Request for Amendment to License R-93 Docket No. 50-185 for Renewal of Possess-But-Not-Operate License State of Ohio, Cuyahoga County, ss.
Mr. Donald J. Campbell, being first duly sworn, says that:
In accordance with the applicable sections of 10 CFR Part 50, the National Aeronautics and Space Administration (NASA) requests License R-93, Docket No. 50-185 for the Mock-Up Reactor (100KWth) be renewed in the possess-but-not-operate status as a utilization facility. A similar request is being made concurrently for the Plum Brook Reactor (PBRF) under separate amendment to license TR-3, Docket No. 50-30. This renewalis requested due to the continued presence of the PBRF at this same site, and the lack of a dependably available nuclear low-level waste disposal facility.
I Approval of this request will continue the Mock-Up Reactor (MUR) in the mode of possess-but-not-operate with protected safe storage. Since NASA has no foreseeable plans to dismantle the MUR, a condition of possess-but-not-operate with protected safe storage is appropriate to allow coordination of MUR decommissioning with the decommissioning of the Plum Brook Reactor (License TR-3, Docket No. 50-30).

k Concerning submittal of additional plans, the MUR falls into the " exemption from requirement to file" category for both the following: :
- a. Radiological Contingency Plan - because the MUR byproduct material possession limits are sufficiently low. :
- b. Physical Security Plan - because the MUR has no fuel and no special nuclear materials.

= Docket No. 50-185 General Information Pursuant to 10 CFR 50.33, the following information is provided to support the request for an Amendment to License R-93, Docket No. 50-185.

- 3. Class of License- 104; Possess-But-Not-Operate
- 4. Use of Facility - The facility has no fuel and the reactor is in a pro-tected safe storage condition.
- 5. Period of Time for which License is Sought - Twenty years from date of issuance
_ 6. Financial Oualification - Being an agency of the United States' Govern-ment, NASA is financially qualified to possess the requested license.

Amendment No.5 License No. R-93
- 1. The proposed Amendment to facility license No. R-93 should read as follows:
This license applies to the non-operable heterogeneous light water-
- cooled and moderated research reactor [herein referred to as the Mock-Up Reactor (MUR)] owned by the National Aeronautics and Space Administration (NASA), an independent agency of the United States Government, and located at the NASA Plum Brook Reactor Facility near l Sandusky, Ohio. The MUR is described in the application dated March :
15,1961, and amendments thereto including the amendment dated j March 26,1973, and supplement dated May 18,1973, to the NASA l
license application.

- 2. Subject to the conditions and requirements incorporated herein, the Nuclear Regulatory Commission hereby licenses NASA:
Pursuant to Section 104c of the Act and 10 CFR Chapter I, Part 50, i'
" Licensing of Production and Utilization Facilities", to posses-but-not-operate the reactor and its inventory of byproduct material generated as !
a result of previous operation.
- 3. This license shall be deemed to contain and be subject to the conditions specified in Part 20, Sections 50.54 and 50.59 of Part 50,10 CFR Chapter I, and to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect and to the additional conditions specified below:
(A) NASA shall not reactivate the MUR without prior approval of the Commission; and (B) NASA shall not dismantle or dispose of the MUR without prior approval of the Commission.
(C) NASA shall not possess fuel for the MUR without prior approval of the Commission.

The Technical Specifications contained in Appendix A to this license are hereby incorporated in this license and changes therein may be made only
- l. when authorized by the Commission in accordance with the provisions of 10 ;
CFR Part 50, Section 50 5s. .
This license is effective as of the date of issuance and shall expire after twenty ,
years.
