ANNUAL ASSESSMENT LETTER FOR WATERFORD STEAM ELECTRIC STATION, UNIT 3 (REPORT 05000382/2019006)

Dear Mr. Vazquez:

The U.S. Nuclear Regulatory Commission (NRC) has completed its end-of-cycle performance assessment of Waterford Steam Electric Station, Unit 3, reviewing performance indicators, inspection results, and enforcement actions from January 1, 2019, through December 31, 2019.

This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility. The NRC concluded that overall performance at your facility preserved public health and safety.

The NRC determined the performance at Waterford Steam Electric Station, Unit 3, during the most recent quarter was within the Licensee Response Column, the highest performance category of the NRCs Reactor Oversight Process (ROP) Action Matrix, because all inspection findings had very low safety significance (i.e., Green) and all performance indicators were within the expected range (i.e., Green). Therefore, the NRC plans to conduct ROP baseline inspections at your facility.

The enclosed inspection plan lists the inspections scheduled through December 31, 2021.

This updated inspection plan now includes planned security inspections which were formerly transmitted under separate correspondence. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. Routine inspections performed by resident inspectors are not included in the inspection plan. You should be aware that the agency is pursuing potential changes to the ROP, including changes to engineering inspections (SECY-18-0113, Recommendations for Modifying the Reactor Oversight Process Engineering Inspections), and other changes to the baseline inspection program described in SECY-19-0067, Recommendations for Enhancing the Reactor Oversight Process. Should these changes to the ROP be implemented, the engineering and other region-based inspections are subject to change in scope, as well as schedule. The inspections listed during the last twelve months of the inspection plan are tentative and may be revised. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes.

Vazquez 2 Additionally, during this period the NRC will schedule an additional inspection per a revised version of Temporary Instruction (TI) 2515/194, Inspection of the Licensees Implementation of Industry Initiative Associated with the Open Phase Condition Design Vulnerability in Electrical Power Systems (NRC Bulletin 2012-01) for any sites who elect to implement the guidance of the Industry Initiative on Open Phase Condition, Revision 3 (Agency Documents Access and Management System (ADAMS) Accession No. ML19163A176). Licensees will be individually notified when the NRC schedules these inspections.

On March 12, 2018, the NRC issued a Confirmatory Order (ADAMS Accession No. ML18072A191) (EA-17-132 and EA-17-153) to the Entergy fleet that included Waterford Steam Electric Station, Unit 3. On January 27, 2020, the NRC initiated a Confirmatory Order follow-up inspection at Entergy Corporate Headquarters in Jackson, MS, of the Confirmatory Order actions required to be completed by the end of calendar year 2019, in accordance with Inspection Procedure 92702, Followup on Traditional Enforcement Actions Including Violations, Deviations, Confirmatory Action Letters, Confirmatory Orders, And Alternative Dispute Resolution Confirmatory Orders. The results of this inspection, which are currently being evaluated, will be documented in NRC Inspection Report 05000416/2020011, 05000313/2020010, and 05000368/2020010, 05000458/2020010, and 05000382/2020011.

The NRC plans to conduct future follow-up inspections of the remaining open Confirmatory Order actions required to be completed by Entergy. The NRC will coordinate with Entergy to schedule these inspection activities.

On April 5, 2019, the NRC issued two Severity Level III traditional enforcement violations associated with willfulness and involving several instances of improper operator log-taking (ADAMS Accession No ML19095B573). Therefore, the threshold for performing Inspection Procedure (IP) 92722, Follow Up Inspection for Any Severity Level I or II Traditional Enforcement Violation or for Two or More Severity Level III Traditional Enforcement Violations in a 12 Month Period to follow up on these violations was satisfied. Inspection Procedure 92722 allows the review using IP 92702 if it is already being performed. Since these violations are being reviewed in their entirety under IP 92702 to follow up on actions associated with the related Entergy Confirmatory Order, the NRC does not plan to conduct a separate IP 92722.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of
