(In your response, you~ admit the violations occurred.

However, you requested

mitigation)of the civil penalty on the basis that the mitigation factors in

.particul.ar case. . In addition, you also believe t1at the NRC has not provided:

an adequate. basis to conclude that FPC's EQ program had significant deficien-

cies following conclusion of the.1985 refueling outage because the NRC inspec-

tionifocused on' specific issues and was not an= integrated appraisal of FPC's EQ

program.-
