l Office of Nuclear Reactor Regulation Items of Interest Week Ending September 10, 1993 Dresden I By Order and amendment dated September 3, 1993, the Dresden 1 SAFSTOR Decommissioning Plan, associated technical specifications, and a renewal of the Dresden 1 Possession Only License to April 10, 2029, were issued. This action followed a staff requirements memorandum from the Commission and publication of a Notice of Issuance of Environmental Assessment in the Federal Register.

Operational Readiness Assessment Team (ORAT) at Seouovah On September 2, 1993, the Special Inspection Branch completed a two-week Operational Readiness Assessment Team (0 RAT) inspection at the Sequoyah Nuclear Plant. The inspection team focused on a broad range of programs at Sequoyah and evaluated examples from both safety related and balance of plant systems. The team found that TVA had developed extensive pre and post restart plans. TVA's evaluations regarding work required to be completed prior to restart were found to be generally conservative. However, the team did identify nine specific deficiencies which fell into three basic programmatic areas; procedural adherence, procedural adequacy, and technical evaluative documentation.

Meetina with Enterav On September 2, 1993, staff from the Radiation Protection Branch met with l

representatives from Entergy Corporation at OWFN.

Entergy discussed their i

plans to use the new physical based source term to support license amendments for the plants operated by Entergy.

Entergy plans to pursue a number of l

amendments such as longer valve closure times after the final version of l

NUREG-1465 is issued.

Meetina with RESL On August 30 and 31, 1993, staff from the Radiation Protection Branch (PRPB) met with the staff of DOE's Radiological Environmental Sciences Laboratory (RESL) at the Idaho National Engineering Laboratory. The following issues were discussed and resolved: actions needed to close out two old FINS, adjustments needed in the way RESL prepares monthly reports, revisions needed in the S0W for FY94, and the status of FY93 tasks.

PRPB also toured the facilities and met the scientists working on the contract.

j Particioation in Palo Verde Access Authorization Inspection The Safeguards Branch accompanied Region V Safeguards inspectors on an access authorization (AA) program inspection conducted at Palo Verde from August 30 -

September 30, 1993. This was the 15th Regional inspection conducted in response to TI 2515/116 to assess implementation of selected licensee AA programs to determine if they meet regulatory requirements as reflected in their physical security plans and to identify program strengths and weaknesses SEPTEMBER 10, 1993 ENCLOSURE A

2 in the areas examined. One remaining inspection is scheduled for Davis-Besse from September 20-24, 1993, that will complete Regional inspections conducted under TI 2515/116.

Following completion of the Davis-Besse inspection, results of the overall effort will be evaluated and appropriate program changes initiated.

ODerator Licensino Recentralization Report On September 7,1993, ICF, Inc. submitted its draft final report on a study investigating the feasibility of recentralizing the operator licensing function. The study entitled, " Evaluation of the Operator Examination and Licensing Function," presents results and findings of the study and discusses recommendations (including pros and cons for centralization) for improving the operator licensing program.

The study is under review within NRR and will be used to support recommendations to the Commission regarding the operator licensing function.

ACRS Briefino on Dioital Instrumentation and Control System On September 9, 1993, William Russell, Associate Director for Inspection and Technical Assessment and members of the Instrumentation and Controls Branch, NRR, met with the ACRS to discuss digital instrumentation and control (I&C) system issues. The staff briefed the ACRS on the staff position on common-mode failure of digital I&C systems and diversity criteria for operating plant retrofits and advanced reactor designs. The staff also discussed the status of interactions with NUMARC on the development of guidelines for use by licensees when implementing digital I&C system retrofits under 10 CFR 50.59.

In addition, the staff discussed information learned from interactions with foreign regulatory authorities (NII, DSIN, and AECB) on digital system reliability and safety in closed session.

Future discussions with the ACRS on digital I&C system issues are expected.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending September 10, 1993 United States Safe and Secure Dismantlement (SSD) Japanese Deleoation Meetino The United States Safe and Secure Dismantlement (SSD) Comunity hosted a meeting from September 7-9, 1993, at the State Department, for an eleven-member Japanese delegation.

The purpose of the meeting was to present briefings to the Japanese delegation on the status of the U.S. SSD bilateral cooperation efforts with Russia, Ukraine, Kazakhstan, and Belarus, and to learn of Japan's efforts that are planned or underway with the former Soviet Union countries.

Two members of the International Safeguards Section participated in the meeting. The U.S. Nuclear Regulatory Comission gave a joint presentation with the Department of Energy (DOE) on September 9 that detailed the planned activities and the program status of the NRC/ DOE Material Control and Accounting and Physical Protectior. Subgroup.

At the end of the State Department briefing on September 9, the Japanese delegation traveled to Albuquerque to attend briefings given by members of Sandia and Los Alamos National Laboratories.

Nuclear Reculatory Commission Issues Supolement 1 to the Final Safety Analysis Report on Envirocare of Utah. Inc.'s Aeolication for a License On September 7,1993, the U.S. Nuclear Regulatory Comission staff issued Supplement 1 to the Final Safety Analysis Report (FSAR) on Envirocare of Utah, Inc.'s (Envirocare's) application for a license to receive, store, and dispose of byproduct material, as defined in Section 11e.(2) of the Atomic Energy Act.

The FSAR Supplement sumarizes the NRC staff review of Envirocare's responses to the 13 outstanding open issues identified in the June 18, 1993, FSAR.

Based on the review of the revised license application, the staff has concluded that Envirocare has resolved all the outstanding open issues and has adequately demonstrated compliance with all applicable standards and regulations.

Therefore, upon completion of the environmental portion of the review, the staff can license the Envirocare facility.

We anticipate that the Environmental Protection Agency (EPA) will issue its Notice of Availability (NOA) of the Final Environmental Impact Statement on September 24, 1993.

The earliest the license could be issued would be 30 days after EPA's NOA, which would be October 24, 1993.

Metalluro. Inc.. Filed a Petition Recuestina Relief under Chaoter 11 On September 2,1993, Metallurg, Inc., and Shieldalloy Metallurgical Corporation (a wholly-owned subsidiary of Metallurg, Inc.) filed a petition requesting relief under Chapter 11 of the Bankruptcy Code with the United States Bankruptcy Court.

On September 7,1993, Metallurg, Inc., and Shieldalloy Metallurgical Corporation forwarded to the U.S. Nuclear Regulatory Comission a copy of the Certificate of Commencement of Case.

Metallurg, Inc., the parent company, is currently not licensed by NRC, while Shieldalloy Metallurgical Corporation possesses two NRC licenses.

sites on NRC's Site Decommissioning Management Plan (Shieldalloy's Newfield, New Jersey and Cambridge, Ohio facilities).

In a follow-up call to i

Shieldalloy Metallurgical Corporation, the Vice President of Manufacturing i

stated that the company intends to adopt a " business as usual" approach as the corporation restructures its debt. He added that the Newfield, New Jersey facility will continue to operate, and the Cambridge, Ohio facility will proceed with site decommissioning activities.

Exoloratory Studies Facility Desion Control On September 8,1993, the Division of High-Level Waste Management (HLWM) 1 On-Site Representative (OR) attended a Civilian Radioactive Waste Management System Management and Operating Contractor (M&O) and U.S. Department of Energy (DOE) meeting in Las Vegas, Nevada, to discuss HLWM concerns regarding i

weaknesses and deficiencies in the Exploratory Studies Facility (ESF) design and design control process.

(These issues were addressed in the letter of August 20, 1993, from B. J. Youngblood, NRC, to D. E. Shelor of DOE,

The meeting also included detailed discussions on overall corrective actions and improvement plans to assure the design process will be conducted correctly and effectively. Senior management from the M&O and DOE, along with quality assurance (QA) and engineering representatives, attended and participated in 3

this meeting.

4 The meeting resulted in the identification of immediate and long term corrective actions involving engineering and QA procedures, training programs, root cause analysis programs, increased performanced-based surveillance and audit programs and improved management actions.

i Industrial and Medical Nuclear Safety The NRC has received a second petition pursuant to 10 CFR i 2.206, dated August 2, 1993, from the Northeast Ohio Regional Sewer District, Cleveland, Ohio.

This Petition requests that NRC institute a proceeding to modify the license of Advanced Medical Systems, Inc. (AMS) to require, inter af fa, that AMS provide adequate financial assurance to cover public liability pursuant to section 170 of the Atomic Energy Act of 1954, as amended (42 U.S.C. 5 2210).

The District alleges the bases for this request as 1) there being extensive evidence indicating prior discharge of Cobalt-60 by AMS, or its predecessor, the Picker Corporation, to the sanitary sewer and 2) hundreds of curies of loose cobalt-60 remain in AMS's London Road facility. The NRC will treat this request as a supplement to the District's petition pursuant to 10 CFR f 2.206 of March 3, 1993.

The Petitioner also makes two requests for action.

First, the District requests that NRC " require financial protection, available in the form of insurance, of certain of its materials licensees" in addition to AMS, the i

level of protection varying with risk to the public posed by the license.

If the District seeks the imposition of protection requirements upon a license category, a rulemaking petition would be required. Second, the District requests that the NRC institute proceedings to modify the licenses of all generators of radiological waste located within Cuyahoga and Summit Counties, SEPTEMBER 10, 1933 ENCLOSURE B

The Supplemental Petition states that the District has submitted a petition for rulemaking pursuant to Section 2.802 requesting that the NRC revise 10 CFR 5 20.303 and 5 20.3003 to require the same notification provision in all licenses issued by the NRC. This request for action will be consolidated with the District's rulemaking petition.

Proposed Amendments to 10 CFR Part 72 for Notification of Events:

On August 27, 1993, the Executive Director of Operations approved publication of a proposed rule to amend 10 CFR Part 72, " Notification of Events at Independent Spent Fuel Storage Installations (ISFSIs) and the Monitored Retrievable Storage Installation (MRS)." This action has been taken in response to public comments and to make Part 72 consistent with other parts of the NRC regulations. The proposed rule will ensure that significant occurrences at ISFSIs and the MRS, such as failure of safety equipment, contamination events, personal injuries, and fires and explosions, are promptly reported to the NRC so that it can evaluate whether the licensee has taken appropriate actions to protect the public health and safety and whether prompt NRC action is necessary.

The proposed rule has been forwarded to ADM for publication in the Federal Reoister for a 75-day comment period.

Day-Firino Weapons Firino Oualification Recuirements - 10 CFR Part 73 On August 31, 1993, a final rule was published in the Federal Register 4,

58 FR 45781) amending 10 CFR Part 73 " Physical Protection of Plants and Materials." The final rule requires that Tactical Response Team members, armed response personnel, and guards at Category I Licensees be qualified for l

day firing of their assigned weapons using updated qualification courses specified in Appendix H of 10 CFR Part 73. This modification provides greater assurance that these security force members will possess sufficient marksmanship and weapons manipulation skills to protect Category I facilities 3

against adversaries possessing capabilities which can be ascribed to the Design Basis Threat specified in 10 CFR 73.1.

The publication of this notice complies with the Staff Requirements Memorandum dated August 10, 1993, which had directed this action.

Meetino with EPA on Residual Radioactivity Standards 4

On September 1, 1993, staff from RES, NMSS, NRR, SP, and OGC met with staff from EPA's Office of Radiation and Indoor Air regarding continued development of radiological criteria for decommissioning. The discussions included a review of the rulemaking status by both NRC and EPA, discussions regarding procedures which might be used within EPA to prepare a finding of sufficiency for the NRC rule, and substantive discussions of technical topics related to modeling, the implementation of ALARA, use of the Keystone Center facilitated dialogue report on public participation, the flexibility and appromch to risk levels which might be afforded to licensees, and the relationship of criteria for structures to criteria for soils. The meeting was very productive, and raised a number of issues which will need to be pursued as the staff prepares 1

development of draft criteria. The NRC and EPA staff's plan to continue periodic information and technical exchange meetings, with the next meeting coming in early October.

2 Direct Containment Heatina RES has issued for peer review a draft report entitled, " Integrated Report on DCH Issue Resolution for PWRs," NUREG/CR-6109. This report represents a profound milestone in the NRC's overall efforts in resolving the DCH issue.

The report describes all aspects (probability of core damage secuences with a potential of high pressure melt ejection (HPME), probability that such core damage sequences actually proceed to vessel breach with high pressure, conditions of reactor coolant system and containment at tine of vessel breach, DCH containment loads, and containment strength) of the DCH issue resolution process and demonstrates the process for two plants.

It provides a description of the research programs (experiments and codes) that form the basis for resolving the issue, the application of the research in resolving the issue for two plants, Surry and Zion, and discusses the conclusions i

regarding the conditional failure probability due to HPME for these plants and the approach for issue resolution for the remaining PWR plants.

Office for Analysis and Evaluation of Operational Data Items of Interest Week Ending September 10, 1993 Diaonostic Evaluation and Incident Investication Branch (DEIIB)

During the period September 7-10, the Quad Cities Diagnostic Evaluation Team (DET) returned to the AE0D offices in Bethesda, Maryland to continue inoffice evaluation and planning in preparation for the third and final week of onsite evaluation activities scheduled for the week of September 20.

Incident Response Branch (IRB)

During the period September 7-10, IRB staff members were in Las Vegas to discuss lessons learned from the Federal Radiological Monitoring and Assessment Center (FRMAC)-93 (an exercise co-sponsored by the NRC and the Department of Energy). The meeting concentrated on the methods and processes to provide monitoring support in the event of a radiological emergency.

During the period September 7-9, an IRB staff member was in Region II providing training on the Emergency Response Data System to members of the regional response erganization.

On September 8, IRB staff met with a representative from the International Atomic Energy Agency (IAEA) to discuss plans for a training session for Eastern European countries on easy-to-use consequence assessment tools (Response Technical Manual-92).

Office of Administration Items of Interest Week Ending September 10, 1993 Contract Awards A sole source contract was awarded tr the University of California, Santa Barbara on September 8,1993, entitled " Seismic Transfer Functions and the Response of Groundwater and the Rock Mass to Seismicity at Garner Valley, CA (Phase 1)."

The contractor will drill a 600 meter bore hole in granitic rock and install instrumentation for rock mass response. The contract amount is

$332,956. The period of performance is for nine-months.

Three contracts were awarded on September 8,1993 in conjunction with NRC's FY 1993 Small Business Innovation Research Program. Office of Information Resources Management Items of Interest Week Ending September 10, 1993 Electronic Information Exchance (EIE) Task Force - Nuclear Information J

and Records Manaaement Association (NIRMA)

Several NRC staff from the Office of Information Resources Management (IRM) and the Office of Nuclear Reactor Regulation (NRR) participated in the EIE Task Force meeting held in Augusta, Georgia, August 29, 1993. IRM staff briefed the group on: the status of the five pilot exchange projects with licensees, NRC's Strategic Plan for Information Technulogy, and the Nuclear Documents System (NUDOCS) replacement.

The three subgroups (Process / Documents, Issues, and Technology) also presented their findings. Based on a survey of its members, the Process / Documents subgroup rated five categories of documents as the best candidates for electronic exchange: generic communications and licensee responses, inspection reports and responses to violations, license amendments and technical specification change requests, licensee event reports (LERs), and monthly operating reports (MORs). The Issues subgroup explained its major goals and objectives.

It will develop a preliminary listing of issues and survey industry and government for additional issues. After prioritizing the issues, the subgroup will develop a number of alternative methods for resolving them.

The Technology subgroup gave an overview of current industry standards used to exchange data, text, computer graphics, and bit-mapped images.

In upcoming meetings, the Task Force plans to have presentations from other government officials who have implemented electronic exchange with a regulated community and to arrange demonstrations of comercially available products that facilitate electronic interchange.

Comouter Security The Codes and Standards Section, responded to a request from IRM's software installers to check a microcomputer for a virus infection. The microcomputer was found to have the JOSHI virus.

It became infected from a disk supplied by another NRC user. This individual's computer was also found to be infected. The virus was eradicated from all infected computers and disks.

Special Pro.iect The File Center continued recrganizing the official materials license case files to segregate decomissioning records into separate folders within each case file and to place the remaining records in letter-size folder:. One hundred seventy cubic feet of records have been reviewed.

The File Center continued reassembling retired 10 CFR 50 docket case files to eliminate boxing together records with 41tfferent expiration dates.

This will ensure acceptance of the records for storage by the Federal Record Center. Seven hundred forty cubic feet of records have been reassembled.

Office of Enforcement Items of Interest Week Ending September 10, 1993 Sionificant Enforcement Actions i

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount l

of $50,000 was issued on September 9,1993, to Comonwealth Edison Company I

(Zion Nuclear Generating Station). This action was based on a Severity Level III violation, involving the August 1989 failure to perform a 10 CFR 50.59 safety evaluation for a change to the facility as described in the Final Safety Analysis Report. The change consisted of maintaining open, for an extended period, a 144 square foot auxiliary building missile door, thereby rendering the building ventilation system incapable of maintaining the design negative pressure relative to the outdoors.

In August 1992, after NRC prompting, a safety evaluation was performed, but the evaluation was technically deficient, and the problem went uncorrected until December 1992.

The base Severity Level III civil penalty of $50,000 was escalated 50 percent for NRC's identification of the issue, and mitigated 50 percent for the licensee's subsequent corrective actions. These considerations resulted in a zero net adjustment to the civil penalty.

EN 93-086 A Notice of Violation and Proposed Imposition of Civil Penalties in the combined amount of $2,000 was issued on September 9,1993, to John R. Sinkey, M.D., Toledo, Ohio.

A violation at Severity Level III was issued because the licensee failed to implement a Quality Management Program (QMP) prior to January 27, 1992. A QMP was not submitted until the staff issued a Demand for Information on May 14, 1993. A $1,250 civil penalty was assessed for that violation. The civil penalty was increased because the NRC identified the l,

violations (50%) and the prior opportunities the licensee had to identify the violations (100%). A Severity Level III problem was issued for 14 violations that in the aggregate indicated a breakdown in the management of the i

licensee's radiation safety program and a $750 civil penalty was assessed.

The base civil penalty was increased 50% because the NRC identified all of the violations.

EN 93-087 A Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $11,250 was issued September 9,1993, to Ingham Medical Center Corporation, Lansing, Michigan. This action was based on: (1) a Severity Level I problem for violations that led to a misadministration as a result of the Licensee's failure to prepare a written directive as required by the Licensee's quality management program and follow departmental procedures, and (2) a Severity Level III problem for violations associated with misadministration reporting i

Second Buildina Status During the week, work continued on the interior construction of TWFN.

Raised flooring for the Operations Center on Floor 4 was installed. Also on Floor 4, ceiling grid and light fixtures were installed.

On September 8, at the weekly progress meeting with the developer and GSA, the developer's representative announced that Montgomery County had agreed to issue construction permits for the remaining floors and areas of TWFN once the developer re-submitted drawings showing necessary revisions.

The developer submitted the revised drawings to the County on September 10.

On September 9, the Director and staff of the Office of Consolidation met with Haworth and Baltimore Stationery representatives to receive final furniture drawings for Floors 4 and 5 and to discuss furniture delivery schedules.

Office of State Programs Items of Interest Week Ending September 10, 1993 Meetina with IDNS Officials Roland Lickus, Region III State Liaison Officer, and other Region III staff met with representatives from the Illinois Department of Nuclear Safety (IDNS) on September 8,1993 in Springfield, Illinois. The purpose of the meeting was to review the Illinois resident engineer program. The State currently has resident engineers at LaSalle and Dresden.

In addition, four Region III senior reactor inspectors received training in the REAC coordinator function of the incident response program.

Meetina with Nevada Lecislative Counsel Bureau Reoresentatives Members of the Office of State Programs and Nuclear Materials Safety and Safeguards management and staff met with two representatives from the Nevada Legislative Counsel Bureau on September 9,1993 at OdFN.

The purpose of the meeting was to make introductions and provide a briefing on NRC's regulatory responsibilities for high-level waste (HLW) disposal, transportation, on-site storage and MRS licensing.

The Legislative Counsel Bureau supports the activities of the Nevada legislative HLW oversight committee, which was formed in 1985. The representatives indicated that the Committee chairman has expressed interest in meeting at some point in the future to get a similar briefing for new committee members.

Palisades Manaaement Meetina Roland Lickus, Region III State Liaison Officer, attended a management meeting with officials from the Palisades Nuclear Plant on September 9,1993 in Benton Harbor, Michigan. The purpose of the meeting was to discuss corrective actions and assessments related to numerous problems experienced at Palisades during refueling and previous fuel handling activities. Representatives from the State of Michigan attended the meeting.

l Office of Policy Planning Items of Interest Week Ending September 10, 1993 Task Force Report on Medical Radiation Protection In response to the Commission's request which followed the Task Force's report and Commission briefing of July 29 (SRM dated August 9,1993), additional information on the regulation of medical uses of ionizing radiation was i

obtained from the States and public interest and health care advocates. This information allowed the Task Force to further assess the scope and magnitude of the problem and identify and assess options which have the potential to result in a more effective allocation of authority and responsibility among Federal and State regulatory bodies to ensure adequate medical radiation protection.

Revision 2 of the Task Force report was issued on September 3,1993. The Task Force did not identify a current need to reallocate regulatory authority based on the lack of information to determine whether a health and safety problem currently exists and the lack of focus on this issue by all sectors contacted.

Office of International Programs Items of Interest Week Ending September 10, 1993 Foreion Visitors On September 9, Mr. Pierre Tanguy, Inspector General for Nuclear Safety at Electricite de France, met with the Chairman, Commissioners Rogers and Remick and the NRC technical staff to discuss advanced reactor certification, license renewal, performance based approaches, use of digital computers in nuclear power plant safety systems and the accident precursor program. On September 10, he met with Commissioner de Planque to discuss many of the same topics.

Dr. Rolf Brits of the Council for Nuclear Safety of South Africa met with members of the staff to discuss environmental monitoring of nuclear power plants and uranium processing facilities.

Shoreham Nuclear Facility to PECO's Limerick Nuclear Generating Station.

l The proposed plan will use barges to ship the fuel from Shoreham to PECO's Eddystone site located southwest of Philadelphia. The fuel will then be transferred to a rail car for shipment to the Limerick Station.

l Representatives of the City of Philadelphia and the State of New Jersey l

have expressed concerns relative to the shipment safety.

Vermont Yankee On September 9, 1993, a five member Augmented Inspection Team (AIT) was i

dispatched to Vermont Yankee to investigate two fuel handling incidents that occurred on September 3 and 9,1993. Vermont Yankee's refueling outage commenced on August 28, and refueling activity has been suspended pending resolution of the issues.

Duke Power Company - McGuire AIT On September 7, the Director, Division of Reactor Safety and the AIT Team Leader conducted a press conference to discuss the completion of the site activities by the AIT, their findings, and the licensee's schedule for Unit 2 startup.

Childress Service Corooration - Ooen Enforcement Conference On September 8, an Enforcement Conference was held in the Region II Office with representatives of the Childress Service Corporation, Beaver, West Virginia.

The conference was open for observation in accordance with the Commission's trial program. public Childress is a coal preparation company using density gauges containing licensed material. A July 27-28, 1993, NRC inspection identified an apparent violation for the unauthorized removal of one of the gauges and placement in a different location, where it was stolen.

Princeton Community Hospital - Enforcement Conference On September 9, an Enforcement Conference was held in tAe Region II Office with representatives of the Princeton Community Hospital, Princeton, West Virginia to discuss apparent violations identified in the areas of their quality management program and security of material. The conference was open for public observation in accordance with the Commission's trial program.

scheduled September 1993 refueling outage. Participants at the meeting will be the Acting Deputy Director for the Division of Reactor Projects, members of the NRC staff, and representatives from the Omaha Public Power District.

Meetino with Uranium Recovery Licensees and State Reaulatory Aaencies On September 9, 1993, the Transition Oversight Team (TOT) met with I

representatives of the American Mining Congress' Uranium Subcommittee, Wyoming Mining Association, NRC uranium recovery licensees, and State Regulatory Agencies. The meeting permitted interaction to discuss issues related to closure of the Uranium Recovery Field Office (URFO) in Denver.

The TOT was established as a working group by the Commission to coordinate the transition of activities from the URF0 to the Division of Low-Level Waste and Decommissioning, NMSS, and Region IV. A spectric task of the TOT is to meet with the affected industry and the involved states to provide information on the activities of the TOT and to obtain feedback related to concerns they have regarding interaction with NRC during the closure process.

The purpose of this meeting was to discuss the licensee's addition of a new dry conversion facility at their Richland, Washington Plant for the manufacturing of low enriched PWR and BWR fuel Additionally, the licensee provided the NRC with the status of their Criticality Safety Analysis update program.
