SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 90 TO FACILITY OPERATING LICENSE N0. NPF ~LO UNION ELECTRIC COMPANY i

CALLAWAY PLANT. UNIT 1 DOCKET NO. 50-483

1.0 INTRODUCTION

By application for license amendment dated February 21, 1992, Union Electric Company (the licensee), requested changes to Technical Specifications (TS) for the Callaway Plant, Unit 1.

The proposed amendment would delete Sections 2.3 and 4.3, " Cultural Resources," of Appendix B to the Environmental Protection Plan (Non-radiological).

In its subsequent letter dated March 29, 1994, the licensee committed to continue implementing the UE Cultural Resources Management Plan. The additional information contained in the April 16, 1992, and March 29, 1994, letters was supplemental in nature, is within the scope of the initial notice, and did not affect the NRC staff's proposed no significant hazards consideration.

2.0 BACKGROUND

Appendix B, Environmental Protection Plan, was originally issued with the Callaway Plant Facility Operating License No. NPF-30. When the NRC issued the operating license for Callaway, UE had not completed all of the necessary actions required to ensure protection of the cultural resources surrounding the plant. Therefore, the NRC included Sections 2.3 and 4.3, " Cultural Resources" into Appendix B, Environmental Protection Plan (Non-radiological),

of the Callaway operating license.

Section 2.3 states that there is a need to protect the cultural resources which are located in the area of potential environmental impact related to maintenance and operation of the plant.

Section 4.3 describes a series of requirements that UE needed to complete to ensure the protection of these cultural resources. Section 4.3 required UE to complete the following:

1.

To (a) prepare in consultation with the State Historic Preservation Officer (SHP0) the potential eligibility of the sites, determined to be in the area of potential environmental impact, for inclusion in the National Register of Historic Places, and (b) provide this information to the NRC.

2.

To provide the NRC with necessary information to complete a determination of effect from operation and maintenance of the plant on the sites determined to be in the area of potential environmental impact.

Prior to licensing the Callaway Plant, UE contracted with American Resources Group, LTD to conduct the Phase I (1983) cultural resources survey and assessment on approximately 5848 acres of residual lands which surround the Callaway Plant. The objective of the Phase I survey and assessment was to locate, evaluate, and identify potentially significant cultural resources.

One hundred twenty-nine sites were identified and evaluated during the Phase I survey; 79 prehistoric archeological sites, 29 historical archaeological sites, and 21 architectural sites. Of the 129 Phase I sites, 23 prehistoric archeological sites and 2 historic archeological sites were considered individually significant and potentially eligible for nomination to the National Register of Historic Places. However, of the 25 sites potentially eligible for the National Register only three (23CY20, 23CY352, and 23CY359) were in the area of potential envircnmental impact from the operation and maintenance of the plant.

Sites 23CY352 and 23CY359 are located within the transmission line right-of-ways and site 23CY20 is in the area of the railroad spur. All three sites are prehistoric archeological sites.

The Phase II (1985) evaluation was conducted on the three sites to further evaluate their National Register eligibility.

The evaluation determined that the three sites were eligible for inclusion into the National Register.

The National Register forms were completed for the three sites and sent to the Missouri SHP0. An affirmative opinion from the SHP0 was obtained on April 2, 1990, regarding the potential eligibility of the three sites for inclusion in the National Register.

By letter dated April 16, 1992, UE provided NRC with an updated A Cultural Resources Manaaement Plan for Residual Lands at the Union Electric Company Callaway Plant, March 1992.

The American Resources Group, LTD was the licensee contractor for the Phase 1 survey and assessment, tne Phase II evaluation, the original plan and the updated plan.

3.0 EVALUATION By letter dated March 26, 1985, UE provided to the NRC the information requested in Section 4.3.

Section 4.3 states in part, that upon completion of these activities the NRC would, in consultation with the SHP0, determine the effect of plant operation and maintenance on the cultural resources in the area of potential impact. The staff completed its evaluation and concluded l

that the operation and maintenance of Callaway plant has no effect on the l

cultural resources in the area of potential impact.

By letter dated May 24, l

1994, the NRC forwarded its determination of "no effects finding" on the cultural resources within the Callaway operation and maintenance areas to the Missouri SHP0 for concurrence. The NRC also provided a courtesy copy of their evaluation to the Advisory Council on Historic Preservation.

By letter dated June 1, 1994, the Missouri SHP0 concurred with the NRC's finding of no effect.

Since the licensee has complied with all the requirements in Section 4.3, and the NRC has completed its determination of effect, all the requirements delineated in Section 4.3 have been satisfied.

Additionally, UE has committed to maintaining the Cultural Resource Management plan that not only protects the three sites within the area of potential environmental impact but also protects all twenty-five sites determined to be eligible for nomination to the National Register.

By letter dated March 29, 1994, UE also committed to inform the SHP0 of any changes to the plan or any changes to the site.

Therefore, the staff concludes that the deletion of Sections 2.3 and 4.3

" Cultural Resources" of Appendix B, Environmental Protection Plan (Non-radiological) is acceptable.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Missouri State official was notified of the proposed issuance of the amendments. The State official 4

had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

The amendment involves changes to the environmental protection plan as I

implemented by the Cultural Resources Management Plan and has no effect upon the physical environment. The staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluent that may be released offsite and that there is no significant increase in individual or cumulative occupational radiation l

exposure. The Commission has previously issued a proposed finding that this amendment involves no significant hazards consideration and there has been no l

public comment on such finding (59 FR 17607). Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth'in 10 CFR 51.22(c)(9).

Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance i

of this amendment.

5.0 CONCLUSION

The staff has concluded, based on the considerations <tiscussed above, that:

(1) there is reasonable assurance that the health and safety of the public i

will not be endangered by operation in the proposed manner, (2) such 1

activities will be conducted in compliance with the Commission's regulations, l'

and (3) the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.
