01 REPORT l-93-021R; RE: SALEM GENERATING STATION i

The above captioned 0! report involves the alleged harassment and intimidation (H&I) of both a Senior Staff and Safety Review Engineer by station management at the Salem Generating Station. The alleged H&I occurred when the i individuals jointly attempted to file a station incident report (IR) with the '

then Salem operations manager and Salem general manager. The IR pertained to the seismic qualification (and subsequent operability) of both unit's l containment fan coil units. The alleged H&I continued beyond the original incident, when a memo was prepared by the former managers requesting that the engineers be removed from any direct or indirect involvement with Salem. The 01 findings substantiated that H&I did occur in both of these instances and indicate that enforcement action may be appropriate in this case. By copy of this memorandum, I am requesting that OGC analyze the report and determine whether there is sufficient evidence to take enforcement action. OE has assigned EA 94-239 to track this case.

Mark Satorius of my staff has discussed this case with members of your staff and arranged a telephone conference for December 12, 1994, at 2:00 p.m. to discuss the development of an enforcement action. At the time this teleconference was scheduled, each of your offices expressed no conflict.

Please ensure that someone from your staff will participate who can approve a course of action in this case. Should we fail to reach a consensus during the call, this matter will be referred to the OEDR for resolution.

Regional Staff may participate by calling my office at (301) 504-2741; those in headquarters may attend in Room 07-H-1. If there is a significant scheduling problem, please call me as soon as possible as an alternate time can be arranged.
