Thi ED0's staff is conducting an analysis of GPU and B&W Th transcripts.

A majority of.the Commission has voi.ed that 25%.;-

Following that, we would request the parties' comments on the staff's analysis.

.O Commis.sioner Gilinsky feels thtt, at a minimum, the Commission should tell the parties now that they will be asked to comment on the staff analysis so that they will have time to familiarize themselves with the record in-GPU v. B&W.

I have no objection to this.

Therefore, I would support Commissioner Gilinsky's request that OGC independently review the transcripts of the GPU v. B&W tria'l.

I continue to believe that it is a bad business to block any Cornissioner's request for help from a

- Commission-level of fice such as OGC or OPE.

In this type of situation -- an adjudicatory matter on which the Coraission may 1

l be divided -- such action can'also be subject to some rather

unf ortunate misinterpretatio'ns.
