This refers to the routine safety inspection conducted by Mr. R. Conte of this

office on January 17 - February 15, 1982 of activities authorized by NRC

License DPR-73 and to the discussions of our findings held by Mr. Conte with

Mr. L. King and other members of your staff at the conclusion of the inspection,

and to a subsequent meeting between Mr. Conte and Mr. S. Chaplin of your

organization on February 25, 1982.

Areas examined during this inspection are described in the NRC Reg. ion I Inspection

Report which is enclosed with this letter. Within these areas, the inspection

consisted of selective examinations of procedures and representative records,

interviews with personnel, measurements made by the inspectoc, and observations

by the inspector.

diso, on February 4, 1982, the inspector took air samples during a Reactor

Building Entry, which were analyzed in our regional office laboratory in

King of Prussia, Pennsylvania.

The basic purpose of these independent measure-

ments is to verify your capability for analyzing radioactive samples, and to

achieve and maintain comparable methods of analyses between your facility and

the NRC.

The complete data from these measurements will be reported in a

subsequent Inspection Report.

Our inspector also verified the steps you have taken to correct the items of

noncompliance brought to your attention in the enclosure to our letter dated

October 29, 1979. We have no further questions regarding your action at this

time.

Based on the results of this inspection, it appears that certain of your

activities were not conducted in full compliance with NRC requirements, as set

forth in the Notices of Violation, enclosed herewith as Appendices A and B.

These items of noncompliance have been categorized into the levels described

in the Federal Register Notice (45 FR 66754) dated October 7, 1980.

You are

required to respond to this letter and in preparing your response, you should

follow the instructions in Appendices A and B.

In addition to the need for

corrective action regarding items A and B of Appendix A, we are concerned

about the implementation of your management control systems that permitted

them to occur. Consequently, in your reply, you should describe in particular,

those actions taken or planned to improve the effectiveness of your management

control systems in the area of modification control.

With respect to Appendix B, we note that you have corrected this item, and

therefore you need only address the corrective steps which will be taken to

avoid further violation in your response.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, documentation of findings of your

control and accounting procedures for safeguarding special nuclear materials

are deemed to be commercial or financial information within the meaning 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the

provisions of 10 CFR 9.12; therefore, the pertinent section(s) of the enclosed

,

inspection report, Appendix B, and your response will not be placed in the

Public Document Room and will receive limited distribution. Additionally, in

accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10,

!

Code of Federal Regulations, a copy of this letter and the sections of the

enclosures that do not contain 2.790(d) information will be placed in the

,

NRC's Public Document Room.

If this report contains any information that you

(or your contractors) believe to be exempt from disclosure under 10 CFR 9.5(a)(4),

it is necessary that you (a) notify this office by telephone within 10 days

from the date of this letter of your intention to file a request for withholding;

j

and (b) submit within 25 days from the date of this letter a written application

to this office to withhold such information.

Consistent with Section 2.790(b)(1),

'

any such application must be accompanied by an affidavit executed by the owner

i

of the information, identifying the parts sought to be withheld, containing a

full statement of the reasons and basis for withholding and specifically

addressing the considerations listed in 10 CFR 2.790(b)(4).

The information sought to be withheld shall be incorporated as far as possible

into a separate part of the affidavit.

If you do not notify us of the intent

,

to request withholding in the 10 days specified, or if the written application

i

is not submitted in the 25 days specified, these sections of the report will

be placed in the Public Document Room.

Telephone notification of your intent

to request withholding or any request for an extension of the 10 day period
