FINAL RULE TO ALLOW ONSITE INCINERATION OF SLIGHTLY CONTAMINATED WASlE Oll AT NUCLEAR POWER REACTORS In response tu your July 17, 1992, request, we have reviewed the subject paper and.concer on its submission to the Executive Director for Operations and the Commission. We believe the final rule is properly justified and is well written.

The enclosed markup of the final rule package contains mainly editorial comments which we believe could improve the submission. We also suggest that the EPA's decision on the status of waste oil be consistently described as a "deci.non not to list" rather than a "delisting decision." The term "delisting" has a specific meaning under the Resource Conservation and Recovery Act program. Also, at several places, we have provided information from the National Profile on Mixed Waste which could further delineate the isste being addressed.

proposed rulemaking (August. 29,1988; 53 FR 32914 at 32917). Minor modifications have been made to reflect the additional discussion of toxic impacts in the preamble of the final rule which responded to public comment. The revised assessment is provided as Enclosure 4. Both the original and revised assessments concluded that the incineratinn of typical waste oils would not result in impacts to the health and- safety of the public or the quality of the environment i which are substantially different from those.
