Item 51 - License Fee Recovery
. DOE-Ross NRC-Beckwith The rule requiring NRC to co'llect full costs in the fee recovery process has been. issued for comment. Approval.has been deferred until the staff agrees on threshold levels for fuel cycle facilities.
NRC will require identification of.
all litansing action costs.on future projects on a plant-by-plant, action-by-action basis ~. The laboratories have already -
been able to implement this requirement.

Item 52 - Reporting of Small Business Contracts DOE-Shepard NRC-Kerr NRC has contacted the DOE SDBU office for a breakout of small/
disadvantaged contract percentages attributable to NRC tasks.

DOE and NRC have now agreed upon a procedure to obtain the data directly from the operations offices.
NRC reports they are now getting this information.

Item 53 - Changes to 10 CFR Part 20 DOE-Deal (Va11ario)
NRC-Tomlin l
NRC has proposed changes to 10 CFR Part 20. ~ DOE stated that these changes will severely impact DOE programs.
EPA is soliciting guidance to set worker exposure standards. NRC has recommended a 50 year dose commitment extrapolated from the current exposure rate. DOE has recommended against using the dose commitment approach for the reasons stated at the ACRS-NRC-DOE Committee hearings of November,1982.
Eight or nine issues have been identified. Most have been resolved, but some remain.
Status:
DOE presented its views to the ACRS on September 22, 1983. An ACRS position will be discussed at meetings scheduled for November 16-18, 1983.
Action:
Once the ACRS position is known, DOE-NRC should decide how to close out this action.

NRC/ DOE MEETING ON TRANSPORTATION PACKAGING ISSUES FEBRUARY 7, 1984 1:00 - 3:30 P.M.

The Nuclear Regulatory Comission (NRC) and the Department of Energy (DOE) have signed a Procedural Agreement (48 FR 51875) concerning planning assumptions and procedures that the two agencies will observe in connection with the development of transportation packaging under the provisions of the Nuclear Waste Policy Act l
(NWPA) of 1982. On February 7,1984, the second meeting between NRC and DOE was i
held, in accordance with the provisions of the Procedural Agreement, to review the status of the program and discuss issues related to packaging design, testing, i
and certiciation and other matters of mutual interest. DOE was represented at the meeting by personnel from the Office of Civilian Radioactive Waste Management, i
and the Sandia, Idaho and Oak Ridge National Laboratories. NRC was represented by staff from the Office of Nuclear Material Safety and Safeguards (Fuel Cycle, i
Safeguards, and Waste Management Divisions) and the Office of Nuclear Regulatory Research. The Department of Transportation (DOT) was represented by a member of the staff of the Materials Transportation Bureau.
DOE and NRC contractors were i
also in attendance. As called for in the Procedural Agreement, this report sumarizes the discussion of issues and agreements reached at the meeting. The j
agenda topics addressed at the meeting were as follows.
DOE Draft Mission Plan DOE opened the meeting by summarizing their preliminary analysis of coments received to date on transportation issues in the Office of Civilian Radioactive i
Waste Managements' Draft Mission Plan. DOE said they agreed with coments from DOT concerning the scope of NWPA transportation activities subject to Federal regulation and that DOE and DOT should jointly determine whether "the private sector cannot or will not provide the required [ transportation]
services in a timely or cost-effective manner." DOE has under consideration a number of other comments from utility groups and states. NRC, whose formal comments have not yet been transmitted.to DOE, noted that transportation planning was not as advanced as in other program areas covered by the Mission Plan.
DOE Spent Fuel Transportation and Storage Demonstration Project DOE reported that its Idaho National Engineering Laboratory (INEL) and Nuclear Fuel Services (NFS) were signing a contract to transfer NFS-owned spent fuel at NFS's former facility in West Valley, New York to INEL as a demonstration project in DOE's research and development program on spent fuel transportation and storage. The contract requires NFS to supply the fuel and the transport / storage I
-2 cask. DOE will take title to the fuel, load the fuel for shipment, transport the fuel and store it onsite. NF3 has selected Transnuclear (TN) to build the transport / storage cask, which will be designed for the NFS fuel only, i.e., a one-time shipment of low-burnup spent fuel. The cask's safety analysis and certification review will be conducted by DOE's Oak Ridge National Laboratory.
NRC commented that a topical report is expected to be submitted by Transnuclear for a dry storage cask most likely similar in design to the NFS-TN cask, but designed for general use. It was agreed that the two agencies should promptly establish a working arrangement to exchange relevant information during the course of review, particularly any safety issues which might emerge with respect to the cask design and use.
It is noted that NRC's review of the topical report is not expected to be completed prior to the DOE /0ak Ridge review.
NRC Review of GNS Cask NRC reported that GNS has submitted for review a testing program for the Castor
!r Yb nodular cast iron transport / storage cask. NRC comments on the testing program will be transmitted to GNS by the end of February 1984.
NRC Assessment of Potential Spent Fuel Oxidation During Transport NRC reported on its assessment of the possible~ impacts of oxidation of U0 on p
spent fuel shipments. The assessment included: a reevaluation of an incident at l
the Batelle Columbus Laboratory in May 1980 in which oxidized UO, was released to the fuel storage pool area during the unloading of a cask kno9n to contain spent fuel assemblies with grossly failed cladding; a summary of the UO oxidation phenomena and projections of the likelihood, extent and consekuences of oxidation during normal and abnormal transportation situations; and a definition of the regulatory implications of the potential for spent fuel oxidation.
The preliminary assessment indicates that the impact of fuel oxidation on previous estimates of consequences and risks associated with worst case (i.e.,
l severe accident or sabotage) spent fuel transportation incidents is small.
NRC may require that spent fuel be shipped in an inert (non-oxidizing) atmosphere to preclude fuel oxidation and that failed fuel be canned.
NRC Modal Study Update l
l NRC reported on the status of its Modal Study, an effort to relate cask design l
criteria to real-world severe accident conditions.
Basically, the approach of l
the study will be to estimate the stresses of realistic accident scenarios and i
determine which, if any, exceed existing cask design criteria. Accident scenarios found to exceed existing criteria would be assessed for probability of occurrence and consequences. These risks would be compared to those previously estimated (NUREG-0170). The study is being conducted by Lawrence Livermore Laboratory, which is expected to submit its detailed work plan to NRC by mid-March. This effort will be completed in about 1 year.

NRC Safeguards Requirements for Spent Fuel Shipments NRC reported that it has before the Committee to Review Generic Requirements (CRGR) a proposed rule change to revise physical protection requirements for
^
spent fuel shipments.
If promulgated, the rule would eliminate present requirements for armed guards in urban areas, advance approval of routes, liaison with local law enforcement departments along the routes, and scheduled communication with dispatchers.
i Provisions retained by the rule would be the unarmed escort, onboard telecommuni-cations and a vehicle imobilization device. Prenotification of states of the shipments is a requirement imposed by Congress and would not be affected.
The proposed rule is based on two reevaluations, with a third independent and confirmatory peer review, which show the consequences from a forced (explosive) breaching of a spent fuel cask,to be substantilly less than expressed in an earlier study upon which present protection requirements are based.
DOE Systems Design Initiative DOE reported that a draft scope of work has been prepared der a Program Research and Development Announcement (PRDA), which is to be issued in the near future.
The PRDA will establish a Systems Design Initiative to solicit ideas for an integrated high-level waste and spent fuel management system. The PDRA will provide an opportun{ty for parties interested in planning to submit suggestions for system components (packaging, handling, storage, transport, disposal, business arrangements, etc.) and possibly receive DOE funding to further develop these suggestions into descriptions of alternative systems. DOE will then project and compare costs and benefits for the alterative systems and modify the reference systems as appropriate.
It was agreed that, either formally or informally, DOE would consult with NRC regarding the results DOE obtained from funded system descriptions.
DOE New Cask Initiatives l
DOE reported that a preliminary schedule for new cask specifications would be available in late Spring. DOE plans to provide a 1 to 3 page description of specifications for new generation casks. _ DOE believes 4 types of casks (light and heavy capacity designs for both road and rail shipments) could accomodate 807, or more of shipment needs. DOE also reported that a draft of its Business Strategy Document, which will be DOE's approach for providing casks, will be available in late Spring. DOE stated that the greater economic efficiencies (greater fuel loadings) associated with casks designed for older fuel may be greater for rail than for truck casks.
NRI suggested and DOE agreed to provide draft proposals bn new cask specificationdnd business strategy to NRC for review and coment.

, Utility Transport Interfaces DOE inquired as to whether NRC was aware of any studies sumarizing utility transport interfaces, e.g., capacity of power reactor cranes for cask handling, availability of railroad siding for rail shipments, etc. NRC responded that some information was available, but was unaware of any industry-wide sumarizing such data.
AGREEMENTS REACHED BETWEEN NRC AND DOE The agreements reached at the meeting n'ay be sumarized as follows:
1.
NRC and DOE will promptly establish a working arrangement to exchange information regarding the. DOE review of the transport / storage cask to be used for shipment of NFS fuel from West Valley, New York, to the Idaho National Engineering Laboratory for storage.
2.
DOE will provide NRC in late Spring the draft New Cask Specifications and a draft Business Strategy Document.
3.
'NRC and DOE will hold discussions this sumer on the general ideas received from the Systems Development Initiative proposals.
4.
NRC will provide DOE with a copy of the Lawrence Livermore Laboratory detailed work plan for the Modal Study and the Director's decision under 10 CFR 2.206 on the oxidized fuel issue.
5.
NRC and DOE will hold' additional meetings on a quarterly basis to discuss l
transportation issues under the Procedural Agreement. The next meeting is tentatively scheduled for the end of April 1984.
