NOTICE OF VIOLATION AND NOTICE OF DEVIATION

(NRC INSPECTION REPORT NOS. 50-325/93-39 AND 50-324/93-39)

This refers to the inspection conducted by M. Shymlock of this office on

,

August 23 - 27, 1993. The inspection included a review of activities autho-

rized for your Brunswick facility. At the conclusion of the inspection, the

,

findings were discussed with those members of your staff identified in the

enclosed report.

.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice), and other activities appeared to deviate from commitments

to the NRC, as specified in the enclosed Notice of Deviation. We are

concerned about the violation and deviation because you failed to determine

correctly the functional status of a plant design feature and you failed to

meet a commitment to test this feature in the established time frame. These

issues are discussed below.

Your engineering organization did not correctly determine the functional

capability of the Emergency Diesel Generator (EDG) 2X LOCA jet assist feature.

i

Your letter to the NRC dated March 6,1993 regarding this issue stated that no

'

modifications were performed on this system which would have altered the

original tested capability. Based on performance of start-up testing you

.

concluded that the 2X LOCA feature met its design functional capability. The

!

testing performed on July 16, 1993 demonstrated that the EDG 2X LOCA jet

assist feature did not meet its design capability and your original functional

,

assessment was incorrect. Your September 20, 1991, response to an NRC Notice

of Violation dated August 21, 1991, documented your commitment to perform EDG

2X LOCA logic testing during the upcoming Unit I and Unit 2 refueling outages.

However, the Unit 2 testing was not performed until July 16, 1993.

It is our

understanding that the testing of Unit I will be performed prior to restart

from the current outage.
