The only urgency I see is *, hat it must be available to the public about 30 days prior to its planned issuance, and Vogel was promised a copy in a letter dated October 17, 1972.

1. The A*tomic Energy Conaission ("the Commission") has found that:

] A. The application, as amended, filed by the Northern States

! Power Company for a full-term operating license, complies with the standards and requirements of the Atomic Energy Act of 1954,

as amended (the Act), and the regulations of the Commission set forth in 10 CFR Chapter I, and all required notifications to

[ other agencies or bodies hcve been duly made; B. Construction of the Monticello Nuclear Generating Plant, Unit 1 f

(the facility), has been substantially completed in conformity

with Provisional Construction Permit No. CPPR-31 and the i

application, as amended, the provisions of the Act, and the rules f

and regulations of the Commission set forth in 10 CFR Chapter I; C. The facility will operate in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission; 3

There is reasonable assurance (i) that the activities authorized by this oper ting license can be conducted without endangering and the health and safety of the public /(ii) that such activities will be conducted in compliance with the rules and regulations of the Commission; E. The Northern States Power Company is technically and financially qdalified to engage in the activities authorized by this operating license in accordance with the rules and regulations of the Commission; F. The Northern States Power Company has satisfied the applicable J provisions of 10 CFR Part 140, " Financial Protection Requirements and Indemnity Agreements", of the Commission's regulations; 1

j G. The issuance of this operating license will not be inimical to the common defense and security or to the health and safety of the I public, and H. After weighing the environmental, economic, technical and other benefits of the facility against environmental costs consider 1ng I available alternatives, the conversion of Provisional Operating ,

2. Facility Operating License No. DPR-22 is hereby issued to the 9

Northern Statco Power Company to read as follows. This license supersedes in its entirety Provisional Operating License No.

DPR-22, as amended on January 19, 1971 4 rA Fehen' 20, U73.

l A. This license applies to the Monticello Nucicar Generating Plant Unit 1, a singic cyc1c, forced circulation, boiling water i ,

nucicar reactor and cicctric generating equipment (hcrcin, the theilit ,

, which is owned by the Northern States Power Company. The facility is located in Uright County on the Northern States' site in j ,, Wright and Sherburne Countics, Fdnnesota, and is described in the 2

i " Final Safety Analysia Report" as suppicmented and amended l (An.cndments 9 through 28), including the application dated June 15, 1972, for conversion of Provisional Operating License No. DPR-22 to a full-term operating license and amendment thereto dated December 21, 1972, and the Environmental Report dated November -

1971, as supplemented April h,1972.

! B. Subject to the conditions and requirements incorporated herein,

, the Coram1ssion herchy licenses the Northern States Power Company (hereinafter, the licensec):

(1) Pursuant to Section 104b of the Act and 10 CFR Part 50,

" Licensing of Production and Utilization Facilities," to I

. possess, use, and operate the facility as a ud11tation facility at the designated location in Wright County, Minnesota, in accordance with teh procedures and limitations described in the applicat.icn the Environmental Report, and 4

in this license; (2) Pursaant to the Act and 10 CFR Part 70, "Special Nuclear Material, " to receive, possess, and use at any one time up to 2300 kilograms of contained uranium 235, fif ty grams of uranium 235 as contained in fission chambers, and 16 grams of plutonium as contained in a plutonium-beryllium s

neutron source all in connection with operation of the facility; (3) Pursuant to the Act and 10,CFR Part 30, " Rules of Ceneral Applicability to Licensing of Byproduct Material," to receive, possess, and use in cornection with the operation the facility:

a. antimony 124, ten scaled sources, not to exceed 1,250 curies per source;
b. americium 241, one scaled source, not to exceed 7 curies;
c. cobalt 60, four scaled sources, two not to exceed 350 microcuries per source, one not to exceed 500 millicuries, and one not to exceed 12.5~ millicuries;

. d. cobalt 60, 0.5405 mil 11 curie ( in solution form);

. e. cobalt 60, 27 microcuries (all without restiction as to chemical or physical form);

f. cesium 137, twelve sealed sources, two not to exceed 5 microcuries per'sourco.and ten'.not to exceed 8 micro-curies per source;
g. cesium 137, 2.702 mil 11 curies (in solutLon form);
h. americium 241, cesium 137, and strontium 90, each not to exceed 1 millicurie per nuclide (all without restriction as to chemical or physical form), and
1. strontium 90, forty sealed sources, not to exceed 1.2 microcuries per source.
(4) Pursuant to the Act and 10 CFR Parts 30 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of facility.

C. This license shall be deemed to contain and is subject to the conditions specified in the following Commission regulations in 10 CFR Chapter I: Part 20, Section 30.34 of Part 30, Sections 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70; is subject to all applicabic provisions of the Act and to the rules, regulations, and orders of the Coumission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

(1) Maximum Power Level The licenscee is authorized to operate the facility at steady state power levels not in excess of 1670 megawatts (thers.al).

  • t (2) Technical Specifications The Technical Specifications contained in Appendices A & B attached hereto are hereby incorporated in this license.

Northern States shall operate the facility at power levels not in excess of those authorized under condition 3.A. of this license in accordance with these Technical Specifications.

No changes sl.all be. made in these Technical Specifications unless authorized by the Commission in accordance with the provisions of Section 50.59 of 10 CFR Part 50.

(3) This license is subject to the following conditions of the protection of the environment a.

D. This license is effective as of the date of issuance and shall expire at midnight, June 19, 2007.
