SUBJECT:

FEDERAL AND NRC REGULATORY REQUIREMENTS CONCERNING HIGH-LEVEL WASTE TRANSPORTATION As promised to the Division of Fuel Cycle and Material Safety in our recent response to its request for information on possible state concerns about transportation, enclosed is a draft follow-up memorandum for your transmittal to Mr. Cunningham.

This memorandum accompanies a list of possible state questions on transportation issues that may be useful in his preparation for the meeting with interested Western states in Keystone, Colorado.

The memo also sets forth a proposed approach to resolving certain key legal questions about NRC jurisdiction in this area, and asks to discuss this approach with Mr.

Cunningham.
