no inconsistencies exist between the licensee's currently approved material control plan and the information (non-safeguards) contained in the renewal application.

(We understand that the Fundamental Nuclear Material Control plans are reviewed.

l approved, and constantly maintained in a current status separate and apart from the renewal application).

Based on the information contained in your memorandum, we agree that a fee should not be charged for your review of renewal applications for safeguards purposes, provided that (1) the review is done solely for the purpose of determining the compatability of the information contained in the application with the licensee's already approved material control plan, (2) no safeguards information has been specifically included in the renewal application for review, and (3) no safeguards licensing action is required.
