SUBJECT:

This report summarizes progress occurring in the Transportation Program Area through August 15, 1984 This report follows the organizational format established in the previous report, including a summary of transportation activities that are not directly related to tasks in the Transportation Program Area ' Plan.

We are adding two tash to the Plan, both pertaining to the Transportation Integration Project.

a 4.' Emergency Response Tasks NRC Policy Statement.on NRC Role in Transportation Accidents Final a.

Policy Statement published in Federal Register March 29, 1984 (48 FR 12335). Coments for possible future revision of statement invited through July 27, 1984. A total of 9 coments have been received, none of which are considered substantive. We are preparing a report to the Comission to sumarize the coments received.

Meeting Between NRC, FEMA, DOE and DOT Following Comission Approval Emergency Response Policy Since no party objected to the emergency response roles as defined in our Policy Statement, the planned meeting on explaining emergency response roles was no longer believed needed. This task was accordingly terminated.

Publish Federal Register notice concerning Intra-agency Roles for Emergency Response in Transportation Accidents This task was accomplished with publication of Federal Register notice mentioned in 4.a., above.

Interagency Coordination Tasks a.

Establish within NM5S/FC a Transportation Program Integration Project This task was completed with the submission of the Transportation Pr.ogram Area Plan in October 1983. The Integration Project's primary i

functions are to provide a central contact for transportation policy j

and activity coordination, and to implement the Transportation Program Plan. The latter are ongoing activities.

Case Study on Institutional Relationships (Spent Fuel Shipment Study) 1 The Aerospace Corporation Project team interviewed by telephone or in person a numbe_t of institutions concerned with spent fuel I

shipment, including IAdditionally, the' project team informed Messrs. J. Myers and J.' Cook of Fuel Cycle Division of their plans to brief FC on August 28, 1984 concerning the first year's activities of the study. The delivery date for the draft annual report has been' changed-from the end of September 1984 to the end of October 1984 at the contractor's request. The two-and-a-half-year study was begun in November 1983 and will conclude in May 1986 with l

publication of a NUREG/CR report sumarizing the study's findings, i

assessments, and recomendations regarding future spent fuel and high-level radioactive waste shipments.

Follow-up Tasks Based on Study Results Should Aerospace identify an issue during the course of their study which requires early resolution, appropriate action will be taken at i

that time. Otherwise, we consider this an inactive task.

6-NON-PROGRAM TASK ACTIVITIES SAFEGUARDS Spent Fuel Protection Rule. Three letters of coment have been received in response to the proposed rule, which was published for public coment on June 8. The coment period ends on September 10.

Implementation of Convention on Physical Protection. Office concurrences have been obtained and the draft final rule has been sent to the Director, NMSS, for approval and subsequent transmission to the EDO and the Comission.

Meeting with French Security Team. On July 13, SGMT participated in a meeting with members of a French Security Team composed of staff from the Ministry of Research and Industry. The discussion focused on the two nations' respective policy on the protection of nuclear material at fixed sites and during transportation.

Meeting with Western Interstate Energy Board Representatives. On July 26, SGMT and FC representatives participated in a meeting with two representatives of the Western Interstate Energy Board (WIEB) to discuss the transportation of high-level waste to interim and permanent storage sites under the Nuclear Waste Policy Act. The meeting was chaired by a representative from State Programs.

The representatives from WIEB were on a fact gathering visit to seek infonnation for-use in a study they are undertaking for DOE. Their. prime concern was safety which was addressed by FC representatives.

Safeguards were discussed briefly and a typical licensee request for a route approval was explained.

4 The fact that DOE probably would assume ownership of the spent fuel F.O.B. at the plant was discussed and in this instance it was explained that the physical protection of the shipment probably would be under DOE regulations which are comparable to NRC rules.

The WIEB representatives were provided copies of the NRC safeguards regulation on the shipment of spent fuel (10 CFR 73.37), the proposed changes to 10 CFR 73.37, and NUREGs concerning safeguards (NUREGs 0561, 0923 and 0725) as well

as safety-related documents furnished by FC.

GENERAL Status of West Valley and GE Morris Spent Fuel Shipments. Shipments from West Valley, New York, to Dresden at Morris Illinois, are continuing with 20 of the 30 completed.

. Shipments from West Valley, New York, to Point Beach, Wisconsin, are continuing i

with 87 shipments of the 114 completed.

Of the shipments from General Electric Co. at Morris, Illinois, to Point l

Beach, Wisconsin, 96 of 109 have been completed. Shipments have been interrupted temporarily due to some loading / unloading equipment being required on a project having a higher priority.

It is expected they will be resumed in October.

Spent Fuel Route Surveys. Two route surveys were conducted with regional "6

assistance. Region V assisted with the Pleasanton, California to Richland, Washington survey and Region I participated in a West Valley, New York to Oyster Creek, New Jersey survey. Both provided field training prior to the regions taking over responsibility for route surveys in FY 85.

Publication of NUREG 0725, Revision 4. "Public Information Circular for Shipments of Irradiated Reactor Fuel". The revised manuscript and the updated state maps of the fifth edition of NUREG 0725 were published the week of July 9..

Presentation before Kansas Legislative Committee. On June 28, 1984 Messrs.

Charles MacDonald and John Cook appeared before a Special Committee on Trans-portation, comprised of representatives of both houses of the State legislature,

. at the State Capitol in Topeka, Kansas. Mr. Cook presented a general overview of NRC's interaction with other Federal agencies on transportation matters and a description of NRC activities in the transportation area. Messrs. Cook and MacDonald responded to questions from the Comittee. Also making presentations that day were U.S. Department of Transportation and several State government officials. The Comittee was reportedly studying transportation with regard to restrictive legislation that had been introduced in the State Senate earlier in the year, and with regard to the operation of the Wolf Creek j

nuclear power station in Southeastern Kansas.

Presentation Before Umatilla Indian Nation. On July 11, Messrs. MacDonald and Cook, along with Region V staff and Waste Management Division Staff from the Richland site and headquarters, met with the Board of Trustees for l

the Umatilla Indian Nation on the Umatilla Reservation outside Pendleton, Oregon. The Umatilla have been granted affected tribe status by DOE under the provisions of the NWPA, and requested the NRC briefing. Mr. Cook sumarized Federal transportation safety responsibilities, and described those sections of NWPA pertaining to transportation in which NRC plays a role. Messrs.

Cook' and MacDonald responded to questions from members of the Board. WM staff provided the Board with NPWA, regulatory (Part 60) and technical (BWIP) overviews. The majority of questions, however, focused on transportation l

matters including concern over local interstate grades and curves, and use of the Columbia River as a transport mode.

.., Some questions exist as to Indian Nation versus State responsibilities regarding emergency response roles and preparedness. We are preparing a letter to FEMA to bring this matter to their attention.

Meeting with Washington State Officials.

On July 12, Messrs. MacDonald and Cook along with staff from WM headquarters, met with officials representing the Governor's Office, the State Legislature, and several State government i

agencies. Mr. MacDonald summarized transportation related activities related 3

to NWPA and our Procedural Agreement with DOE, and Mr. Cook outlined other non-certification related transportation activities at NRC.

In the ensuing discussion, the Governor's representative stated that transportation would be 1

the key political issue concerning the site, and went on to discuss a number of State concerns in the transportation area, including prenotification and Federal coordination with states. A state government official suggested ~ that the repository be required by license condition to develop and " fund" an energency response plan.

Bimonthly Salt-States Meeting. On August 1, Messrs. Cunningham and Cook 1

participated in a DOE sponsored bimonthly meeting with States that contain salt formations under consideration for the high-level waste repository under NWPA. Also 'in attendance from NRC were staff from WM, SP and FC. Other speakers included representatives from U.S. Department of Transportation, Federal Emergency Management Agency, and an Ohio emergency preparedness official.

In Mr. Cunningham's remarks, he discussed the assessment of environmental impact at these sites, the Modal Study and the applicability of semi-and full-scale testing in the development of a ger.eration of transport casks.

Overall, DOE was not completely responsive to state concerns and requests expressed during this meeting. Comments exchanged at the meeting indicate that the working relationship between DOE and the states could be improved.

t Quality Assurance Programs for Transport Packages. On June 21, 1984, IE issued Information Notice 84-50, clarifying the scope of quality assurance programs for transport packages. The clarification was required because past inspections of transportation activities and associated QA programs of nuclear utilities revealed instances of inadequacy regarding implementation of QA programs for transport packages.
