- Bob, In reference to an overriding concern with Salem, I think we need to address the effect of the recurring issues on the transient, such as inade'uate corrective action of long-standing problems (e.g., the MS-10J, the steam flow spiking and rod control).
10 CFR 2, Appendix C, section I. states: " Consistent with the purpose of this program, prompt and vigorous enforcement action will be taken when dealing with licensees...who do not achieve the necessary meticul2H2 attention to detail and the high standard of compliance which the NRC expects."
Section IV. states: "The NRC reviews each case being considered for enforcement action on its own merits to ensure that the severity of a violation is characterized at the level l
best suited to the significance of the particular violation.
In some cases, special circumstances may warrant an adjustment to the severity j
level categorization."
Finally, section IV.A. states: "The purpose of aggregating violations is to focus the licensee's attention on the fundamental underlying causes for which enforcement action appears warranted and to reflect the fact that several violations with a i
common cause may be more significant collectively than indivicually and may therfore, warrant a more substantial enforcement action.
In addition, a civil penalty for multiple occurrences of a violation with the same root cause may be subject to escalation of the base civil penalty."
i One common theme to be considered: this is the fourth AIT in four years.
That fact alone demonstrates a lack of meticulous attention to detail.
Underlying causes include inadequate corrective action and inadequate work control.
Part 2 provides us the ability to send the i
licensee a strong message about the performance trend of the past four 4
years (at least) which has not yet been corrected.
We need to tell them that they must put an and to the type of performance that leads to AITs if we are going to allow them to continue to operate the Salem units.
