SUBJECT:

48 CFR CHAPTER 20 NUCLEAR REGULATORY COMMISSION ACQUISITION REGULATION (NRCAR)

Attached for your approval is a final rule to be published in the Federal Reaister that implements and supplements the Government-wide Federal Acquisition Regulation (FAR).

Backaround: On September 22, 1989, the Director, Office of Administration, signed a proposed rule which was published in the Federal Reaister on October 2, 1989 (54 FR 40420). The final rule implements FAR 1.301(b) concerning the a

issuance of Agency Regulations that supplement the FAR.

It also incorporates Agency policies, procedures, contract clauses, and solicitation provisions that govern the contracting process and otherwise control the relationship between the Agency and its contractors. This final rule also includes the organizational conflicts of interest language approved by the Commission on November 2, 1992 (pp. 107-113).

Public Comments: All public comments were considered in the development of this final rule. The public comments with staff responses are addressed on pages 7-17.

4 Backfit Analysis: The staff has determined that a backfit analyt,is is not required for this final rule because it does not involve any provision which would impose backfits as defined in 10 CFR 50.109(a)(1).

Notices: The appropriate Congressional committees will be notified.

Coordination: All offices were requested by memorandum dated October 2,1991, to comment and concur. These office comments were considered in the i

development of the final rule. The Office of the General Counsel has no legal objection.
