Dear Mr. Perkins:
This serves to acknowledge receipt of your Septamt er 14, 1992, letter which described certain actions that the Nuclear Regulatory Commission (NRC) has taken regarding the Palo Verde Nuclear Station related to safety concerns which I had previously provided to the NRC.
Your September 14, 1992, letter also requests additional information from me to assist the NRC in their investigation of the Palo Verde Nuclear Station. Ihave recently become aware of a pending investigation of the NRC Region V staff by the NRC Inspector General's office based in Washington, D.C.
I consider the NRC l.G.
Investigation to be a most serious matter and one that has lessened my confidence in the NRC Region V's ability to conduct an " Independent
- Investigation of my safety concerns relevant to the Palo Verde Nuclear Station.
Based on the foregoing, the NRC Region V's request for my assistance in investigating safety concerns at the Palo' Verde Nuclear Station is hereby denied at this time. I am concerned that my safety issues raised to the NRC Region V related to the Palo Verde Nuclear Station have not been resolved. Therefore, I have made a written request to Mr. James Taylor, NRC Executive Director for Operations, to arrange for Mr.
Oscar DeMiranda of the NRC Region 11 office to investigate the substance of my safety concerns related to the Palo Verde Nuclear Station.
In light of the pending NRC 1.G. Investigation of the NRC Region V office, I believe this course of action to be in the best Interest of the public and the environment as a whole.
