Dear Mr. Audin:
This letter is in partial response to your February 3,1985, letter in which you requested, pursuant to the Freedom of Information Act (F0IA), five l
categories of documents. This also confirms the information relayed during the February 15, 1985, telephone conversation between you and Mrs. Nita Beeson regarding the scope of your interest in the fourth category concerning NRC rules covering requests for changes in regulations and appeals of administra-tive and Comission decisions.
During that conversation, you said that you were interested in whether 10 CFR 2.206 required that the Comission review an appeal of a decision made by the Director of Nuclear Material Safety and Safeguards and whether an appeal procedure beyond that required by 10 CFR 2.206 exists. Should you disagree with this stated scope of category four of your request, please telephone Mrs.
Beeson on 301-492-7760 so that any misunderstanding may be corrected.
We are placing copies of the records identified on enclosed Appendix A in the PDR. The records will be filed in PDR folder F01A-85-95 under your name.
The documents and their accession or docket file numbers listed on enclosed Appendix B are already available for public inspection and copying at the PDR.
Those documents responsive to category four of your request include a copy of current 10 CFR 2.206 and Subpart H of 10 CFR Part 2.
Paragraph (c)(1) of section 2.206 states, in part, that "...the Comission may on its own motion review that decision...to determine if the Director has abused his discretion
" and, further, in paragraph (c)(2) that "No petition or other request for Comission review of a Director's decision under this section will be entertained by the Comission." Subpart H describes how one may petition the Comission to issue, amend, or rescind a regulation. For your information, these and all other NRC regulations are available for inspection and copying for a fee from NRC Local Public Document Rooms in the New York cities of New i
York, Oswego, Rochester, Shoreham, and White Plains in addition to the Washington, DC, PDR.
