Request for Amendment to License TR-3 Docket No. 50-30 for Reinstatement of Possess-But-Not-0perate Status.

Edward A. Richley being first duly sworn, says that:

In accordance with the applicable sections of 10 CFR Part 50, the National Aeronautics and Space Administration (NASA) requests License TR-3, Docket No. 50-30 for the Plum Brook Reactor Facility (PBRF), be reinstated to possess-but-not-operate as a utilization facility. A similar reinstate-ment request is being made concurrently for the Mock-Up Reactor (MUR) under separate amendment to License R-93 Docket No. 50-185. This status change is requested because of budget limitations which have indefinitely delayed NASA dismantling plans for the PBRF.

Approval of this request will change the PBRF condition from dismantlement mode to possess-but-not-operate with protected safe storage. Since NASA has no foreseeable plans to dismantle the PBRF, a condition of possess-but-not-operate with protected safe storage is appropriate to allow items to be released for possible reuse at a savings to the Government and benefit to the public.

We have initiated an engineering study at the PBRF to review the existing conditions in more detail. This study involves surveys, tests, and measurements that will identify and characterize radiological conditions and radioactive inventory after twelve years in the shutdown state. The study results will provide information to economically enhance maintenance in a protected safe storage condition.

" exemption from requirement to file" category for both the following:

Radiological Contingency Plan - because the PBRF byproduct material possession limits are sufficiently low, b.

Physical Security Plan - because the PBRF has no fuel and no special nuclear materials.

4. Use of Facility - The facility has no fuel and the reactor is in a protected safe storage condition.
5. Period of time for which license is sought - Ten years from date of issuance.
6. Financial Qualification - Being an agency of the United States Government, flASA is financially qualified to possess the requested license.

1. The proposed amendment to facility license No. TR-3 should read as follows:

This license applies to the heterogeneous light water-cooled and moderated test reactor referred to as the Plum Brook Reactor Facility (PBRF). The PBRF includes all associated on site support facilities except for the Mock Up Reactor (MUR) which is under separate License R-93, Docket No. 50-185.

The PBRF is owned by the National Aeronautics and Space Administration, (NASA), an independent agency of the United States Government and located at the NASA Plum Brook Station near Sandusky, Ohio. The PBRF is de-scribed in the application for the full-term license dated January 10, 1964, and amendments thereto, including:

AMEND 8?hT 5 FOR STAND-BY Application - March 19,19/3 Supplement - May 11, 1973 AMENDMENT 6 TO EXCLUDE STRUCTURES 1121, 1142, and 1156 Application - October 27, 1976 AMENDMENT 7 FOR PROTECTED SAFE STORAGE (This Application)

2. Subject to the conditions and requirements incorporated herein, the U.S.

Nuclear Regulatory Commission hereby licenses NASA:

Pursuant to Section 104c of the Act and 10 CFR Chapter I, Par t 50,

" Licensing of Production and Utilization Facilities" to possess-but-not-operate the PBRF and its inventory of byproduct material generated as a result of previous operation.

3. This license shall be deemed to contain and be subject to the conditions specified in Part 20 and Section 50.54 of Part 50,10 CFR Chapter I, and to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect and to the additional ccnditions specified below.

a. NASA shall not reactivate the PBRF without prior approval of the Commission,
b. NASA shall not dismantle or dispose of the PBRF without prior approval of the Commission.
c. NASA shall not possess fuel for the PBRF without prior approval of the Commission.
4. Technical Specifications The Technical Specifications contained in Appendix A to this license are hereby incorporated in this license, and changes therein may be made only when authorized by the Commission in accordance with the provisions of Section 50.59 of 10 CFR Part 50.

This license is effective as of the date of issuance and shall expire after ten years.
