WOLF CREEK ALLEGATION PROGRAM ASSESSMENT In accordance with agreements reached at the meeting on September 11, 1984, among representatives from Region II, Region III, Region IV, and the Office of Inspection and Enforcement, and in subsequent telephone conversations between J. H. Taylor and R. P. Denise, I request that I&E assist Region IV in an assessment of the allegations efforts related to the Wolf Creek Generating Station The assessment should include the following phases:

1. An assessment of the structure of the utility program on allegations received by them, chiefly in their Quality First Program. Attributes assessed should include program placement in the utility organization, organizational independence, delineation of responsibilities within the Quality First Organization, precision and adequacy of decision-making process within Quality First, number and qualification of personnel, formality of effort as reflected in offical instructions, information flow instructions (including alleger notification),

record keeping, ~ management notification, trending, assessment of trends, etc.

2. An assessment of the implementation of the utility program on allegations received by them, chiefly in the Quality First Program.

- This assessment should be focused on a determination of whether the utility program is being effectively implemented, and implemented as planned. The NRC assigned personnel should review a significant selected sample of allegations received by the utility for verifi-cation of program implementation. Attributes to be assessed include progress of effort toward resolution (is the backlog maintained at a reasonably low level), priority treatment, timeliness of effort, clarity of corrective actions and other decisions, adequacy of documentation and record retention, adequacy of technical support and rationale for disposition, etc.

3. An assessment of the NRC/RIV effort on allegation management and closeout related to the Wolf Creek plant.

In the conduct of this assessment, all personnel need to be careful not to disclose the identity of those persons making allegations to the utility or to the NRC.

es I have assigned Mr. Glen Madsen of Regi.on IV to participate in this effort. Based on discussions with Mr. J. Taylor and Mr. W. Haass, I under-stand that W. Haass, E. Fox, and one other person have been designated as I&E participants. I expect Mr. Haass to execute the lead role. The effort is presently scheduled to start on September 25, 1984, when the team arrives at the Wolf Creek plant site. . A completed effort, including final report to be issued by the RIV Task Force Director, should be scheduled for no later than October 19, 1984.

We appreciate the I&E assistance on this matter. If there are any questions or required clarifications, please have your staff contact me.

PROPOSED IMPOSITION OF CIVIL PENALTY - $64,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Sixty-Four Thousand Dollars ($64,000) will be issued on or about September 27, 1984 to Kansas Gas and Electric Company. This action is based on discrimination by the licensee against an employee for engaging in a protected activity as a Quality Assurance inspector. The discrimination was evidenced by a complaint filed by a Quality Assurance Inspector and affirmed by the Secretary of Labor, that he had been placed on probation, teminated, and refused reemployment for reporting quality assurance discrepancies and safety problems to the licensee's Quality Assurance Manager. The discrimination involved a managernent level ahnve the first line of supervision. It should be noted that the licensee has not been specifically infomed of the enforcement action. The Regional Administrator has been authorized by the Director of the Office of Inspection and Enforcement to sign this action. The schedule of issuance and notification is: Mailing of Notice September 27, 1984 Telephone Notification of Licensee September 27. 1984 A news release has been prepared and will be issued about the time the licensee receives the Notice. The State of Kansas will be notified. The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
