STAFF DEFERRAL OF FINAL RULE, 10 CFR PART 20
" DISPOSAL OF WASTE OIL BY INCINERATION" ,
The staff has completed a final rule package which would amend Part'20 to-allow-onsite incineration of waste oil by nuclear power reactor 1icensees' under existing operating effluent limits determined to be "as. low as is. ,
reasonably achievable." This rule was developed in-response to_a petition for rulemaking submitted by the Edison Electric Institute and the Utility Nu:: lear Waste Management Group in 1984. -However, the-staff intends to defer--submittal-of the final rule pending the outcome of the Commission's_Below Regulatory-Concern (BRC) consensus building process.
From a strictly technical standpoint this effort is not a BRC rulemaking.
However, we believe that going forth at this time with the rule could, from a public perception standpoint, call into question the Comission's good faith comitment to defer waste disposal actions pending the outcome of the consensus building process.
Deferral of this action is not expected to have any signif.icant impacts for.
reactor licensees. There is not widespread interest-in onsite incineration at this time. Moreover, those_ licensees who wish to pursue this alternative may :
continue to ap>1y for a license amendment to allow-onsite incineration in accordance wit 1 the radiological effluent release limits of Part 20 and.Part-50, Appendix I.. We will reevaluate the final rule packare at the conclusion of the consensus building process and determine an appropriate cour.:e of-action. _ Orldnal Signsd By:
