Yesterday,"I was advised by the: General Counsel that OGC could not.

tion developed in the case of GPU v. B & W prior to a Comission Ed decision'on restart.
Apparently, OGC coes not have somecne sufficiently esc'5 char. familiar with the Till-1 Restart record to distinguish between informa.

tion devel.oped in the Restart proceeding and information developed in the trial.
Additionally, the record of the' trial is already more than 71 c E2 t : 0,000 pages long and promises to become much longer.
In light of these

two factors, I propose that the Comission not req 0' ire OGC t~o prepare some quick sumary of the record prior to our restart decision.
- Rather, I would prefer that the Comission make its decision based on informa-tion presently before it.
The Comission should be provided withia' report of any new information developed in the trial at the conclusion of the trial.
If the report brings to the Comission's attention any issue which would require revisiting, the Comission will do so at that time.
I would like the. Secretary to monitor. responses to this. memorandum.

Based upon your advice, the Commission might find it necessary to take action.
