Dear Mr. Mills:

I am responding to your letter of January 8,1997, to Chairman Jackson of the U.S. Nuclear Regulatory Comission (NRC) in which you forwarded a copy of a letter dated January 8,1997, to Samuel Collins of the NRC from David Lochbaum of the Union of Concerned Scientists. You state that in his letter, Mr. Lochbaum alleged that the NRC staff made a technical error in its evaluation of the 10 CFR 2.206 petition on the Millstone Unit I refueling i practices by using spent fuel pool water temperature as the limiting factor l when the design and licensing basis for decay time has nothing to do with

! decay heat removal but is based exclusively on the offsite dose consequences.

l As you may be aware, Mr. Lochbaum retracted his January 8 letter in a letter dated January 17, 1997. As noted by Mr. Lochbaum in his retraction letter, all of the Millstone Unit 1 fuel offloads were bounded by the fuel-handling accident analysis previously performed by the licensee.

If you have any other questions on this issue, please contact Mr. Stephen Dembek at (301) 415-1455. Mr. Dembek is the petition manager for the 10 CFR 2.206 petition that Mr. Lochbaum referenced in his letters.
