By letter dated November 12, 2019, GPU Nuclear, Inc., Metropolitan Edison Company, Jersey Central Power & Light Company, and Pennsylvania Electric Company (collectively referred to as the FirstEnergy Companies) and TMI-2 Solutions, LLC (together with the FirstEnergy Companies, the Applicants), jointly submitted an application to transfer the FirstEnergy Companies licensed authority under Possession Only License No. DPR-73 for the Three Mile Island Nuclear Generating Station Unit 2 (TMI-2) (the License) to TMI-2 Solutions, LLC. TMI-2 Solutions, LLC is an indirect wholly owned subsidiary of EnergySolutions that has been established for the purpose of maintaining and decommissioning the TMI-2 facility. The Applicants also requested that the NRC approve conforming administrative amendments to the License to reflect the proposed transfer. The Applicants requested that the NRC consent to this transfer to implement expedited decommissioning at TMI-2. In addition, on December 12, 2019, the Applicants submitted a revised Post-Shutdown Decommissioning Activities Report including Site-Specific Decommissioning Cost Estimate for TMI-2 (ADAMS Accession No. ML20013E535).

The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this license transfer application request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in the characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application, as further informed by information provided in your December 12, 2019, transmittal to the NRC, and concluded that it provides technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the request in terms of protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

Based on the information provided in your submittal, the NRC staff expects to complete this review by July 2020. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date, the reasons for the changes, along with a new schedule, will be communicated during routine interactions with the assigned project manager. This schedule is based on the NRC staffs initial review of the application and it could change, due to several factors including requests for additional information and unanticipated addition of scope to the review.
