Dear Mr. Chairman:
This letter responds to your April 14, 1982 letter regarding the NRC positions of General Counsel and Deputy Executive Director for Operations.
We understand your concern that Commission decisions about these positions be made on the basis of merit and ability, free from inappropriate or undue influence.
The Commission's decisions about these positions will be made on that basis.
As Chairman, I received suggestions from a number of people inside and outside the NRC about personnel changes.
.However, my response was the same from the day I assumed my job: I ' wanted a suitable period to observe the performance of key staff members before initiating any changes.
While the Commission shares the view expressed in your April 14 letter about the preeminence of merit and ability, we are concerned about some of the questions in that letter.
We recognize the responsibility of the Committee to oversee NRC activities.
However, a degree of confidentiality must be accorded to the personnel decisionmaking process, and we would prefer to answer in general terms some of your ques-tions which most directly raise the confidentiality concern.
We believe that doubts which may be expressed about the basis for particular NRC personnel decisions will be allayed by the decisions we make.
The qualifications of the persons appointed to these positions will be available for public scrutiny.
Our responses, which are numbered to refer to your specific questions, follow:

There is no vacancy in either position at present.

that we intended to replace him when we identified a replacement.
After consultations with the Executive Director for Operations, I told the D'eputy Executive Director that he would be replaced.
This was done so that each fncumbent could take advantage of any other opportunity that might arise in the interim.
In the case of the Deputy Executive Director for Operations, I also told the incumbent that this could include other jobs in the NRC.

The actions taken so f ar have been to identify possib'e candidates and to interview a few-that appeared quali-fied.
This effo.rt will continue.

No formal or draf t criteria have been developed.
5.&6.We are concerned that our ability to make good personnel decisions will be chilled if we are required to provide the information sought by these questions in their literal detail.
Qualified persons cannot be expected to contribute f reely to the personnel decisionmakinc process if the detail of their parti-cipation is necessarily to be a matter of public record.
As Chairman, I have had conversations about the nomina-tion of people to replace incumbent staff members, and specific names have been given to me in some instances.
However, as I noted earlier, I have consistently held the view that a suitable period was needed to observe the performance of NRC staff members before initiating any changes.
As I have said, I am concerned that individuals suggesting names of possible candidates will be less willing to contribute freely if the detail of their participation is a matter of public record.

I belicye that dissemination of lists
-f possible candidates would constitute an unwarranted invasion of privacy of the individuals involved especially in view of the fact that some of these individuals have not'or may not ever be contacted.
In addition, we wil.l. accept proposed names fro'm any source.
The evaluation wili be independent of where the name arose.
Finally, the concerns expressed in our response to questions 5 and 6 apply with respect to identifying the individuals who have suggested candidates.

The Commissioners will make the final decision on a new General Counsel.
The Executive Director for Operations and I will decide on the Deputy Executive Director, but I will consult with the Commissioners.
b)
Interviews will be scheduled based on discussion with the Commissioners or Executive Director as appropriate to their decisionmaking involvement.
c)
The individuals involved as described above will participate in the interviewing process.
d)
The Commission will follow the process established by the Civil Service Reform Act for filling SES general positions.
Specific procedures vary depending upon whether the process will culminate in a noncareer appointment, transfer of a career member.of the SES, or an initial career appointment to the SES.
e)
The Commission will make the selection of the General Counsel.
The Executive Director for Operations, in consultation with the Chairman, will make the final selection of the Deputy Executive Director for Operations.
However, prior s
to the final decision, consultation with persons not employed by the Commission may be necessary, e.g.,
ref erence checks, conflict-of-interest checks, security checks.
