Since modification #13 to contract # AT-(49-24)-1023 was not available i
to IE, it is somewhat difficult to respond to Dr. Saenger's February 18, i
1975 letter (enclosed).
This is an on-going problem - wherein' IE has not been supplied.with copies of the contracts or modifications thereto - with respect to medical consultants.
It is impossible for IE to determine what medical consultants are under contract and with what conditions unless such information is routinely made available.
Nevertheless, IE is aware of the situation wherein various consultants are receiving different levels of compensation.
In fact all but one of IE's inedical consultants were authorized by Dr. Knuth to receive
$80 per day for their service time:
Dr. Reynold Brown, Dr.- Bel ton Burrows, Dr. James Maxfield, Jr., Dr. Eugene Saenger, and Dr. George Thoma.
Only Dr. Niel Wald is receiving a different amount - $135 per day.
The situation for Dr. Wald arose because he alleged he was receiving
$100 per day when under contract to the AEC's General Manager's or-ganization.
He insisted on being recompensed at or near maximum for services rendered to IE.
IE considers Dr. Wald-- and the other doctors on retainer - as among the very best specialist in radiation health in this country.
Dr. Knuth has stated that "We should offer him (Dr. Wald) $300'per day if that is what it takes to get him...".
Obviously, IE and NRC are constrained by the legal limits established for reimbursing consultants under such contracts.
These same medical consultants can eans$300-$400 per day if employed by.the very same firms and organizat#ons IE 'i.s' investigating.

viously, these medical consultants are worth being recompensed at up j
to that level.
On the other hand, they have often used the information I
obtained on an IE assignment for publishing scholarly papers. This adds to their stature and, perhaps, increases requests for their services as consultants. This opportunity to publish scholarly papers -
perhaps not available when employed as an industrial consultant - may act as a form of recompense.

situations for which they are retained may represent the most in--
j teresting instances of human radiation damage occurring today. Thus, 6
their services to IE place them at the forefront of actual experience with problems in' radiation health. This further enhances their stature and, again, may act as a form of recompense.
Finally, one must raise i
the legal /public relations question.
If an fiRC official were ever asked what the compensation (for such a highly qualified consultant) was, would it be embarrassing -to admit it was less than the legal

Even if both the actual compensation and the legal maximum j
were only a small fraction of the normal compensation for such a consultant.
