The Commission must be aware that your future, like ours, is inextricably bound up in what happens at Three Mile Island, and that your credibility with the public hinges largely on the decisions you will make about the future of T.M.I.

You are aware that if you authorize the restart of T.M.I.-1 and something goes wrong, your agency will suffer the same loss of credibility and public trust that it suffered after the T.M.I.

accident and the snafus at Diablo Canyon.

In short, you seem to be aware the technical problems at stake in the T.M.I.-1 restart proceedings require your closest and most careful considerations.

Your investigation into T.H.I.-l's seismic capa bili ties, along with the Appeal Board's decision to reopen the record on decay heat removal, suggest to us that you are indeed looking more carefully at the technical problems than the Atomic Safety and Licensing Board.

While your record of favoring the utility's wel fare over that of the people of the T.M.I.

area does not inspire much hope in us, we would like to offer the following observations for the record.

1) We believe that you should require G.P.U.

restart, instead of letting the company delay the improvements to the fi rst refueling outage and beyond.

2) Since the Commission has decided to investigate the seismic issue, which is basically a generic safety problem and was uncovered during a general study of U.S.

nuclear plants, the Commission should reopen the hearing record to consider Union of Concerned Scientists Contention 17. This Contention addresses the question of whether T.M.I.-1 should be allowed to operate in the absence of a plant-speci fic resolution of unresolved generic safety issues.

3) We believe you should invesigate the ability of the plant to withstand a Class 9 accident, and the effectiveness of local emergency planning in the event of a Class 9 accident.
4) We believe you snould requi.re G.P.U.

to install hydrogen control equipment.

You have ruled that the hydrogen control. problem need not be investigated because it was not, a direct cause of the T.M.I.-2 accident. We remi nd you that perhaps the time period when local residents experienced the greatest anxieties was during the hydrogen bubble episode of the T.M.I.-2 accident.

5) We are deeply concerned about the lack of a solution to tne problems of Thermal Shock and Er.bri ttl ement.

This is particularly disturbing in view of studies that you have conducted that indicated T.M.I.-1 to be among the top twenty reactors in the country that are potential candidates for this occurrence.

While your consideration of these issues will not necessarily regain the credibility that you _have already lost in this area, we believe that resolutions of these and other generic issues before any ' decision is made on the restart of T.M.I.-1 will be in the best interest of all parties concerned.
