j WASHINGTON, D. C. 20555 June 21, 1982 Mr. Richard A. Udell Critical Mass Energy Project 215 Pennsylvania Avenue, S.E.
IN RESPONSE REFER Washington, DC 20003 TO F0IA-82-205
Dear Mr. Udell:
This is in respon' e to your letter dated April 20, 1982 in which you s
requested, pursuant to the Freedom of Information Act, nine broad categories of records generated by present NRC Comissioners, primarily Chairman Palladino and Commissioner Roberts, and the White House.
You provided some clarification on the scope of your request, noted below, during a telephone conversation between you and Linda Robinson on April 26, 1982, and provided further clarification and your fee waiver justification by letter dated May 10, 1982. At this time, we are providing the following responses to your request.
Category one.
Commissioner Roberts' office is continuing to search for and review records subject to this category, as clarified in your letter dated May 10, 1982.
Category two.
Chairman Palladino's office provided the record identified on enclosed Appendix A.
This record is being placed in the NRC Public Document Room (PDR), 1717 H Street, N.W., Washington.DC 20555, for l
public inspection and copying. The record will be filed in folder F0IA-l 82-205 under your name.
Commissioner Roberts' office has no records subject to this category of your request.
Category three.
The NRC Commissioners have no records subject to this category, which was clarified by you on April 26, 1-982 to cover the period since President Reagan's inauguration.
Category four.
Chairman Palladino's office provided the records identified on enclosed Appendix A, which will be placed in the PDR in folder F0IA-82-205.
The other NRC Commissioners have no records subject to this category.

~
Commissioner Roberts' office has no records subject to this request, which was clarified by you on April 26, 1982 to cover the subject of selection of NRC Commissioners.
Category seven.
The NRC Commissioners and the NRC personnel office maintain no records subject to this category.
(Foryourinformation,a staff member of the personnel office informed this office that NRC employs only two noncareer Senior Executive Service (SES) employees and that, with regard to career employees, political affiliation is covered by Merit System Principles found in Chapter 23 of Title 5 of the United StatesCode.)
Category eight.
Chairman Palladino's office provided the record identified on enclosed Appendix A, which will be filed in the PDR in folder F0IA-82-205. We will respond later on additional records subject to this category.
Category nine.
Commissioner Roberts' office informed this office that he does not have a phone log or a record of verbal communications.
Because the remainder of this category is too broad, Commissioner P.oberts has construed the phrase "any documents not requested above and not available in the NRC Public Document Room" to be limited by the paragraph following it.
He further construes "other industry or utility groups or companies or their employees" to mean groups or companies of the same type as those lisi.ed earlier. Accordingly, his office provided the records identified on enclosed Appendix A, which will be filed in the PDR in folder F01A-82-205.
NRC has determined that, in accordance with the Commission's regulations (10 CFR 9.14a), search fees will be waived for the ab6've-mentioned records which you have requested. This determination represents a finding by NRC, based upon the information which you have provided us regarding your purposes and intended use of the requested documents, l
that furnishing the information to you can be considered as primarily benefiting the general public rather than conveying a mere. private benefit to you.
We will notify you as soon as search for and review of additional l
records subject to your request are completed.
l Sincerely, L
i J. Felton, Director Division of Rules and Records Office of Administration l
