ACRS Full Committee Meetina on GE ABWR Instrumentation and Control Systems On November 4, 1993, GE and NRR met with the ACRS to discuss the GE ABWR instrumentation and control (I&C) system design and the basis for the staff's approval of the design for certification under 10 CFR Part 52.

The staff and GE previously met with the ACRS Computers and Design Acceptance Criteria Subcommittees on November 2, 1993, to discuss this topic. As a result of the meeting, the ACRS agreed with the approach the staff has taken and documented in Section 7 of the ABWR safety evaluation report which relies on approval of:

1) the I&C system architecture and functional requirements, 2) the software development process with commitments to the industry standards, 3) the phased staff audit of the process, and 4) compliance with the Commission-approved diversity position.

Foreign Travel to Sweden On October 29, 1993, Amy Cubbage of the Reactor Systems Branch and Robert Perch of DSSA met with representatives of the Swedish Nuclear Power Inspectorate (SKI) in Stockholm, Sweden, to discuss the water level instrumentation issue and other regulatory issues including shutdown risk and core shroud cracking. On November 1, they met with ABB-Atom, and on November 2, they toured the Forsmark Nuclear Power Plant and met with plant personnel.

The NRC staff gained valuable insights into how the Swedish BWRs are resolving concerns related to noncondensible gases in the level instrumentation.

Two of the units at Forsmark have begun design work for a condensate chamber vent modification, and the third unit is planning to install a different condensate chamber design which prevents the buildup of noncondensible gases. This condensate chamber design has been in use at a Swedish PWR at the Ringhals site for the past two years, and the design was verified by testing prior to installation.

The Forsmark units are also planning to add a diverse means of level measurement other than differential pressure.

Concepts currently under consideration are an ultrasonic device (EMUS) in use at a German plant and an incore device that detects core cooling which has been in use at Barsebeck for the last 5 years.

Float switches are in use at Ringhals Unit 1, a BWR, and this level measurement device provides redundant and diverse start of ECCS injection.

Plants in Decommissionina Process - Status of Trainina Rule Exemotions NRR is responsible for seven plants in the process of being decommissioned; namely, Dresden 1, Indian Pt. 1, Rancho Seco, San Onofre 1, TMI 2, Trojan, and l

Yankee Rowe.

Exemptions from the recently issued training rule,10 CFR 50.120, are being processed for six of these plants.

Commonwealth Edison stated that Dresden 1 is staffed by Unit 2 personnel that would meet the training rule requirements; therefore no exemption is needed. The NRC staff agrees with this assessment and is preparing a letter to that effect.

The remaining six plants are being issued exemptions on the initiative of the staff as permitted by 10 CFR 50.12(a).

These exemptions only relieve the NOVEMBER 12, 1993 ENCLOSURE A

2 licensees from compliance with the systems approach to training requirements of 10 CFR 50.120; all previous training requirements and commitments are unaffected.

The Rancho Seco exemption has been issued. The training rule becomes effective on November 22, 1993, and the NRR staff is working closely with OGC in order to have the remaining exemptions, except for Indian Point 1, issued by that date. The Indian Point 1 exemption is scheduled for issuance by mid-December 1993. 'As the staff has determined that Indian Point 1 presently 1

meets the rule, the exemption need not be issued by November 22.

Calvert Cliffs Units 1 and 2 Both units are operating at 100% power with no significant problems.

The first transfer of spent fuel from the spent fuel pool to the Independent Spent Fuel Storage Installation (ISFSI) is scheduled for the week of November 15-19, 1993. The ISFSI is located within the plant site boundary and was licensed in accordance with 10 CFR Part 72, materials license No. SNM-2505, on November 25, 1992. The license is for 120 modules, each~of which is capable of storing 24 fuel assemblies. The fuel assemblies are contained in a dry shielded horizontal position module for long-term storage.

.i Three Mile Island Unit 1 Three Mile Island Unit 1 is operating at 100% power, producing 865 MWe, in its 20th consecutive day of operation.

No major components are presently out of service.

However, one of the two pressurizer Code safety relief valves has seat leakage of about 0.75 gpm. The leak rate has gradually been-increasing over the past 2 weeks. GPU Nuclear has consulted with the valve vendor (Dresser) to pursue options to reseat the valve.

NRR management and Region I are following this situation closely. The staff has advised the licensee that manually lifting the valve with the reactor at power, as contemplated by the licensee, would not be prudent. The staff recommended that'the plant be in hot shutdown'if that course of action were selected. A special review group was assigned by the licensee to review the options.

In a conference call on November 5, the licensee advised the staff that they have decided to manually lift the relief valve on or about November 14 and that the plant will be in hot shutdown for this test.

Diablo Canyon Units 1 and 2 The San Luis Obispo. Mothers for Peace (SLOMFP) requested a two week extension to their deadline for submitting proposed findings of fact with regard to the license recapture hearing. The ASLB granted SLOMFP's request and gave them until November 19, 1993, to submit proposed findings. 'The staff's and licensee's schedules have also been revised. Our proposed findings of fact are now due on December 10, 1993, and the licensee's response to the-staff'and SLOMFP is due December 20, 1993. The licensee issued their proposed findings as originally scheduled on October 8, 1993. The ASLB's decision is expected early in 1994.

.A Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending November 12, 1993 Site Familiarization at Westinahouse. Columbia. South Carolina During the week of November 1-5, 1993, two Licensing Branch staff members visited the Westinghouse Electric Corporation facility in Columbia, South Carolina.

The staff members were provided a site familiarization tour.

Items discussed included the licensee's preparation to comply with the changes in Part 20 regulations, air sampling techniques and liquid / air effluent treatment and monitoring. The staff members also participated in a Management Meeting with Westinghouse and Region II staff.

The licensee's performance during the last two years was reviewed and their strengths and weaknesses were characterized.

The licensee also made a presentation covering the progress of their Criticality Safety Margin Improvement Program. This program includes the implementation of a strong configuration control system, a hazards review, and a root cause analysis program.

Part 70 Standard Review Plan Meetinas The Nuclear Regulatory Commission is developing a Standard Review Plan (SRP) to provide guidance to staff who review applications for licenses, under 10 CFR Part 70, to produce enriched uranium or to process it in making reactor fuel. On Monday, November 8, 1993, at NRC headquarters, the staff held the second of a series of public meetings with fuel cycle licensees to obtain information relevant to the development of acceptance criteria for the various areas of review within the SRP..

Fourteen industry representatives were present, and provided useful comments concerning acceptance criteria for the review of submittals on radiation protection, environmental protection, decommissioning and waste management. The final meetings of this series are scheduled for November 15 and 16,1993.

Support to the International Atomic Eneray Aaency (IAEA)

Staff from the Division of Fuel Cycle Safety and Safeguards participated in l

the semi-annual review meeting of the U.S. Government Support Program. At i

this meeting, the U.S. Government and the IAEA reviewed the status of the

{

ninety-plus tasks of various magnitudes, which the U.S. Government funds in response to IAEA needs to keep IAEA safeguards effective. The IAEA confirmed that the present channels of communications for requesting assistance are working properly and should not be changed. The IAEA also discussed fifteen new areas in which they plan to request U.S. assistance in the coming year.

l Applied Radiant Enerav Corporation Sources Tested i

1 On October 21, 1993, in accordance with license requirements, Applied Radiant Energy Corporation (ARECO) performed leak tests of its 25 Waste Encapsulation and Storage Facility (WESF) sources. All sources passed the tests. Although not required, ARECO also performed " clunk" tests of the WESF sources and reported that all sources passed the tests. According to ARECO, "[1]imited visual examination and the results of this recent clunk test indicate that no changes in the sources have occurred."

2 AREC0, located in Lynchburg, Virginia, leases the WESF sources containing cesium-137 from the Department of Energy (DOE) for use in an underwater irradiator. ARECO continues to use the WESF sources, while maintaining increased surveillance, until DOE arranges for the return of WESF sources from commercial irradiators following the failure of one WESF source at the Radiation Sterilizers, Inc. facility in Decatur, Georgia, in June 1988.

Hearina on Scent Fuel Containers On November 8, 1993, Storage and Transport Systems Branch staff attended a field hearing on spent fuel containers before the Committee on Science, Space and Technology, Subcommittee on Energy.

The hearing was held in Newport News, Virginia. Mr. Robert M. Bernero, Director, Office of Nuclear Material Safety and Safeguards, presented testimony on the Nuclear Regulatory Commission's requirements for certifying spent fuel casks for storage and transportation and the relationship of these requirements to the multi-purpose canister system.

The multi-purpose canister system is currently being considered by the U.S. Department of Energy for the high-level waste repository program.

NRC/ DOE Meetina on the Multi-Purpose Canister System On November 9, 1993, staff from the Nuclear Regulatory Commission and the Office of Civilian Radioactive Waste Management, Department of Energy (DOE),

met for a presentation by DOE and DOE contractors on the conceptual design of the Multi-Purpose Canister (MPC) system.

State of Nevada representatives were also in attendance. The meeting focused on a description of the MPC concept and operating strategy, including conceptual design bases, identification of technical and programmatic issues, and a tentative schedule for MPC development.

Audit of West Valley Proiect Office Division of High-level Waste Management quality assurance (QA) staff observed a U.S. Department of Energy, Office of Waste Management, Vitrification Projects Division, quality assurance audit, of the West Valley Project Office (WVPO) from November 1-5, 1993, in West Valley, New York. The audit examined the adequacy and effectiveness of implementation of the WVP0 QA program and activities related to high-level radioactive waste. A staff member from CER Corporation participated in observing this audit as a representative for the DOE Office of Civilian Radioactive Waste Management. The State of Nevada and affected units of local government declined to participate as observers.

The Nuclear Regulatory Commission observers determined that the audit was effective in evaluating the WVP0 QA program, and agreed with the audit team that the overall WVP0 QA program implementation was effective. The audit team identified seven preliminary observations and issued four preliminary deviation and Corrective Action Reports at the exit meeting.

None of these is significant in terms of the overall WVP0 QA Program.

Site Visit to Araonne National Laboratory (ANL)

On October 27-28, 1993, representatives from the Nuclear Regulatory i

Commission, U.S. Department of Energy (DOE), the State of Nevada, and others participated in a site visit at ANL. The purpose was to focus on DOE's glass and spent fuel waste form research programs, including the primary parameters affecting waste glass and spent fuel performance.

During the visit, scientists from ANL, DOE, and NRC gave overview presentations on glass and spent fuel testing, a forthcoming DOE compendium of glass characteristics, and waste form performance, respectively. At the conclusion of the briefings, all participants were taken on an extensive tour of ANL's waste form testing facilities.

Briefings and presentations were given by ANL scientists on the following topics: metal corrosion testing; effects of glass surface area to volume ratios on dissolution; sample preparation; long-term static and drip tests of radioactive glass dissolution; glass natural analogues; colloid formation; glass modeling; drip tests of UO,

and spent fuel dissolution.

A general wrap-up and discussion period was helb at the end of the lab tour.

Maine Voters Approve Formation of a Compact with Texas On November 2, 1993, approximately 73% of the people voting in a statewide referendum in Maine approved the formation of a low-level radioactive waste coapact with the State of Texas. This statewide voter approval is required by Maine law.

In June 1993, legislation was enacted by the State of Texas to form a Compact with the States of Maine and Vermont.

Legislation ratifying the Compact was passed by the Maine legislature later the same month. Similar -

legislation is expected to be introduced in the Vermont legislature in January 1994. Congress must then ratify the Compact agreement.

Atlas Corporation Meets With Nuclear Reaulatory Commission Manaaement On November 8, 1993, Atlas Corporation's President, Steve Mantz; Chief Financial Officer, Mike Gross; and Vice-President for Regulatory and Governmental Affairs, Richard Blubaugh, met with management and staff from the Office of Nuclear Material Safety and Safeguards and the Uranium Recovery Field Office. Atlas requested the meeting to get a better understanding _of:

1) NRC's process for conducting a reevaluation of the Atlas reclamation plan and environmental assessment for its Moab, Utah mill; 2) a schedule for completion of the NRC staff's review; and 3) how NRC will recognize in its surety requirements, the Title X reimbursement payments which the U.S.

Department of Energy is directed to make under Title X of the Energy Policy Act of 1992.

In addition, the staff and Atlas discussed the company's economic considerations in disposing of the mill tailings, including the potential for a reduction in Atlas' financial. stability.

Representatives from the State of Utah, the U.S. Department of the Interior, U.S. Environmental-Protection Agency and the Grand County, Utah Council listened to'the

discussion through a telephone hookup and were provided an opportunity to'ask questions or comment at the end of the meeting.

l Staff Visit to' Atlas Mill Site in Moab. Utah On November 9, 1993, staff from the Uranium Recovery Field Office and Division d

of Low-Level Waste Management and Decommissioning performed field investigations at the Atlas Minerals tailings site in Moab, Utah.

The staff examined features of the Colorado River in the site area, including sediment distribution, high water. levels, erosion of stream banks, and channel configuration. The National Park Service assisted the staff in this effort by providing knowledgeable guides, who were familiar with channel configurations and erosion patterns in the area. The information gathered during these observations will be used in the staff's evaluation of the potential for flooding and the adequacy of the erosion protection design.

Environmental Protection Aaency Acoroves Final Amendments to 40 CFR 192 On October 29, 1993, the Administrator of the Environmental Protection Agency (EPA) approved final amendments to EPA's uranium mill. tailings standards in 40 CFR Part 192. The final amendments require timely closure of non-operational uranium mill tailings impoundments and verification that radon a

flux through the impoundment covers does not exceed 20 pCi/m s.

Uader a-settlement agreement signed by industry, environmental groups, and EPA in April 1993, EPA was required to promulgate the amendments before the end of October 1993, as part of a multi-step program to rescind EPA's Clean Air Act standards for uranium mill tailings disposal in Subpart T of 40 CFR Part 61.

fleetina with Nuclear Waste Pro.iect Manaaer of the Leaaue of Women Voters On November 5,1993, Nuclear Regulatory Commission staff met with the Nuclear Waste Project Manager of the Headquarters Office of the League of Women Voters.

The purpose of the meeting was to acquaint the Project Manager with the roles, responsibilities, and regulatory programs of the NRC for the high-level waste repository, spent fuel storage and transportation, low-level waste management, Enhanced Participatory Rulemaking, and public outreach.

The League of Women Voters presently has a grant from the Department of Energy to conduct a five-year educational and outreach program related to nuclear waste management.

Last year, during the first year of the project, the League updated and revised the Nuclear Maste Primer.

In the second year, the League is sponsoring a workshop in April 1994 to train League representatives in nuclear waste issues and how to communicate these issues effectively at the

" grass roots" level. The League will also be issuing six grants to local Leagues to conduct public projects related to nuclear waste. The Project Manager and the NRC staff agreed to communicate periodically and exchange information on the status of their respective programs.

Office of Nuclear Regulatory Research Items of Interest Week Ending November 12, 1993 Draft Staff Evaluation Report Reaardina Individual Plant Examination Submittal for ona Public Service Company's Palo Verde Units 1. 2. and 3 RES has completed its review and issued a draft staff evaluation report i

regarding the Individual Plant Examination (IPE) submittal for the Arizona Public Service Company's Palo Verde Units 1, 2, and 3.

The IPE was performed in two stages. The results of the preliminary stage showed a core damage frequency (CDF) of 1.0E-3/ reactor-year because of the dependence of several key plant systems on just two of four Class 1E DC power channels. The licensee "hsequently identified four modifications to address this vulnerability. The licensee's final IPE, which incorporated these modifications, resulted in a CDF of 9.0E-5/ reactor-year. The licensee did not identify any other vulnerabilities with respect to core damage or containment performance.

The licensee indicated that various additional improvements are being considered for implementation.

Based on the review of the Palo Verde IPE submittal and associated documentation, the staff concludes that the licensee met the intent of Generic Letter 88-20.

In addition to the IPE efforts, the licensee plans to maintain a "living" PRA.

Annual NRC/NUPEC Seismic Information Exchanae Meetina On October 26, 1993, in conjunction with the 21st Water Reactor Safety Information Meeting, staff members of Structural & Seismic Engineering Branch, RES; Civil Engineering & Geosciences Branch, NRR; Division Director and Deputy Division Director of DE, RES; and representatives of BNL met with Mr. Tanaka and Mr. Taira of Nuclear Power Engineering Corporation (NUPEC) of Japan and with Prof. Shibata of Yokohama National University.

This meeting was held to discuss some of the ongoing activities related to seismic engineering at NRC and NUPEC as a part of an annual information exchange.

Mr. Taira discussed NUPEC's ongoing activities related to model tests of embedment effects on reactor buildings (dynamic soil-structure interaction) and model tests of shear walls of reactor buildings.

NRC/BNL discussed the results of pre-test analyses conducted for the main steam and feed water system tests to be conducted by NUPEC.

In this collaborative effort NRC will be performing some pre-and post-test analyses while NUPEC is performing the tests.

which have emerged in connection with the ALWR reviews. NRC also discussed an i

RES project which is evaluating the cumulative impact on the safety margin of piping systems which may result from all of the proposed changes to the ASME code.

Prof. Shibata discussed a recent survey paper, which he authored, on seismic design practices for piping systems in Japan.

This brief meeting was extremely informative and several areas may be appropriate for further information exchange or collaborative efforts.

2 next meeting on the collaborative effort related to main steam and feed water tests will take place in the U.S. in December.

Cooperative Proaram on Containment Model Tests The steering committee for the joint effort on tests to failure of models of containment structures met on October 25, 1993, in conjunction with the 21st Water Reactor Safety Meeting. The tests are being performed by the Nuclear Power Engineering Corporation (NUPEC) of Japan and Sandia National Laboratories (SNL) under the sponsorship of the Ministry of International Trade and Industry (MITI) of Japan and the NRC. Models of a steel containment, representative of BWR designs, and a prestressed concrete containment, representative of PWR designs, will be tested at SNL, NUPEC is responsible for the design and construction of the models. The steering committee, based on both budgetary and technical considerations, set a test schedule of 1996-1997 for the steel model and 1998 for the concrete model. The committee also agreed to organize a multi-participant calculational effort in which pre-test predictions would be compared with test results and conclusions drawn about the fidelity of analytical models.

k Office for Analysis and Evaluation of Operational Data Items of Interest Week Ending November 12, 1993 Diaanostic Evaluation and Incident Investiaation Branch (DEIIB)

The formal exit meeting of the Quad Cities Diagnostic Evaluation Team (DET) was held on Monday, November 8, 1993 at the Quad Cities site. The Quad Cities DET Manager, AE0D and NRR Directors, Region III Administrator and other members of their staff attended the exit meeting. The meeting was open for public observation and received media attention.

Incident Response Branch (IRB)

IRB staff and NUS have begun upgrading the Emergency Response Data System (ERDS) software to run on an improved version of the operating system.

Testing will continue through next week.

On November 10, IRB hosted a meeting of the Response Subcommittee of the Federal Radiological Preparedness Coordinating Committee (FRPCC) to revise the Federal Radiological Emergency Response Plan (FRERP).

IRB participated in meetings with the Russian delegation from GrosAtomNadzur (GAN) to discuss the implementation of Lisbon Initiative No. 3.

This initiative concerns the establishment of an Incident Response Center within the Russian Republic.

Office of Administration Items of Interest Week Ending November 12, 1993 Traffic Study A purchase order has been awarded for an evaluation of traffic patterns for the 0WFN and TWFN garages. The contractor will evaluate the feasibility of establishing a one-way traffic pattern where vehicles enter the 0WFN garage and exit the TWFN garage. The contractor will also provide recommendations concerning mitigating traffic congestion, signage and lighting. The contractor will complete all work under this order by December 15, 1993.

Security Directors' Meetina On November 9, 1993 Raymond Brady, Director, Division of Security, and James Dunleavy, Chief, Personnel Security Branch, attended a meeting of Security Directors at the Office of Personnel Management (OPM).

The meeting was hosted by the OPM Assistant Director for Federal Investigations.

The meeting served to brief users of OPM personnel security investigations of ongoing initiatives, including possible effects of the National Performance Review on OPM's personnel and personnel security services.

Atomic Eneray Act of 1954 On November 10, 1993 Raymond Brady, Director, Division of Security, and an NMSS representative attended a meeting at DOE concerning a review of the relevant safeguards, security and classification provisions of the Atomic Energy Act to determine their currency, inter-agency relationships and changing requirements related to national security matters in light of the post cold war environment. A report is due to the Secretary of Energy by the end of 1993.

Uranium Mill Tailinas Reaulations: Conformino NRC Reouirements to EPA Standards A proposed rule that would conform existing NRC regulations governing the disposal of uranium mill tailings to proposed EPA regulations was published in the Federal Register on November 3, 1993 (58 FR 58657). The proposed rule is intended to ensure the timely emplacement of the final radon barrier and to require appropriate verification of the radon flux through that barrier. The comment period for the proposed rule closes December 17, 1993.

Fulemakinos to Grant Standard Desian Certification for Evolutionary Licht Water Reactor Desians An advance notice of proposed rulemaking that invites public comment on issues pertaining to the form and content of rules that will certify evolutionary light water reactor designs was published in the Federal Register on November 3, 1993 (58 FR 58665). The comment perior or the advance notice of proposed rulemaking closes January 3, 1994.

basis threat for radiological sabotage to include use of _a land vehicle by i

adversaries for transporting personnel, hand-carried equipment or explosives.

The comment period for the proposed rule closes January 3,1994.

Electronic Transfer The Office of Information Resources Management (IRM), in support of the Office of Nuclear Reactor Regulation, arranged for an electronic transfer of a softcopy of a Supplemental Safety Evaluation Report with Texas Utilities.

l This file transfer is in support of the NRC's Electronic Exchange Initiative with nuclear power plants.

The NRC is engaged in a demonstration of electronic exchange with a limited number of power plants, and is actively j

Records Destruction Of the 719 boxes of records eligible for destruction by the end of calendar year 1993, consistent with the NRC Comprehensive Records Disposition Schedule, NUREG-0910, IRM has received authorization to destroy 194 boxes of records in storage at the Archival Facility and 41 boxes in storage at the Federal Records Center.

IRM is awaiting responses from the responsible offices on the final disposition of the remaining 484 boxes of records.

The three separate occasions that this occurred have' collectively been classified as a Severity Level III violation.

By EN 93-081 dated August 12, 1993 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 75,000 to the GPU Nuclear. Corporation. The action was based on five radiological controls violations.

The licensee responded to the Notice in a letter dated September 20, 1993 and paid $50,000 of the proposed

$75,000. After careful consideration of the licensee's response and its arguments against the escalation of the civil penalty, the staff has concluded that the $75,000 civil penalty as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty is appropriate.

Accordingly, an Order Imposing Civil Penalty in the amount of $25,000 was issued November 9,1993.

This permit was suspended two days later by an inspector who took issue with the County staff who approved the permit. The matter was resolved by the end of the week and the 'stop 1

work' order will be rescinded. Work on Floors 2 and 3 moved ahead with closing of walls, and installation of ceiling grid and lights on Floor 3.

On November 11 and 12, the developer completed paving the TWFN perimeter driveway.

The purpose of the meeting was to discuss with the State officials the requirements and process for obtaining Agreement State status. State officials indicated that a draft Agreement State package would not be submitted until June 1994 for NRC review.

Maria Lopez-Otin, Federal Liaison, attended the November 10, 1993 meeting of the j

Subcommittee on Water Resources (SWR).

The SWP. was briefed on the impending i

announcement by President Clinton of the cieation of a National Science and Technology Council (NSTC). The NSTC_ wuld replace the Federal Coordinating Council of Science, Engineering and technology (FCCSET), be equivalent to the National Security Council in stature, and be chaired by the President.

It is expected that there will be 10 committees under the NSTC and that the Committee on Earth and Environmentai Sciences (CEES) will be one of them.

The FCCSET is a statutory council. and the SWR will continue its work to finish its report to submit to either body. Ms. Lopez-Otin has a copy of the proposed organization of the CEES ander the NSTC.

The SWR heard a presentation from Dr. Roy Mink, Presider.i of the Water Resources Institute in Idaho, which is part of the National Institutes for Water Resources.

The member universities of the NIWR conduct training at the graduate and post graduate level, as well as support a number of projects relevant to state and/or regional water needs. Please contact Ms. Lopez-Otin for more information.

EPRI International LLW Conference Stephen Salomon, State Programs, participated in the Electric Power Research Institute (EPRI) International Low-Level Waste (LLW) Conference which was held on November 10-12, 1993 in Monterey, California. Dr. Salomon co-chaired a panel on LLW disposal on which Richard Vollmer, Director, Office of Policy Planning, made a presentation on the NRC staff cost compilation of LLW disposal facility development.

Private Enterprise / Government Interactions Roundtable Conference Maria Lopez-Otin, Federal

Liaison, attended the First Annual Private Enterprise / Government Interactions (PEGI) Roundtable Conference on November 3-4, 1993 in Rosslyn, Virginia. Among the conference's objectives were:

to develop and foster direct lines of communication between Federal scientists and private sector researchers; to support the President's new technology direction to forge a closer working partnership among industry, Federal and State workers and universities; and to explore existing and future technology transfer mechanisms. The agenda of the conference included representatives from Federal NOVEMBER 12, 1993 ENCLOSURE M

agencies, universities, industry and international consortia.

The roundtable format elicited frank discussions and a number of insightful comments.

For example, there appeared to be a consensus that: (1) laws and regulations as presently constituted do not lead to efficient use of resources and a number of them Snould have a " sunset" clause; (2) in the present global economy, the idea et limiting patents to the country of origin may no longer be valid and may curtail private investment in research; and (3) there is a need to study the EFFECTS of environmental regulations and laws. Ms. Lopez-Otin, as a member of the PEGI group will be working on the proceedings of the conference and can make copies available to those interested when they are published.

4 Office of International Programs Items of Interest Week Ending November 12, 1993 Foreion Visitors On Tuesday, Mr. Takao Ishiwatari, President of Japan Power Reactor and Nuclear Fuel Development Corporation (PNC) visited NRC and had separate appointments with Commissioner de Planque and Commissioner Rogers.

In both meetings he made the point that although Japan's government had recently changed, there would be not change in PNC's programs.

He also emphasized his interest in developing a cooperative research program with the U.S. in the area of actinide burning.

Before departing NRC, Mr. Ishiwatari met very briefly with the Chairman.

On November 10, Mr. Philippe Rouvillois, Administrator General, and Mr. Hubert de la Fortelle, Director of International Relations, Atomic Energy Commission (CEA) of France met with Chairman Selin.

The Chairman summarized his observations from his trip to the FSU and CEE, and they discussed the recent decision by Ukraine to reopen the Chernobyl units. Additionally, they discussed the disposal of plutonium resulting from weapons dismantlement and the future of nuclear power in the U.S.

Geoffrey Stevens, Head of the Division of Nuclear Development for the OECD Nuclear Energy Agency met with'the Office of Research and the Office of Nuclear Reactor Regulation on November 10 to discuss nuclear development, plant life management, plant aging, and advanced reactors. Although Mr.

Stevens is with the OECD/NEA, his primary mission for visiting the U.S. was as a member of an International Energy Agency team to review " Nuclear. Policy in the U.S."

He also paid a courtesy call on Commissioner Gail de Planque, and attended the Commission meeting on Human factors.

Region I Items of Interest Week Ending November 12, 1993 1.

Enforcement Conference with Boston City Hospital The Division of Radiation Safety and Safeguards held a closed enforcement conference with Boston City Hospital on November 9, 1993.

The conference was conducted to discuss the apparent violations identified during a routine inspection conducted on October 6, 1993.

The apparent violations included the failures to secure licensed material and follow procedures in the licensee's Quality Management Program. Also discussed were several other minor violations related to the training of personnel, linearity tests of dose calibrator, and the notification requirements.

Enforcement action is pending.

2.

Northeast Utilities On November 8,1993, Northeast Utilities announced several personnel changes and an engineering reorganization affecting the Millstone and Haddam Neck sites.

The most significant personnel changes were the appointment of Mr. Donald Miller as the Senior Vice President of the Millstone Station, replacing Mr. Steven Scace; and Mr. Scace assuming the position as the Vice President-Nuclear Operations Services.

These changes are effective December 5, 1993. Mr. Miller was formerly the Vice President of the Peach Bottom Atomic Power Station.

The engineering reorganization consolidates all engineering functions by unit under the Engineering Director, a new position.

The personnel changes also resulted in the termination of eight former managers / supervisors.

The Executive Vice President will discuss these changes in a management meeting at Region I today.

Beaver Vallev Unit 2 i

An AIT is underway at Beaver Valley Unit 2 to review common mode failure concerns regarding the emergency diesel generator (EDG) sequencers.

EDG No. I and No. 2 had failed load tests on November 4 and 6, 1993, respectively. The failures were initially attributed to solid-state relays (Model 365A) made by Automatic Timing and Controls (ATC), Inc.

The failures would have prevented safety loads from sequencing onto the 1

safety buses during a LOOP /LOCA with a safety injection signal present, j

that is being propagated through the power supply to the ATC relays,

causing spurious reclosure of the ATC relay' contacts. A modification replaced conventional relays with the Model 365A relays in October 1990.

j The relays that failed have'been installed:since April 1992. The AIT i

continues to investigate overall EDG sequencer design _ and the' exact-nature of the failure. Unit.1 does not use the ATC relays and, as yet, does not appear to have the problem.

The Regional Administrator and other senior regional managers addressed topics ranging from licensee performance assessment to inspector identified impediments to performing inspections.

Quad Cities Station On November 8,1993, the Quad Cities Diagnostic Evaluation Team exit meeting was held at the Quad Cities Station. The NRC was represented by the Regional Administrator, senior NRC staff members from Headquarters, i

and the Diagnostic Evaluation Team Leader. The licensee was represented by Mr. J. J. O'Connor, Chairman and Chief Executive Officer and other Commonwealth Edison Company staff. The meeting was open to the public and the media. Thirteen diagnostic evaluations have been conducted since 1987. This was the third at a Commonwealth Edison facility; previous evaluations have been conducted at Dresden and Zion.

On November 5,1993, the Colorado Department of Health (CDH) asked the Denver District Court for a temporary restraining order and preliminary injunction against Ramp Industries Inc, a Colorado Agreement State licensee.

RAMP Industries Inc. is a treatment and disposal facility that accepts radioactive ma'.erials, hazardous materials, and mixtures of i

the two.

The restraining o. der will prevent the company from accepting any additional hazardous or radioactive waste until the more than 6000 i

drums of material currently in their custody are properly treated and disposed of, according to the Director of CDH's Office of Environment.

RAMP Industries Inc. has also failed to provide adequate liability insurance for its prorerty. Additionally, on November 5, 1993 the Rocky f

Mountain Low Level Radioactive Waste Board levied a fine against RAMP Industries Inc. for importing waste into the region without authorization.

The company is to pay $3000, within 30 days, and $6000 more if all illegally imported material is not properly disposed of within 90 days of the order.

In his new position, he will have no responsibility for nuclear matters and he.will report to Jack Greenwade, Group Vice President, Operations. Components of the plant i

support organization at the site have been reassigned to other site organizations as follows:

Industrial Health and Safety to the Vice President, Nuclear Generation; Emergency. Preparedness to the General Manager, Nuclear Licensing; Nuclear Training to the General Manager, Plant Services; and Facilities Management to the Manager,-Human Resources. These changes were effective on November 10, 1993.
