Dear Chairperson Jackson:

Please review the enclosed E-Mail dated January 8,1997, which is a copy of a letter from David A. Lochbaum to Samuel J. Collins of the NRC. Mr. Lochbaum alleges that the NRC made a technical error in evaluation of the 10 CFR2.206 petition on the Millstone Unit I refueling practices by using spent fuel pool water temperature as the limiting factor when the design and licensing bases for decay time has nothing to do with decay heat removal but is based exclusively on the offsite dose consequences. Note that the NRC spent 16 months investigating the petition before reaching a conclusion. If Mr.

Lochbaum's allegatien is valid it means that the NRC is technical incompetent. Doubting that the NRC is incompetent and knowing that Mr. Lochbaum is technical competent I went seeking a answer. My nuclear friends believe that the apparent NRC misjudgment was deliberate. If so, than the NRC is playing games with Nuclear Safety Concerns which is unacceptable in the public's eyes.

Please clarify the problem discussed above. As an owner of residential proper; 4 miles from a nuclear power plant I am concerned. Thank you.
