that a former superintendent for Ebasco Constructors, Inc. was fired because he refused to participate in a conspiracy to falsify critical documents from 1985 to 1987, relating to the construction of HVAC systems at the South Texas i

Project. The jury awarded Rex nearly $250,000 in lost wages and interest after hearing two weeks of testimony. On Monday, the former superintendent's attorney, Ms. Billie Garde, sent a letter to NRC Chairman Ivan Selin t

summarizing the trial testimony and requesting a meeting. This was reported l

in the Houston Chronicle on October 19, 1993.

(Note: The former superintendent never approached the NRC with a " technical" issue. This

NRC Seminar at the Annual Meetina of TRTR The Non-Power Reactors and Decommissioning Project Directorate (ONDD) presented a one day seminar at the annual meeting of the Organization of Test, Research, and Training Reactors (TRTR) in Gainesville, Florida on October 20, 1993. NRC staff members made presentations on significant events at aon-power reactors (NPRs), the NPR inspection program, NPR operator licensing, the i

revision to 10 CFR Part 20, NPR emergency planning status of high-enriched to low-enriched uranium core conversions, ONDD licensing update, NPR guidance i

document update, and regional roundtable discussions. The Executive Director i

for Operations was the luncheon speaker. ONDD staff members also attended the TRTR meeting on October 21-22, 1993.

Loss of Soent Fuel Pool Coolino Task j

t On October 14, 1993, a lead project manager was assigned to manage staff action regarding loss of spent fuel pool cooling scenarios The action stems i

from a 10 CFR Part 21 report filed by two contractors for cnnsylvania Power and Light Company (PP&L) in November 1992.

In the repor*., the contractors l

postulate several scenarios in which spent fuel pool cooling could be lost for i

extended periods of time leading to significant offsite dose consequences.

Although the report details the scenarios for Susquehanna Steam Electric Station (SSES), the authors postulate the scenario is applicable to other i

reactor facilities.

Following a presentation to the NRR staff by the report authors on October 1, 1993, the staff assigned a task team to evaluate the technical issues

involved. The task team has the following initiatives underway:

The action plan is substantially complete.

IPE/IPEEE Proaram The individual Plant Examination (IPE) for the Shearon Harris Nuclear Plant was recently submitted. The study indicates that the estimated frequency from internal events, including flooding, is 7.0 X 10', core damage Early in the study, a dominant contributor to core damage (about 50% of the total) was identified that involved failure of the non-vital 125 volt de electrical system. To reduce risk, procedure changes were made to direct operators to manually operate circuit breakers in this system if this de system is lost.

The two remaining dominant sequences result from small LOCAs and loss of offsite power.

To date, 63 IPEs, covering 86 plants, have been received of an expected total of 76. This includes the IPE for Trojan, which the staff has chosen not to review because of the licensee's decision to permanently shut the plant down.

Watts Bar Unit 1 Schedule Delays In a management meeting on site, TVA announced that the date for beginning hot functional testing has been delayed from November 1993 to March 1994. The fuel loading date (operating license issuance date) has been changed from April 1994 to a " window" of late summer to early fall 1994. TVA stated that the reasons for the changes are:

TVA is behind the original modification schedule due to additional emerging work and lower than planned productivity.

TVA has moved up work in containment originally scheduled for after hot functional testing to minimize damage to completed and tested systems.

Startup and pre-op test procedures require additional reviews to ensure that all commitments are included.

Craft workforce will be decreased to increase efficiency and to ensure that Engineering and Materials are well ahead of Modifications.

Senior NRC managers at the meeting indicated that TVA's lack of a fuel loading date, as well as the reluctance to admit schedular slippage despite mounting evidence, made it difficult for the staff to commit resources to support review and inspection activities.

OCTOBER 22, 1993 ENCLOSURE A

3 ITAAC Review Team The ABWR Independent ITAAC Review Team (IIRT) has completed the pilot phase of their planned review. The comments generated by this review of eight systems have been forwarded to the NRR staff for review and resolution with GE as appropriate. The team will continue their review of the ITAAC and the SSAR currently on the docket as time permits. The IIRT plans to commence the review of the final ITAAC on November 29, 1993. This is predicated on GE's submittal of SSAR Amendment 33 on November 22.

Emeroency Preparedness Exercise Aby Mohseni (PEPB) is assisting a Region V inspection team in evaluating a full-participation emergency preparedness exercise at Diablo Canyon. The Region V team is observing the licensee's performance while an evaluation team from FEMA is observing the performance of State and local emergency response organizations.

The Cooperative Efforts Group Members of the Probabilistic Safety Assessment Eranch (M. Rubin, A. Ramey-Smith) attended a meeting held on October 18, 1913, of The Cooperative Efforts Group. The purpose of the meeting was to present to the NRC staff the Group's proposed response to GL 89-10, and to inform the NRC that they intend to proceed with a graded approach. The group indicated that the approach proposed is a blend of deterministic and probabilistic aspects.

An assessment of the risk importance of motor operated valves (MOVs) at Monticello identified 10 M0Vs which accounted for 99.9% of the cumulative Fussell-Vesely ranking. The proposed approach appears to be a reasonable method for identifying important MOVs in response to GL 89-10, which would require the closest attention with respect to operability.

Ft. Calhoun Problems with Pressurizer Power Operated Relief Valves (PORVs)

During routine surveillance testing of the pressurizer power operated relief valves (PORVs) at Ft. Calhoun, the licensee observed that one of the valves initially opened with the upstream loop seal water at the valve inlet, but did not properly oper. on demand with steam conditions after the loop seal cleared.

As a result, the licensee removed both PORVs and sent them to Wyle Lab for followup testing and root cause investigation. The subsequent testing performed at Wyle indicated the same behavior of the same valve which did not perform properly at the plant. This valve ;as then disassembled, and it was found that the main valve cage, which surrounds the main disk guide, was distorted such that system fluid could enter between the guide and cage. The i

licensee believes that this condition could have allowed sufficient flow into the area below the disk and caused the valve to not open.

Further, the licensee believes that since the loop seal water would have more viscous resistance to entering this area, the valve thus operated better with the loop seal at the valve inlet. The licensee is attempting to determine the cause of the cage distortion including whether it is a maintenance or inservice phenomenon. The licensee now plans to drain the PORV loop seals before the OCTOBER 22, 1993 ENCLOSURE A c

4 end of the current outage, replace the necessary valve internals, and test the valves with steam before reinstalling.

The licensee also found cracking along the main disk surface which faces the valve discharge (an area not in ccntact with the system fluid when the valve is closed.) The licensee is planning to section this disk to determine the nature of the cracking. The second PORV also had cracking in this area but to a smaller extent. The licensee discussed this with the valve vendor, Dresser, who indicated that cracking in this area is very rare.

Currently, the staff does not believe the Ft. Calhoun experience is of generic significance since there are no other Dresser PORVs at other facilities which are installed with loop seals. These valves were successfully tested in the EPRI test program in 1981, and there has been generally successful operating experience with them (with a few exceptions including the THI-2 event in 1979 when a PORV stuck open for unknown reasons.) The staff of NRR, AE0D, and Region IV will continue to follow the licensee's investigation.

Participation in International Workshoos on Diaital I&C Systems During the week of October 18, 1993, members of the Instrumentation and Controls Branch (HICB) attended separate meetings in Europe concerning development of criteria for design of digital instrumentation and control systems. An HICB staff member and a counterpart from RES attended an international workshop at Halden, Norway. The workshop was intended to plan future research at the Halden facility into digital system verification and validation (V&V) methods. This research will assist the staff in the development of V&V criteria for the Standard Review Plan update. Another HICB staff member attended an IAEA specialists conference in Paris on digital systems design criteria development. The conference included a visit to the Chooz B site to see the digital I&C systems being installed in the plant.

Participation in the Nuclear Utilities Software Manaaement Group (NUSMG)

Conference in Annapolis. MD On October 21, 1993, William Russell, Associate Director for Inspection and Technical Assessment, NRR, Bruce Boger, Director, Division of Reactor Controls and Human Factors, and members of the Instrumentation and Controls Branch, attended the NUSMG Semi-Annual Workshop in Annapolis, MD. Mr. Russell made a presentation on diversity and quality review criteria for digital instrumentation and control system retrofits to operating reactors. The presentation provided the nuclear industry participants with information on the staff's recent experience with digital I&C system diversity in operating plant retrofits as compared to the approach taken in the advanced reactor design reviews.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending October 22, 1993 Inspection at Nuclear Fuel Services. Inc.

)

The Inspection Section of the Operations Branch conducted a spec!al material control and accounting (MC&A) inspection at Nuclear Fuel Services, Inc. (NFS) during the week of October 12-15, 1993. The primary purpose of the inspection was to assess the current status of plant operations and stored materials as they relate to the ongoing plant cleanup and close-down. The inspectors examined all remaining storage areas for special nuclear material (SNM) and designated areas for ongoing activities.

The current quantities of SNM on site were also determined. As a result of observations and discussions with licensee management, it was determined that the NFS close-down has had no adverse MC&A safeguards implications to date.

Staff also concluded that present NFS staffing levels are adequate to perform required MC&A safeguards activities.

Intearated Safety Analyses Department of Energy safety analysis experts from the Savannah River Technology Center (SRTC), who are developing guidance for the Division of Fuel Cycle Safety and Safeguards on methods to perform Integrated Safety Analyses (ISA) of fuel cycle facilities, were accompanied by a member of the Regulatory and International Safeguards Branch, while visiting the Babcock &

Wilcox (B&W) fuel fabrication facilities in Lynchburg, Virginia, on Oct. 18-20, 1993. The purpose of the visit was to expand their exposure to the kinds of processes and safety issues faced by NRC licensees, as well as to review the approach to ISA being used by the B&W Naval Fuel Division for its scrap l

recovery operation. A similar visit was to the Westinghouse fuel fabrication facility in Wilmington, North Carolina.

International Safeauards Environmental Measurements System Database.

On October 13, 1993, members of the International Safeguards Section met with representatives of the Rattian Corporation to discuss their International Safeguards Environmental Measurements System (ISEM) database. This database contains information on 46 commercially-available environmental monitoring techniques and could be used by the Internatit,nal Atomic Energy Agency as a tool for implementing an environmental monitoring program to detect undeclared facilities. The database will allow IAEA inspection planners to compare the various techniques based on weight of equipment, cost, sensitivity, etc.

Industrial and Medical Nuclear Safety On October 19, 1993, Carl J. Paperiello, Director, IMNS and Dennis Rathbun, Director, OCA, discussed medical regulations with Bob Alvarez from Senator Glenn's Staff. On October 22, 1993, they will discuss the Nuclear Regulatory Commission's medical regulatory program with several members of Senator Metzenbaum's staff.

1 ISFSI License Issued for Prairie Island On October 19, 1993, the U.S. Nuclear Regulatory Commission issued Materials License SNM-2506 to Northern States Power Company (NSP), authorizing receipt and storage of spent fuel in an independent spent fuel storage installation (ISFSI) located onsite at its Prairie Island Nuclear Generating Plant, Goodhue County, Minnesota.

This ISFSI is to provide interim storage for up to 1,920 fuel assemblies stored in 48 TN-40 storage casks built by Transnuclear, Inc. NSP plans to load its first cask in 1994, if the State Legislature approves the State Certificate of Need for the ISFSI.

Technical Exchances on Radionuclide Micration and Near-Field Phenomena Related to Radionuclide Releases On October 13, 1993, representatives of the U.S. Department of Energy (D0E),

U.S. Nuclear Regulatory Commission, State of Nevada, and affected units of local government met in Los Alamos, New Mexico, to participate in a technical exchange and to discuss recent activities related to experimental and theoretical studies pertaining to the migration of radionuclides at Yucca Mountain. Topics discussed included methods of determining sorption, modeling issues, and strategies for modeling radionuclide migration. Presenters included representatives of DOE and consultants from Los Alamos National Laboratory, Lawrence Livermore National Laboratory, and Lawrence Berkeley Laboratory.

Presentations also were made by NRC staff and staff from the Center for Nuclear Waste Regulatory Analyses. On October 14, 1993, there was a second technical exchange an Near-Field Phenomena Related to Radionuclide Releases from the Engineered Barrier System (EBS). The purpose of this technical exchange was to discuss past, current, and planned experime 6,s and computer simulations of near-field phenomena for the Yucca Mountain repository, with emphasis or. thermal hydraulics and releases of radionuclides.

Discussions focused on items such as effects of heat on the saturation of the rock, circulation of air and water vapor, changes in water chemistry, and interactions of steaa and water with components of the EBS.

On October 15, 1993, there was a site visit, for those technical exchange par-ticipants who wished to attend, to the Los Alamos National Laboratory facilities where Yucca Mountain studies are being conducted.

Participants toured the Atomic Force Microscopy Laboratory, Photoacoustic Spectroscopy Laboratory, the Underground Caisson Experiment that is being used for flow tests and water chemistry work, and the Mass Spectrometry Laboratory whete dating of volcanic rocks is ongoing.

U.S. Department of Enerav Publishes " Case Study of Michioan low-Level Radioactive Waste Generators" The purpose of this study was to assess the nature and extent of problems associated with the ongoing generation, storage, and accumulation of low-level waste (LLW) in the State of Michigan since November 1990, when the State was denied access to LLW disposal facilities. The study evaluated socioeconomic, demographic, community infrastructure, fiscal, land use, cultural / historic /

3 aesthetic, and social / political / psychological impacts on local areas and the State. Minimal impacts were identified. Most LLW generators either have explored, or are exploring, options for volume reduction or waste minimization. The principal incentive for reductions in LLW is the avoidance of future disposal costs. The report states that the general trend indicates that some large volume generators will suffer a significant capacity shortfall before the year 2000. However, most generators stated that they would obtain additional storage capacity if needed. No significant impact on operations was noted by any generator. The report states that potential future impacts include switching to nonradioactive processes that may be more costly or less reliable. displacing productive operations with storage space, increased insurance costs, the need for financial assurance bonds, limits on opportunities to expand research, and increasing liability for disposal cost.

Access to Barnwell Facility Restored for the Central Compact On October 19, 1993, the Southeast Compact Commission voted to restore access for the States in the Central Compact to the low-level radioactive waste (LLW) disposal facility in Barnwell, South Carolina. The Southeast Compact Commission's contracts with States and compacts, for access to Barnwell through June 30, 1994, are conditional upon those States and compacts making progress in developing their own LLW disposal facility. The contracts are terminable by either party, for any reason, upon 60-day notice. Generators from the Central Compact had been denied access to Barnwell since July 1, 1993, following a Southeast Compact Commission vote in April to terminate the Central Compact's contract.

In addition, the Southeast Compact Commission authorized access for generators in the District of Columbia. They took this latter action because they recognized that the District could not site a facility within its jurisdiction. Access will be effective as soon as contracts can be executed.

The States of Michigan, New Hampshire, and Rhode Island, and Puerto Rico continue to be ineligible for access to the Barnwell fa:ility.

Office of Nuclear Regulatory Research Items of Interest Week Ending October 22, 1993 Public Workshop on Desian Certification Rules On October 13, 1993, the Nuclear Regulatory Commission published a Federal Register Notice (58 FR 53002) announcing a public workshop on November 23, 1993, at the Ramada Inn in Bethesda, Maryland, on topics related to the form and content of rules which will provide standard design certification for evolutionary light water reactor designs. The purpose of the workshop is to inform the public of the NRC's current proposals for approving standard reactor designs by rulemaking, answer questions posed by the meeting participants, and discuss recommendations or concerns raised.

This action is being taken to provide the opportunity for early public participation in the development of design certification rules.

In a related action, the staff is developing an advanced notice of proposed rulemaking (ANPR), which will be published in early November 1993, soliciting public comment on the same topics. This ANPR will also contain a draft of a proposed prototypical rule on design certification and is expected to be available at the time the workshop for discussion.

Radiopharmacy Proposed Rulemakina (10 CFR Parts 30. 32. and 35)

The proposed amendments to 10 CFR Parts 30, 32, and 35 on the medical use of byproduct material were published in the Federal Reaister in July 1993 for a 120-day public comment period. The amendments would provide greater discretion to properly qualified nuclear pharmacists and physician authorized users to prepare radioactive drugs for medical use; allow human research using byproduct material while protecting the rights of human subjects; and permit the medical use of radiolabeled biologics. The public comment period was ended on October 15, 1993. More than 200 comments have been received to date.

A cursory analysis of the comments indicates that the amendments are favored by a majority of the commenters. The staff is currently analyzing public comments in detail. The final rulemaking is expected to be completed in the summer of 1994.

Draft Staff Evaluation Report Reaardina Individual Plant Examination (IPE)

Submittal for the New York Power Authority James A. FitzPatrick Unit RES has completed its review and issued a draft staff evaluation report regarding the Individual Plant Examination (IPE) submittal for the New York Power Authority's J. A. FitzPatrick Nuclear Power Plant. The licensee estimates that the mean value of the core damage frequency from internal events at 1.9E-6/yr. The IPE did not identify any vulnerabilities with respect to core damage or containment performance, however, one of the plant modifications, which resulted directly from the IPE effort, included use of the fire protection system to provide emergency diesel jacket water cooling directly through the emergency water system. A number of other safety enhancement are being considered for implementation. Based on the review of the FitzPatrick IPE submittal, and site visit which included walkthroughs, technical discussions with plant personnel and analysts, and audit of " tier 2" ENCLOSURE C OCTOBER 22, 1993 a

information (selected fault trees, notebooks, and associated calculations),

the staff concludes that the licensee met the intent of Generic Letter 88-20.

In addition, the licensee plans to maintain a "living" PRA to support their accident management program.

Draft Staff Evaluation Report Reaardina Individual Plant Examination (IPE) i Submittal for Northeast Utilities Service Co. Millstone Unit 1 RiS has completed its review and issued a draft staff evaluation report regarding the Individual Plant Examination (IPE) submittal for Northeast Utilities Service Co. Millstone Unit 1 Nuclear Power Plant. The licensee estimates that the mean value of the core damage frequency from internal events at 1.lE-5/yr. The Millstone.1 IPE is based on a Level 2 PRA, and represents an enhancement to the 1985 Level 1 probabilistic safety study. A number of plant improvements have been implemented as a result of the IPE effort. The licensee plans to maintain a "living" PRA with periodic updates to support a risk management program, update training and implementation of l

technical specification improvements.

Incident Response Branch (IRB)

On October 19-20, the DOA Director and IRB Branch Chief met with members of Region III emergency response organization to discuss the Agency response to the loss of offsite power event at la Salle on September 14, 1993. A summary of the lessons learned and corrective actions will be developed.

During the past week, IRB staff continued to meet with representatives of other Federal agencies to rewrite the Federal Radiological Emergency Response Plan (FRERP), the document used to coordinate the Federal response to radiological emergencies. A final draft is expected in November.

Office of Administration Items of Interest Week Ending October 22, 1993 Contract Awards A contract was awarded to Conger & Elsea, Inc., on October 20, 1993 entitled,

" Incident Investigation Team Training." The contractor shall furnish qualified personnel, materials, and services to present (1) an Incident Investigation Refresher Course, (2) an Incident Team Training Refresher Course, (3) a Root Cause/ Incident Investigation Workshop and (4) a Human Performance Investigation Process Training Course. The contract was awarded for $961,000 and the period of performance is October 20, 1993 through October 19, 1998.

A contract was awarded to Andrew L. Hogg, Jr., on October 21, 1993 entitled,

" Inspecting for Performance Course." The contractor shall furnish qualified personnel, materials and services to (1) present and maintain the Inspecting for Performance Course inclusive of minor and major updates, (2) develop a version of the course specifically dealing with nuclear materials issues and (3) develop and present specialized versions of the course or additional courses which deal specifically with topics covered in the Inspecting for Performance Course. The contract was awarded for $263,554 and the period of performance is October 25, 1993 through October 24, 1998.

A contract has been awarded to install motion sensors in restrooms, copy rooms, elevator lobbies and conference rooms in One White Flint North.

The sensors, to be installed as part of NRC's energy reduction initiatives, will automatically turn lights on or off as individuals enter or leave a room. The sensors are expected to result in an energy reduction of approximately 63,000 kilowatt hours and an annual cost savings of $4,000. All work will be completed by November 30, 1993.

The petitioner requests that the NRC amend its regulations to revise the definition of the term " commercial grade item," to include a flexible generic process for the dedication of commercial grade items for safety-related use. The petitioner also requests that the regulations be amended to clarify that the entity performing the dedication of a commercial grade item is responsible for discovering, evaluating and reporting deficiencies as required by NRC regulations. The comment period for the petition closes December 28, 1993.

Office of Information Resources Management Items of Interest Week Ending October 22, 1993 Status of GA0 Review of Records Schedules Coverina Research Records The Office of Information Resources Management (IRM) discussed with the General Accounting Office (GAO) their review of the records disposition schedules covering the NRC's research records that were submitted to them on July 1,1993, for concurrence. Their preliminary analysis of the schedules and the proposed retention periods resulted in their recommending an increase in the retention period for the less significant summary data generated from experiments and tests from two years or sooner if no longer needed, to three years. GA0 believes that the three year retention period is required to ensure adequate records are available should they be instructed to review the research program at the NRC.

GA0 also recommended a change to the authorized disposition for source data files from

" Destroy when the program manager determines that the records have no probable value" to " Destroy when no longer needed for administrative or program purposes." GA0's formal reply is forthcoming.

Voice Mail There are 1,306 user mailboxes on the new system.

Of these, 1,019 have been initialized (78%) by staff members.

Training has been provided to 442 staff members.

Office of Nuclear Reactor Reaulation (NRR)

A tape backup system for the Events Assessment Branch applications server has been installed. NRR staff will perform file backup operations and maintain the inventory of tapes created by the backup.

UPS for Phillips Computer Center The Uninterruptible Power Supply (UPS) installed to support the Phillips Building Computer Center will be repaired this weekend and connected to the Power Distribution Unit.

Network Ceatrol Center The Network Control Center (NCC) is planning a meeting in Headquarters for Regional Resource Management staff involved in supporting networks in the Regional Offices.

The meeting will take place the week of November 29, 1993.

Some planned discussion topics include the NCC's organizational structure, AUTOS (Agency Upgrade of Technology for Office Systems) standards, LAN (Local Area Network) Administrator responsibilities, Network monitoring tools, and software products such as Netware 4.0, NetShield and Wordperfect Office 4.0.

On October 18, 1993, Office of Personnel staff attended an OPM workshop entitled " AIDS /HIV in the Workplace - A Manager's and an Employee's Perspective." Two speakers shared their experiences with HIV/ AIDS. One was the Director for Administration at the Comptroller of the Currency in New York, who supervised.two employees with AIDS. The other was an attorney with the HIV-Legal Clinic at the District of Columbia. School of Law, who is HIV-positive. A representative from the White House Office of National AIDS Policy Coordinator provided an update on new initiatives involving Federal agencies' workplace AIDS programs.

This program was sponsored by the Office of Small and Disadvantaged Business Utilization / Civil Rights and the Hispanic Employment Program Advisory Committee. The theme for this year's observance was " Hispanics: A Diversified Workforce To Change The Future." Dr. Nils Diaz, was the keynote speaker. Dr. Diaz is the Director of the Innovative Nuclear Space Power and Propulsion Institute as well as Professor of Nuclear Engineering Sciences at the University of Florida. Ms. Suzanna Valdez of the White House Staff delivered Presidential Greetings. Ms. Maria Lopez-Otin, OSP, was presented an award in recognition for the outstanding leadership she has brought to the efforts of the Hispanic Employment Program Advisory Committee.

The Commissioners' Conference Room was filled to capacity. The Office of Small and Disadvantaged Business Utilization / Civil Rights was pleased to see such a large number of NRC managers as well as their staffs in attendance.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on October 21, 1993, to Glendive Medical Center, Glendive, Montana. The action was based on a Severity Level III problem involving the hospital's having conducted nuclear medicine activities without either an authorized user or radiation safety officer. The base civil penalty of $2,500 was not adjusted.

A Confirmatory Order Modifying License was issued on October 20, 1993 to Ball Memorial Hospital, Muncie, Indiana. The action was based on the results to date of an on-going NRC investigation of circumstances in which Licensee nuclear medicine technologists, incle. ding the supervisory technologist, administered patient dosages that e ceeded the established radiopharmaceutical dosage ranges at that institution. The investigation has confirmed that, since at least 1988, nuclear medicine technologists have increased diagnostic radiopharmaceutical dosages by as much as 40% beyond the approved dosage range but did not record the dosage increase in the required NRC record. The Licensee terminated one employee and suspended another.

The Licensee subsequently allowed the suspended individual to return to non-NRC licensed activities. The Order requires the use of unit patient dosages or two-person verification of the patient dosage amount, radiation safety and compliance audits, and increased coverage by an Assistant Radiation Safety Officer. The Order also requires the Licensee to furnish the NRC staff with a copy of the report of its own internal investigation into the matter. The NRC investigation is continuing. The Licensee has agreed to the enforcement action.

Civil Penalties Paid The City of Columbus paid the civil penalty in the amount of $2,000.

The r

action was based on a violation involving the present and two former RS0s deliberate actions involving removal of source rods in moisture density gauges for cleaning, when the individuals were not authorized to do so. The licensee responded to the Notice in a letter dated May 19, 1993. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty.

Office of Consolidation Items of Interest Week Ending October 22, 1993 Second Buildina Status During the week, the marble for the Exhibit area arrived on the site and about 95 percent of the ceiling is installed in the public corridor and the Exhibit area on the Plaza level (Floor 1). Lights and ceiling tiles are in on all floors except Floors 2 and 3.

All or most of Floors 10, 8, 7, 5 and 4 have carpet tile. Some floors have cabinets, sinks and running water in coffee stations, vending areas and special areas.

Built-in credenzas, chair rails and motorized viewing screens are already installed in some conference rooms on several floors. Two-person teams are working in LAN Server rooms on Floors 4-10 pulling cable. Ceramic tile is being installed in revised bathrooms.

On October 18, Lerner Enterprises notified GSA by letter that delivery of substantially completed Floors 4-10 and the Plaza lobby and Exhibit area are anticipated during the period November 4 through November 11.

Lerner requested walk-throughs to note any discrepancies that would impede acceptance of these floors by GSA. The Lerner dates for substantial completion seem exceedingly optimistic based on progress as of October 23.

On October 20, Consolidation staff met with Lerner, OMNI, Haworth, Baltimore Stationery and their installer, Harford-Forest, and Transwall and their installer to discuss coordination of delivery and installation of the systems furniture and demountable walls.

At the weekly progress meeting on October 20, Frank Gambino of Lerner, announced that the County permit reviews of Floors 2 and 3 were complete for construction and mechanical but were still pending for electrical systems.

Forum Quarterly Meeting on October 20-22, 1993 in Williamsburg, Virginia. Dr.

Salomon made a presentation on considerations for updating NRC's cost study of the LLW disposal process. NRC staff intends not to perform any further work in this area unless directed by the Commission. The Forum Executive Committee 4

I will consider the matter of how to proceed on the issue of cost and report to the Forum at its next meeting in January 1994. NRC School Volunteers Procram Fifteen NRC volunteers are tutoring students weekly from three schools:

Bethesda Chevy-Chase High School, Julius West Middle School, and Beverly Farms

Elementary School.

Two interns, Maudette Griggs and Andrea Wilford, are working with students at Beverly Farms on projects taken from an engineering program, the World in Motion.

Mike Cullingford (NRR), Harold Lefevre, and Rob Lewis (both NMSS) provided presentations to students and parents at Stedwick Elementary School's Science Night.

Other volunteers, scientists and engineers, are being interviewed by 4th and 5th grade students from Potomac Elementary School in a series of career talks being taped at NRC. Another series of career presentations are taking place at Robert Brent Elementary School in the District of Columbia.

TWFN Exhibit Center The Exhibit Center Planning Committee has met twice to discuss the purpose of the Center, expected target audiences, kinds of exhibits (e.g., multi-media, graphic, photographic), display of NRC publications, rotation of exhibits, and use of contractual assistance.

In addition, the Committee visited the Exhibit Center space in TWFN to get a better idea of the amount of space for exhibits. Specific topics to be depicted by exhibits will continue to be discussed and incorporated as appropriate in a draft statement of work to obtain a contractor to help with planning, designing, building, and installing exhibits. Availability of exhibits from nuclear power plant visitors centers is being pursued through regional public affairs officers.

In late September, Robert Dautray was appointed High Commissioner for the French Atomic Energy Commission (CEA). Mr. Dautray is a long time member of CEA, most recently serving in the position of Scientific Director. Dr Dautray replaced Dr. Jean Teillac who retired after serving nearly twenty years in this position.

(CEE) countries met with the Chairman, Commissioner Rogers, Commissioner de Planque, the EDO Jim Taylor, and OIP Director Carl Stoiber to report their.

views on NRC's inspector training program for CEE inspectors.

The inspectors, Messrs Yordan Harizanov (Bulgaria), Milan Musak (Czech l

Republic), Gyula Fichtinger (Hungary), and Miroslav Lipar (Slovak Republic),

have participated since August in NRC's first comprehensive training program for CEE regulatory inspectors. The training, funded by AID, was based in Region I.

The program consisted of training sessions conducted by regional staff, a PRA course held in Region III, courses at NRC's Technical Training Center in Chattanooga, TN, and par ticipation in several site inspection activities. They also received three days of training on a range of licensing l

issues while in Washington.

The training program was designed to familiarize the participants with NRC 7

inspection philosophy and procedures, which they could draw on for developing their own formal national inspection procedures (explicit, written inspection procedures are currently lacking in most CEE nuclear inspectorates).

The visitors commented that they found the training to have been most beneficial to them, and that they intended to incorporate the bulk of the information received into their own inspection programs.

Visit of JAERI Vice President Tsu.ii On Thursday, October 21, Vice President Eiichi Tsuji of the Japan Atomic Energy Research Institute (JAERI), accompanied by Mr. Tsutao Hoshi, Deputy

Tennessee Vallev Authority - Watts Bar On October 19, the Regional Administrator, the Office Director of NRR, an members of their staffs, were at Watts Bar site to conduct a meeting with the licensee regarding status of the facility.

The meeting was open to the public and received significant media coverage.

Tennessee Valley Authority - Seauoyah Sequoyah Unit 2 achieved criticality (Mode 2) at 4:39 p.m. on October 19, 1993.

NRC 24-hour inspection coverage continues.

The licensee is proceeding to the next hold point which is 30 percent power. The licensee will obtain NRC concurrence prior to increasing power beyond this hold point.

Unit I remains in cold shutdown in a refueling outage.

Carolina Power and Licht Company - Brunswick On October 20, the Deputy Regional Administrator met in the Region II office with representatives of the Carolina Power and Light's Nuclear Assessment Department to discuss the department's assessment activities.

Palisades Nuclear Plant On October 21, 1993, the Deputy Director, Division of Reactor Projects and selected members of the Region III staff, met with the Nuclear Engineering and Construction Manager of Consumers Power Company and members of his staff. The meeting was held to discuss events and corrective actions ass,ciated with primary water stress corrosion cracking (PWSCC) at Palisades, and how Palisades corrective actions compare with other industry experiences of PWSCC.

Midwest Quality Assurance Manaaers Meetina On October 21, 1993, the Regional Administrator made a presentation on the effectiveness of Safety Assessment and Quality Verification at Region III utilities during the semi-annual Midwest Quality Assurance Managers Meeting.

Perry Nuclear Power Plant On October 20, 1993, the Senior Vice President - Nuclear of Centerior Energy Corporation, the Vice President, Nuclear - Perry, and other :

members of Perry management met with the Regional Administrator, Region III, and other members of Region III management, to discuss the Perry Course of Action document which details plans to improve the performance of Perry over the next several years.

Issues of discussion included management reorganization, management focus, quality oversight effectiveness, and operation, engineering, and plant support improvement programs.

Dresden Nuclear Power Station On October 18 and 19, 1993, the Regional Administrator visited the Dresden Station. On October 19, 1993, the Regional Administrator, the Division Director of Radiation Safety and Safeguards, the Deputy Director, Division of Reactor Projects and the Assistant Director for Region III Reactors, NRR, presented the Dresden SALP 12 report to Commonwealth Edison Company at the Dresden Station. Licensee representatives in attendance were: the Senior Vice President; Vice President and Chief Nuclear Officer; Vice President, Nuclear Oversight and Regulatory Services; and the Dresden Site-Vice President.

of the Wyoming Department of Environmental Quality at the URF0 office on October 19, 1993. The purpose of the meeting was to discuss recent amendments to the license for the Pathfinder Mines Corporation's Shirley i

Basin Mill authorizing the receipt and disposal of byproduct material I

waste.

Comanche County Memorial Hospital - Enforcement Conference An enforcement conference was held on October 21, 1993, in the NRC l

Region IV office with representatives of Comanche County Memorial Hospital of Lawton, Oklahoma, to review the findings related to an inspection conducted on August 10-12, 1993. The conference focused on an apparent lack of management oversight of the radiation safety program which resulted in 13 apparent violations of NRC requirements.

Particular attention was focused on the licensee's failure to comply with Quality Management program requirements related to brachytherapy procedures.

South Texas Proiect Manaaement Meetina The management meeting with Houston Lighting & Power Company scheduled for October 20,1993, was cancelled because of airline flight cancellations. The meeting had been planned to discuss the STP Business Plan and ar.swer questions related to the planned improvements and the OCTOBER 22, 1993 ENCLOSURE R t

plan's correlation to restart issues and Diagnostic Evaluation Team l

findings. The cancelled meeting will be combined with a previously i

scheduled management meeting at the STP site on October 29, 1993. Media j

representatives and members of the public who arrived in the Region IV i

office for the cancelled meeting were informed of the meeting scheduled for October 29. Copies of the STP Business Plan were given to l

interested media representatives.

Discovery of Residual Radioactivity at the Morton Facility in Ooden.

Morton Automotive Safety Products, a business group of Morton i

International, Inc., reported to NRC Region IV on October 19, 1993, that source material contamination had been discovered at its Ogden, Utah, manufacturing facility. The thorium contamination was identified i

outside the manufacturing plant in early September by Morton's health physics consultant. Radiation levels identified during the initial l

surveys were reported to be approximately 30 times background levels. A concentration of thorium in excess of 60 picocuries/ gram was discovered i

in one soil sample. A detailed characterization survey of the site l

began on October 19, 1993. Morton officials have concluded, based on i

their initial surveys, that contamination levels currently identified l

pose no immediate health or safety risk. A training session was planned on October 20, 1993, to discuss survey findings with its employees.

l The thorium contamination apparently originated during the tin.9 e,at a source material license was issued by the AEC to Marquardt Corporation for the possession of magnesium-thorium alloy. The license was-issued t

in January 1958 and was terminated by the'AEC in April 1971. This

facility has changed ownership several times 'and now is owned by Morton International.

Region V staff to discuss the circumstances of the violation, the 4

training provided by the companies to supervisors, and the corrective actions taken."

Reaion V Participation in the Diablo Canyon Exercise i

Region V participated in a full-scale plume pathway emergency exercise at Diablo Canyon on October 20, 1993.

Regional participation included a 19 member site team and a 5 member base team. Region V also sent a l

4 representative to the California State Emergency Operations Center (E0C).

The exercise shifted to the ingestion pathway phase on October 21 and 22, 1

1993.

Four members of the site team and the E0C representative participated in the ingestion pathway phase of the exercise.
