Dest Mr. Deusert Supplementing the unterial on the Minnesota Pollution Ccetrol /rney's involvement with Northen States Power's Monticello plant that I sent to Bill 2nd on April 23 is the attached revised draft of the Weste risposal Permit. We received this draft April 24 in a meeting with Mr. Bobert Tuvesm, Chaiman of the Minnesota Pollution Centrol Agency (PCA) and Mr. John Badalich, its Executive Eeentary.

l Mr. Beda11ch nquested the meeting to bring us up-to-date on PCA setivities regarding the proposed pe mit. He advised us that the PCA would meet a May 12 for final consideration of the permit, and, as

tr. Tunson stated, the permit would probably be issued at that time.

We naffirmed our opinion that the State of Minnesota bed no jurisdica tion over the setting of limits on radioactivity releases fra the plant.

Commissioner llamey and I met with Mr. E r1 Dwald, Chaiman of the Board of Northern States Power Capany cs: April 25. Mr. Bwald indicated that NSP had not yet decided what action the Company vculd take. Ccesidera.

tion was being given to accepting the pemit and trying to live with it, accepting the permit but meerving ce the Company's rights and not accepting the pemit to make a test case.

I will keep you informed of furtlwr developmenta in this matter.

Dear W. Bauser:

GErtter Supplementing the r.nterial on the Minnesota Follution Control Agency's involve ent with Mrthern Ctates Puer's t'onticello plant that I sent to Mr. Enr. land on April 23 is the attached revised draft of the Waste Disposal Permit. He m ceived this draft April 24 in a meeting with I'r. Robert ?aveson, Chair-an N

of the !iinnesota Pollution Control Agency (PCA) and

!>. John rwrinlich, its t;xecutive Secretary.

'r. 3adalich requested the :eeti:n to bring us up-to-date on PCA activities regaming the proposed pemit. He advisea us that tne PCA would reet on ;'ay 12 for final consideration of the permit, and, an l'r. 'Ibveson stated, the permit would procably be issued at that tirn. 'de reaffimed our opinion that the State of :11nnesota nad no jurisdiction over the settin:t of liriits on radioactivity releases from the olant.
