Dear Ms. Bell:

This is a fourth partial response to your letter dated September 5,1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of documents pertaining to four categories of information regarding Notices of Violation at the Catawba plant.

The documents listed on the enclosed Appendix H are responsive to your request and are being placed in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555. You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting folder F01A-84-727 under your name.

Portions of the documents listed on the enclosed Appendices I and J and the entire document listed on the enclosed Appendix K are being withheld from public disclosure based upon the exemptions of the F0IA indicated on the Appendices. The nonexempt portions of the documents are being placed in the PDR under your name. Information withheld pursuant to Exemptions (6) and (7)(C) consists of names and identifying details the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. This informa-tion is being withheld from public disclosure pursuant to Exemptions (6) and (7)(C) of the F0IA (5 U.S.C. 552(b)(6) and (7)(C)) and 10 CFR 9.5(a)(6) and (7)(iii) of the Commission's regulations. Information withheld pursuant to Exemption (7)(D) consists of the name and other identifying information of an individual. Because disclosure of this information would disclose the identity of a confidential source, it is being withheld from public disclosure pursuant toExemption(7)(D)oftheF0IA(5U.S.C.552(b)(7)(D))and10CFR9.5(a)(7)

(iv) of the Commission's regulations.

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclo-sure and that its production or disclosure is contrary to the public interest.

The person responsible for the denial of portions of the documents listed on Appendix I is the undersigned. The person responsible for the denial of par-tions of the documents listed on Appendix J and the entire document listed on Appendix K is Mr. Ben B. The denial by the undersigned may be appealed to the Executive Director for Operations (ED0) within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the EDO, U.S. Nuclear Regulatory ,

Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denials by Mr. Hayes may be appealed within 30 days to the Comission and should be addressed to the Secretary of the Commission.

The staff is continuing to review records subject to your request. We will notify you as soon as possible with regard to the remaining records.

Dear Mr. Felton:

Pursuant to the Freedom of Information Act, 5 U.S.C. 522, as amended, the Nuclear Information and Resource Service requests the following documents regarding a Notice of Violation at the Catawba plant. Please consider " documents" to include reports, studies, test results, correspondence, memoranda, meeting notes, meeting minutes, working papers, graphs, charts, diagrams, notes and summaries of conversations and interviews, computer records, and any other forms of written communication, including internal NRC Staff memoranda. In your resoonse. olease identify which documents corresoond to which reauests below.

Pursuant to this request, please provide all documents prepared or utilized by, in the possession of, or routed through the NRC related to:

1. The Notices of Violation 84-88-01 and 84-39-01 (associated with Inspection Reports 50-413-84-88 and 50-414-84-39, respectively), concerning " Inadequate Implementation of Quality Assurance Requirements in the Welding Program";
2. All " raw data" (14. telephone interviews, affidavits, notes),

studies, and analyses done by Duke Power Company, the Brookhaven National Laboratory, and other consultants relating to investigation (s) by Duke Power Company in connection with the

" Welder B" issue, and the above-referenced Notices of Violation;

3. All araw data", studies and analyses done by or for the NRC Staff (or its consultants) for the NRC Staff's investigation of the " Welder B" issue and the above-referenced Notices of Violation; and
4. The NRC Steff review of the Duke Power investigation and documents related to the investigation.

In our opinion, it is appropriate in this case for you to waive search charges, pursuant to 5 U.S.C. 552(a)(4)(A) "because furnisring the information can be considered as primarily benefiting the general public." The Nuclear Information and Resource Service is a non-profit organization serving local organizations concerned about nuclear power and providing infor-mation to the general public. Information required by 10 CFR 9.14a was provided by letter dated August 3, 1984. The documents requested by this letter will be used by the intervenors, the Palmetto Alliance, in the Catawba operating license proceeding.

Insofar as the information can lead to a full and public airing of issues related to public safety, in an ajudicatory proceeding, the release of such documents will benefit the public living near and around the Catawba plant.

I look forward to a response within the ten working days allowed by law.
