CONTRACT NO. AT(49-24)-0305, BINDER /ELSTER ASSOCIATES This is in reference to the above-numbered contract. As I discussed with you on July 19, 1976 we are limiting our effort on this contract to a review rather than a review and approval. After reviewing this contract, we offer the following coments

(1) The sole source justification indicates that.the contractor has extensive experience in the counseling field and that an unreason-

., able amount of time and expenditure would be necessary for another firm to reach this level of experience. However, the justification does not indicate that this level of experience -.

is necessary to meet the minimum needs of the government or  ;

that time is of the essence in this performance. Thus, this  :

justification needs to be strengthened. fc*

(2) The' contract's statement of work does not specify the obligation of the contractor in sufficient detail to adequately measure the contractor's performance. The actual counseling program NRC is buying appears to be stated in the proposal, dated April 30, 1976.

I Thus, the statement of work could be improved by utilizing that information (assuming the information contained in the proposal is relevant to the expected performance) in order to specify what we expect the contractor to proyide during the performance of this contract. gg wiD4(t + Rbyqmu I
