Relief Request Safety Injection System Class 2 Welds - Byron Station, Unit 1 By letter dated August 29, 1985, you requested emergency relief from Section XI of the ASME Code concerning certain preservice inspection requirements.

By letter dated August 30, 1985, we granted until 9:00 p.m. on September 3, 1985, a temporary waiver of compliance with the ASME Code preservice inspec-tion requirements.

Your August 31, 1985 letter requested permission to defer the aforementioned preservice inspections until the first outage of at least 10 days duration.

Enclosed is our safety evaluation which concludes that the relief you have requested is granted until the first outage of at least 10 days duration.

As indicated to representatives of Conunonwealth Edison Company in a telephone call at 6:00 p.m. on September 3, 1985 with Mr. Thomas Novak and other NRC personnel, the Staff has concluded that your failure to conduct a preservice volumetric and surface examination of two welds in the safety injection system is not subject to Technical Specifications 3.4.10(b), 4.4.10 and 4.0.5 since they pertain to inservice inspection. Accordingly, the action statement of Technical Specification 3.4.10(b) is not applicable. This failure with respect to the Preservice Inspection Program will be the subject of separate correspondence from our Region III office.
