Gentlemen:

SUBJECT: PROPOSED CIVIL PENALTY ACTION: EA 84-104

(REPORT N0. 50-302/84-23)

This refers to a routine safeguards inspection conducted by a member of the NRC

Region II i:taff on August 12-16, 1984, of activities authorized by NRC Operating

License No. CPR-72, for Crystal River 3. The findings were discussed with you

and members of your staff during an Enforcement Conference held in the Region II  !

Office on September 6, 1984.

This safeguards inspection identified two violations in which vital equipment was

not afforded the level of protection specified in the physical security plan.

One violation revealed that the door leading into a vital area containing vital

equipment had not been provided with the access control features common to other

vital areas at the plant. These controls were specifically required by your

approved Physical Security Plan (PSP). The second violation indicated a failure

to identify and secure an opening in a vital area barrier with the proper

security equipment as specified in the Physical Security Plan. The second

violation is of particular concern since it appears that you were aware of the

specific requirements of your PSP as long ago as 1980, and yet did not observe

them.

These violations, identified in the enclosed Notice of Violation and Preposed

Imposition of Civil Penalty, would normally be categorized in accordance with NRC

Enforcement Policy,10 CFR Part 2, Appendix C, as revised, 49 FR 8583 (March 8,

1984), at Severity Level IV (Supplement III). However, because circumstances

surrounding one violation involved failure to take adequate corrective action

for previously identified problems, and together the violations indicate a

weakness in the exercise of your responsibility to fully implement and maintain

in effect all provisions of the PSP, the violations have been categorized as

a Severity Level III problem. After consultation with the Deputy Director,

Office of Inspections and Enforcement, I have been authorized to issue the

enclosed Notice of Violation and Proposed Imposition of Civil Penalty in the

amount of Fifty Thousand Dollars ($50,000).

You are required to respond to the Notice of Violation. You should follow the

instructions specified in the Notice when preparing your response and, in doing

so, you should place all Safeguards Information as defined in 10 CFR 73.21 only

in the enclosures, so that your letter may be placed in the Public Document Room,

In your reply, you should describe those actions taken or planned that are

designed to increase the effectiveness of the management of your security

program, particularly with regard to fully implementing and maintaining in effect

all provisions of your Physical Security Plan. Your reply to the Notice and the

results of future inspections will be considered in determining whether further

enforcement action is appropriate.

The material enclosed contains Safeguards Information as defined by 10 CFR 73.21

and its disclosure to unauthorized individuals is prohibited by Section 147 of

the Atomic _ Energy Act of 1954, as amended. Therefore, the material, with the

exception of the report cover letter which is an inspection summary, will not be

placed in the Public Document Room.

The responses directed by this letter and the enclosures are not subject to the

clearance procedures of the Office of Management and Budget issued under the

Paperwork Reduction Act of 1980, PL 96-511.

Should you have any questions concerning this letter, we will be glad to

discussed them with you.
