YOUR JUNE 4,1982 LETTER REGARDING SUBJECT REPORT

In the referenced letter, you indicate receiving a draft of NRC Inspection

Report 50-309/82-05 on June 1, 1982.

You also requested an extension of the

review deadline to July 3, 1982. This should clarify your understanding of the

status of the subject inspection report and respond to your request for extension.

Although the copy of the subject report you received on June 1 indicated it was

a draft, you should note that, in fact, it was an expedited version of the final

report signed by me on May 28, 1982.

The May 28, 1982 letter forwarding the report did not forward our enforcement

actions resulting from the findings of the report because of our current practice

of issuing the inspection report separately from our proposed enforcement in

cases where we need further information to understand the central issues involved.

An enforcement conference was held with you on June 2,1982, to obtain this

information.

Regarding your request for extension, it is not NRC policy to withhold reports

from public distribution pending licensee review of the factual content of the

report or its cover letter.

Rather, NRC withholds reports solely based on the

considerations discussed in 10 CFR 2.

Therefore, your request for a 30 day

extension has not been granted. You have 30 days from the date of the report to

identify information which you consider proprietary in nature and request the

withholding of this information.

You are welcome to respond, in writing, to the report findings. Your response

will be considered when we determine the scope of enforcement actions we will

pursue.
