ENCLOSURE 1 NOTICE OF VIOLATION-Duke Power Company Docket Nos. 50-369 and 50-370 McGuire Units 1 and 2 License Nos. NPF-9 and NPF-17

During the Nuclear Regulatory Commission (NRC) inspectioni conducted ' on i

February 24, 1990 through March 26, 1990, violations of NRC requirements were identified. In accordance with the " General Statement of Polic

Technical Specification 6.8.1.a requires written procedures to be established, implemented..and maintained covering the applicable L

procedures reconenended in. appendix A of Regulatory Guide 1.33, Revision 2 February 1978.

Appendix A of Regulatory Guide 1.33 Revision 2, February 1978 Section 9.a.. states 'in part, that maintenance that can affect the.

performance of safety-related equipment should be properly performed in accordance with written procedures.

Station Directive 9.4.1, Handling of Station Procedures, states in part that each major change to a procedure shall be approved prior to use and that if'a-discrepancy affects the acceptance criteria of a procedure or

. prevents satisfactory completion of a procedure, a deficiency exists that shall be corrected prior to signing off the procedure.

Contrary to the above, the process to make a major change in maintenance procedure MP/0/A/7600/31 Limitorque HRC Gearbox for Butterfly Valves Corrective Maintenance, was not properly followed.during a modification.

On February 24,1990,: the maintenence procedure was signed off as complete prior. to the approval of a procedure change which affected the-satisfactory completion of the modification.

A torque value of 130 ft-lb was used to mount the gearboa to the yoke on Containment Spray Heat 1 Exchanger Service Water inlet uolation valve,1RN-134A, prior to having this torque value approved for use in the procedure.

This-is a Severity Level IV (Supplement I) violation applicable to Unit'l only.

. Technical Specification 6.8.1.h requires written procedures to be established, implemented, and maintained covering Fire Protection Program implementation.

Selected Licensee Commitment (SLC) 16.9.5, Fire Barrier Penetrations, states in part, that all fire barrier penetrations (walls, floor / ceilings, cable tray enclosures and other fire barriers) separating safety-related fire areas or separating portions of redundant systems irnportant to safe shutdown within a fire area and.all sealing devices in fire rated assembly 9o0509o381 900424 ADOCK 0500 ]9 DR a

penetrations (fire doors, fire windows, fire dampers, cable piping, and ventilation duct penetration seals) shall be operable. With one or more of t,

Contrary to-the above, during a field walkdown of the Unit 2 Auxiliary Feedwater system on March 15, 1990, the inspectors noted. fire door 601G

,C was blocked open, rendering it inoperable for an undetermined period of time.

No fire watch was posted and no hourly fire watch patrol was established.

Pursuant to the provisions of 10 CM 2.201, Duke Power Company is hereby l

l required to submit a written statement or. explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk Washington, DC 20555 with a copy to the Regional Administrator, Region !!, and a copy to the NRC Resident-Inspector, McGuire Nuclear Station within 30 days of the date of.the letter transmitting this Notice.

This reply should be clearly marked as a " Reply to a Notice of. Violation" and should include for each violation:

(1) admission or-

-denial of the violation, (2).the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved. (4) the corrective sicps which will _he taken -to avoid further violations, and (5) the date when full compliance will be achieved.

Where ' good cause is shown, consideration will be given to extending :the_ response time.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended,'. or

revoked or why such other action as may.be proper should not be taken.
