Dear Ms. Jackson:

Pursuant to the Freedom of Information Act, 5 U.S.C.

522, as amended and 44 C.F.R. Part 5 of the Federal Emergency Management Agency's regulations, Public Citizen's Critical Mass Energy Project requests the following documents regarding the ef fects of Hurricane Andrew on emergency planning and preparedness for the Turkey Point nuclear power plant.

Please consider " documents' to include reports, studies, test results, correspondence, memoranda, meeting notes, meeting minutes, graphs, chart.s, ~ diagrams, notes and summaries of working papers, conversations and interviews, computer records and any_other form of written communications inc h ding internal FEMA memoranda.

Pursuant to this

request, please provide all documents prepared or utilized by, in the possession of, or routed through FEMA related to the hurricane and the subsequent discussions between FEMA, the Nuclear Regulatory Commission and Florida Pcwer and Light which resulted in the shutdown of the Turkey Point nuclear power plant.

Please also provide any information on the current status of emergency preparedness for the Turkey Point-emergency planning zone (EPZ) including but not limited to the emergency planning requirements of 10 C.F.R. 50.47.

Pursuant to and in compliance with 44 C.F.R.

5.43 cf the Agency's regulations governing requests for waiver of fees, Public Citizen's Critical Mass Energy Project puts forth the fc11cwing information.

Public Citizens Critical Mass Energy Project seeks the requested information elely to centribute to and help shape the public debate on emergency planning and preparedness as it pertains to nuclear issues.

Public CitizenDiitical Mass Energy Project is a nationally known non-profit public interest organization founded in 1974.

We these documents in an analysis of Hurricane Andrew's will use effect on emergency planning and preparedness at the Turkey Point-Power Plant.

We plan to broadly disseminate the Nuclear information contained in this analysis to the press and the general public.

Our past publications have attracted attention in the local, national and trade media.

Some have addressed emergency planning and preparedness at nuclear power plants.

Thousands of copies of the reports have been sold or distributed to members of the public, industry, and citizen groups.

Since

" disclosure of the information is in the public interest because it is likely to contribute significantly to the public understanding of the operation or activities of the government and is not primarily in the commercial interest of the requester" (5 U.S.C.

552 (a) (4) (A) (iii); 44 C.F.R. 5.43 (a) ), we request a complete waiver of any processing or duplicating costs you might incur in providing-these records to us.

If you rule otherwise, please notify us before filling the request.

I If all or any parts of this request are denied, please cite the specific exemptions on which you rely in refusing to release the documents.

If in some way this request requires clarificacion or additional detail, please contact us.
