SUBJECT:
REQUEST TO TERMINATE LICENSE SNM-910 In accordance with the information contained in your January 27, 1993, letter and enclosure, supported by your certification on Nuclear Regulatory Commission Form 314 (dated February 12, 1993), and as confirmed by a November 30, 1992, letter to you from the State of New York, Department of Health, there is no longer a need for Rensselaer Polytechnic Institute to hold an NRC license for possession of special nuclear material.
Accordingly, pursuant to Title 10, Code of Federal Regulations, Part 70, Materials License SNM-910 is hereby terminated.
The State of New York, Department of Health, has been notified of this action.
In addition, NRC has ceased all processing activities with regard to your submissions, listed as follows, and considers them to be cancelled and requiring no further action.
- 1. Decommissioning Financial Assurance dated November 26, 1990
- 2. Possession Limits Application dated July 21, 1992
- 3. Renewal Application dated August 17, 1992 Enclosed for your information is a copy of the Safety Evaluation Report, including the Categorical Exclusion, which was prepared to support this action.

Materials License SNM-910. RPI's current SNM holdings are well below 350 grams, and are subject to a State of New York license (No. NYSHD-103S).

Discussion Due to RPI's reduced SNM holdings, and because New York is an Agreement State, and has issued a state license to cover RPI's limited SNM activities, there is no longer any need to maintain an NRC SNM license.

License SNM-910 is appropriate and will not adversely affect the common defense and security nor the public health and safety, and is otherwise in the public interest.

The staff has determined that the termination of Materials License SNM-910 is i
appropriate under the agreement between NRC and the State of New York, and j
that the criteria in 10 CFR 51.22(c)(ll) for categorically excluding an action i
from environmental review have been met.
Therefore, neither an Environmental Assessment nor an Environmental Impact Statement is necessary for this action.
