SUBJECT:

THOMAS APPLEGATE I called Bert A. Davis, Deputy Director, Region III, Office of Inspection and Enforcement, NRC, on March 2,1981, and advised him I had received a telephone call from Thomas Applegate regarding Applegate's concern about James Keppler accusing Applegate of posing as an undercover NRC investiga-tor.

Davis advised that Applegate has also contacted him about the same matter.

Davis then advised that Keppler had received a telepheae call from the Resident InspeF. tor (Daniels) at Zimmer.

Daniels advised Keppler that he had received a phone call from a Chief of Security at Zimmer that one of 1

the security guards had been contacted by Applegate and that Applegate had identified hi'mself as an undercover investigatoi for NRC.

The security i

guard further advised the Chief of Security that he would sign a statement

~i as to this incident.

Davis further advised that several Region III inspectors were returning to.

Region III via the limousine from the airport when the driver of the limousine indicated he had just dropped off an NRC centultant at the i

airport. The NRC inspectors were curious as to who the censultant was then proceeded to question the driver.

After a period of time the driveRthen j

recalled the name of the consultant as Tom Applegate. The limo driver further stated that Applegate told him that he (Applegate) was going to shut down a nuclear power plant.

Davis stated that after hearing about these two instances involving Applegate l

posing as an investigator and a consultant Keppler then called Thomas Devine, Applegate's lawyer, and advised him of Applegate's activities as reported by 4

two different sources.

Davis stated he would keep 0IA advised on this matter.
