= WAIVER OF COMPLIANCE REGARDING FACILITY OPERATING LICENSE NPF-82, PARAGRAPH 2.C.(13) QUARTERLY DRILLS LICENSE CONDITION, SHOREHAM NUCLEAR POWER STATION, UNIT 1-(TAC NO. 75498)

~In its letter of'May 30, 1990, the Long Island Lighting Company (LILCO)

. requested interim relief from Paragraph 2.C.(13), Quarterly Drills License ,

Condition, of its Facility Operating License NPF-82 pending NRC staff action on its December'15,'1989 request to cease offsite emergency preparedness ,

,' . activities and to implement the defueled emergency preparedness plan. This p license condition, 2.C.(13), requires LILCO to conduct training drills such that:its offsite. emergency plan is exercised quarterly _with full or partial iparticipation by the Local Emergency Response Organization (LERO). . As a consequence, LILCO is next scheduled to conduct a LERO drill on June 20, 1990. .!

Because of the Shoreham facility's current 'defueled status and the NRC's Confirmatory Order, dated March 29 1990, prohibiting LILCO from placing any

-nuclear fuel into the Shoreham reactor vessel without prior approval from the-NRC,'the NRC is grantingLa temporary waiver of compliance to the requirement _,

iofFacilityOperatingLicenseNPF-82', Paragraph 2.C.(13). This waiver of '

compliance-is granted on the following; basis:

1. - Shoreham is defueled with-all fuel located in the spent. fuel pool, which is located outside of the primary containment: 1
2. NRC issued a Confirmatory Order on March 29, 1990 confirming the LILCO commitment not to move fuel back into the reactor vessel ,

without prior NRC approval; and

.- 3 . Design basis accidents for a nuclear facility in a defueled condition are all associated with a loss of water inventory in the spent fuel-pool or with fuel handling. These accidents do not require LERO assistance.

The NRC staff has commenced the administrative process to review the proposed
