REVIEW OF TRANSCRIPT IN GPU V. B&W Earlier this week, I-n o t e'd, in a draft response to

Question 10 in Congressman Udall's February 23, 1983 letter, that Commissioner Gilinsky still expects the General Counsel to analyze the transcript of GPU v. B&W and to advise him of its significance for the TMI-1 restart decision.

In this regard, a majority of the Commission has concurred in the approach outlined in my memo of February 25, 1983 on this~ subject.

That approach does not encompass your providing an independent assessment of the tran. script in GPU v. B&W called for by Commissioner Gilinsky in his memos of February 2, 1983 and March 2, 1983, inasmuch as such work would involve significant legal and supporting technical effort which would duplicate the ongoing work assigned to the EDO staff by my memo of December 29, 1982.

Nonetheless, as'we discussed on March 7, 1983 and March 9, 1983, it is appropriate for OGC to prepare to comment on the EDO staff analysis and the parties' comments (per my 2/25/83 memo) by reading of the pertinent parts of the transcripts and consulting with OPE on any technical matters involved.

In addition, 'as noted in my February 25, 1983 memo,.it is expected that you will prepare a written analysis of the effec't that the GPU and B&W settlement may have on GPU's l

l pending $4 billion' claim against NRC, as requested by Commissioner Gilinsky.

I also ' agree that OGC must becomb knowledgeable about the record of GPU v. B&W to prepare for OGC's role in this'pending suit against NRC.
